We have a dog on site. Dog is directly supervised by staff 24/7 just like the clients. Dog is either locked inside with us, or tied outside with us. Someone came to our facility claiming witnesses state that our dog killed one of their sheep. I tell them to kick rocks. A few hours later, someone from the city comes threatening to take the dog. I tell them they cant prove it was this dog. They tell us to work it out with the sheep owner. --- Ok, a few weeks went by and we didnt hear from the sheep owner again. My boss, the actual owner of the dog, was happy to just let it go, but he was worried that this time was passing because they were preparing some sort of legal action, so he did finally get in touch with them. A few weeks ago, they told us they had checked out the sheep and it was not going to make it. Now, they tell us they cannot produce a sheep. Ok, its been a few weeks. The remains are probably disposed of by now. A few weeks ago they say they had taken pics of the damage. Now they tell us they cannot produce the pics. A few weeks ago they tell us they have an eyewitness, later changed to multiple eyewitnesses. Now we find out it was one guy who reported it from work. He does not work within view of their field. He works at a city dump right next door to our facility and who has a history or verbally abusing our residents (telling them they should be penned in like animals, theyre rapists, homos, etc). Anyways, we started pushing the issue and we find out that this guy who works next door to us is in a bad mood one day and just decides he hates our kids more than normal. Maybe he decides they dont deserve a dog. I dont know. At any rate, he calls up a nearby sheep owner and tells them he saw our dog kill a sheep. They couple who own the sheep are so worked up they dont even go to their field to check it out. They come straight over here and start mouthing off. I tell them our dog never leaves the facility and it cant be our dog. They say theyll be back with police and leave. They then go to their field and find out there is no dead sheep. Instead of owning up to their error, they double down and call the city. Perhaps keeping up the act to save face. Police told them they dont have sufficient evidence so they called animal control. Animal control comes and I tell them they cant prove it was this dog. This dog never leaves the facility. Its always either locked inside or staked outside. The city leaves and we never hear from the couple again until we get in touch with them and piece all this together. Our dog is fine and sleeping on a couch right now. Edit: additional details. I'm 15 and trying to find my first job, and I walked into the Subway near my home and asked for a job application. The manager said he could start the interview now and gave me an apron and hat and had me go behind the counter and start making sandwiches. He said he needed to see me make sandwiches as part of the interview. Customers would walk up and tell me what they wanted and he'd watch me make them. This lasted for about 4-5 hours until the store closed, then he said I had to help clean up. I was there for about 6 hours in total, and when I got home my family was really upset that he made me stay and basically "work" for so long for my interview. They all are saying it was illegal and I should have been paid, is this true? The manager said he'd call me to let me know if I got the job or not. Should I expect to be paid for this? Posted: 30 Jun 2019 08:45 AM PDT Okay, so my partner and I live in a residential community, and our house is right next to the residential pool. To access the pool you must have a key to enter. Our bedroom window is facing the pool and we leave our windows open almost every night. Well, once summer hits, or spring/winter breaks, we begin to have problems with kids home from college jumping the fence to use the hot tub. I am up at 530 for work and they constantly wake me up. There will be about 6-10 of them usually. They've broken the gates, throw patio furniture into the pool, and last summer it was shut down because of vandalism. Which all of those costs come out of the HoA fees we pay. So my line of thinking is, if they have a key and are there past the pool closing (2200) but they are respectful and quiet, I dont mind. If they are loud and obnoxious, I call the cops, and if I see someone jump the fence no matter the time, I call. So I've called multiple times. Usually the kids do leave. One of the times it was all girls, and one fell jumping the fence and luckily didnt hurt herself. I called the cops and when they came out they apologized for ruining their fun, but they were called so they have to make them leave. And the cops were laughing and joking with them (I eavesdrop through my window). The last time I called, the office showed up and told the kids to leave because it was past closing. The kid said he lived here but didnt have a key. The cop told him to leave and then left. The kids got back into the pool and another kid showed up. I called the cops again and the dispatcher said she'd send someone out but they never came. They were there being very loud on a Sunday night from 1200-200. We are getting very frustrated because the police or not getting names, writing tickets, doing anything. And this happens multiple times a week. If someone gets hurt jumping the fence I dont know if that could be a lawsuit, but as I said, we are paying for the repairs through the HoA fees. Is there anything that we can do? Can the police do more when they're called? We talked to the HoA and theyre going to send out a letter highlighting pool usage rules, but some of these kids don't even live here. Husband is raping his incapacitated wife, and her DPOA doesn't care Posted: 30 Jun 2019 06:40 AM PDT I work at a nursing home in Alabama where a husband and wife are both patients. The husband has some forgetfullness but is alert to person, place and situation. The wife however is not alert to anything. She can't talk and is completely dependant on staff for all care. At night, her husband goes into her room and rapes her. She doesn't resist but my understanding is that if a person cannot communicate then sex with them is automatically rape. Most of the staff have seen or have heard about this. Management has been told, and they relayed their concerns to her DPOA. The DPOA is the daughter of the husband and wife. She says that it is not rape because her mother does not resist and anyway they are a married couple. I thought about reporting the husband for elder abuse but the problem is the DPOA would not cooperate with the police. All of the mother's information is protected by HIPAA so the police would not be able to get information from the staff who work at the nursing home. And they couldn't do a medical exam on her because the DPOA wouldn't consent to that. Is there any way the DPOA could get her status revoked? Or her decision overridden somehow? [link] [comments] |
My company tells customers food is transported below a certain temp, but I know it is not Posted: 29 Jun 2019 04:42 PM PDT Arkansas, US This has been an issue for over a year now. My company, a large international fast food company (I'm trying not to be too specific) has a document on its website that tells customers that food is transported at or below a certain temperature to maintain food qualify and safety. Internal documents tell me not to accept a food delivery if it is above this temperature. My district manager, however, told me to ignore this policy. If it was off by just a couple degrees that would be one thing, but food has been arriving upwards of 20-30 degrees above this temperature. At my boss' insistence, I've accepted food that is definitely a health code violation in Arkansas -- "food that is labeled as frozen... Shall be received frozen" -- it's not always been arriving frozen. I've tried escalating this though internal corporate means, but I was told by my manager that my district manager would not let me be promoted if I don't drop it. I can't drop it. When I told our distributor what temperature I could accept, he said "my truck doesn't even get that cold." They deliver to several locations in the state so I know they also are not getting food in temp. I think this is why I was told to drop it; it's too big of an issue so a major pain to address. I know I'm just a small fry in this company, but I'm trying to find some sort of law I can show corporate to get this fixed. Since the temperature is on a document available on the company website, would that be considered advertising/false advertising? I've also found a law regarding deceptive trade practices:
4-88-107. Deceptive and unconscionable trade practices generally. (a) Deceptive and unconscionable trade practices made unlawful and prohibited by this chapter include, but are not limited to, the following: (1) Knowingly making a false representation as to the characteristics, ingredients, uses, benefits, alterations, source, sponsorship, approval, or certification of goods or services or as to whether goods are original or new or of a particular standard, quality, grade, style, or model; My question is, would this be considered a false representation of source, perhaps? Instead we have to purchase $33 branded jackets Background info: I've been working at this local grocery store for 3 years. For the most part it has been great. I am a carryout(bagger), cashier and I work maintenance shifts. Carryouts are supposed to help customers by bagging their groceries, talking to them and making sure they leave happier than they walked in. On occasion we help the customers outside. Carryouts are also supposed to get the grocery carts from out side and bring them in. This can take anywhere from 15 minutes to an hour. (Depedning on who does it, and how many are outside.) I learned today that we will not be allowed to wear personal jackets/coats outside during winter, and we will have to buy branded jackets that cost $33 not including tax. The punishment for not wearing the jackets, is a write-up (store operates on "3 write-ups, you're fired" business practice). He has been arrested previously for trespassing onto our property and has a record of harassment. He has also been texting us using an anonymizing app so the police cannot say it is him that is harassing us. However, the newest method of harassment has him leaving an air compressor plugged in touching a shared wall and then leaving so every 5 minutes it starts up and vibrates the whole house. You can hear it very clearly in the opposite side of the house. He has it on a timer so it shuts off at 10pm and starts up again at 9am. Police have been out but when they call him, he just says he will be back at 9:55 pm to shut it off and hangs up on them. Posted: 30 Jun 2019 05:32 AM PDT Good morning all, A party rental company is threatening to send a bill to collections for my refusing to pay $150 for missing flatware. Backstory: I had a wedding for about 140 people. All items and food came from the caterer with the exception of the flatware. The caterer was out of the one my wife wanted so they found another company and did all the leg work and ordered it. The caterer sent me the invoice and told me I just had to pay the rental company, they would take care of the rest. The party rental company delivered the flatware to the caterer. The caterer brought the flatware to the wedding, set it up and took it back to their place of business afterwards. The party rental company picked up the flatware from the caterer. The party rental company emails me a week later telling me exactly 5/150 of each piece are missing. I called my credit card company and blocked them from charging my card but otherwise I have ignored them for a few weeks but now they are threatening to send to collections. I believe this is 100% the caterers responsibility as I never touched the flatware other than eating my dinner at the wedding. [CA] Landlord threatening $1400 maintenance fees over portable washer and dryer Posted: 30 Jun 2019 10:40 AM PDT Location: Los Angeles Backstory: My roommates and I live on the upper floor of a duplex and our lease expires in just over two months. A week ago, my landlord entered my apartment to fix a doorknob. While she was inside, she noticed my roommates and I have a portable washing machine, a 110 volt dryer (no gas), and building materials (wood). She emailed us and said we had seven days to remove these items. However, we were very careful when reading our lease and ensured that these items are not prohibited anywhere in the agreement. We informed our landlord of this (in writing) and said that unless she could point to the sections in our lease which we were in violation of, we would not remove the items. We did not hear back from her for four days. Last night, she finally responds and informs us she is scheduling maintenance to be done as a result of us using the portable washer and dryer. She says we will have to pay for the plumbing to be hydro jetted because the washer was hooked up to the sink (as it was designed to be) and for an air quality and mold test because of the dryer (a 110 volt unit which doesn't use gas and is designed to be vented indoors). She estimates that these tests could cost up to $1400 total. She did not make note of any sections of our lease that we were in violation of by owning a portable washer and dryer (which we requested). We have not requested that either of these be done. In the first email our landlord sent us, she never mentioned damage to the plumbing or property, she only asked that we remove the washer and dryer. However, since we did not comply with her requests, her tone is now far more hostile and aggressive even though we have not violated our lease. She still has not identified the sections of our lease she claims we are in violation of by having the portable washer and dryer. She has not provided any proof that we're at fault for any damage that may or may not have occurred (again, until this most recent email, we were never informed of any damage to the plumbing or property which makes us think there isn't any). With regards to the wood we have, one of my roommates works as a carpenter and brings wood home to work on personal (never commercial) projects. This wood was the only time our landlord actually referenced our rental agreement in her email. She referenced a sentence which states "highly combustible items such as gasoline are prohibited." Considering gasoline is the example, we're inclined to ignore this request as well. There is plenty of unfinished wood in the apartment (doors, cabinets), so asking us to remove a few planks seems absurd and unenforceable. We're considering removing it simply as a show of good faith though. Outside of telling our landlord that we won't pay for this maintenance (which we plan to tell her) and possibly speaking to a lawyer, is there anything else we should do or be aware of? Our thinking is that she's trying to scare us since she still hasn't identified a section of our rental agreement that prohibits owning a portable washer and dryer. So recently at a small business I work for, along, with 6 other employees, our boss changed our pay day from a Wednesday to a Friday a week before payment. This was upsetting but we get it and it's understandable with the days the funds come through and stuff. Well come Friday, most employees were out of town, and we didn't get paid. We texted our boss and for most the day no response, he finally replied to one of us that payment would be the next day. Next day - no payment whatsoever. We had all decided if we didn't get paid we wouldn't be going in to work. A one day strike to send a message as out of the last four pay periods, only one was on time. The employees felt that they were not heard and it was getting ridiculous. One employee was over-drafted a couple hundred dollars because of bills, another was out of town and couldn't afford to get home with a car issue, and another had rent due. We texted him at the end of the day to notify him. He texted back today that we were all fired. He tried saying everyone but me, calling me an honest man, but I stood up for everyone. So we are all fired. Is there any legal action at all I can play here? If we aren't paid tomorrow does that add more legal action? She is at least 65 years old now, but doesn't have any paperwork to this effect. Everything was destroyed (accidentally and on purpose in Cambodia - this is very common there during the war) Her landed immigrant paperwork lists her as 55 years old. She still does not speak any English. She'll be 77 years old before she is eligible for her government pension. She cannot work anymore due to arthritis. She's currently at a college apartment/townhouse complex in Virginia and has her lease extended until July 2020. Two days ago the management at the complex told her that they are doing "cosmetic renovations" to the place she is renting with 3 other people. They told her that she and her roommates have until July 14th to move all of her stuff out because they are doing those renovations. This wasn't anything requested by the renters to the apartment and most of them are out of state/too far to be able to move things out themselves. The management has offered to hire a moving company to move all of their things at their own expense but none of the renters are comfortable with having a stranger move all of their things while they're not around. I'm wondering how legal this is to kick renters out for a month (4-6 weeks according to them) for something that they are calling "cosmetic renovations". They have been refusing to say much over email and everything sounds sketchy. They are claiming that the construction company that originally built the house is the one that is forcing the management to force the renters out. The only thing we could get in writing is: "The renovations that are being done are all cosmetic fixes. Many of our units are not holding up to the luxury standard that you have signed for and these renovations are only to preserve the standard that we intend to uphold. In the event that there are additional renovations needed, you will be notified. If you have any additional questions, please let us know, we are happy to help." Posted: 30 Jun 2019 05:51 AM PDT So yesterday my abusive estranged father texted my sibling saying that "I have a box of your stuff here if you want it you need to pick it up by Friday or it will be gone" none of us have talked to my father in 7 yrs since the last time me and my sibling went to his house during our parents divorce (6 hrs ago we were both 19 and 20 at the time) he called the cops and threatened to have us arrested...even though the lawyers said we were still allowed out his house, the cops didn't let us get any of our stuff and told us to just go home and let the divorce lawyers figure things out and then the next day he went out and got a restraining order against us and order of protection we had to go fight it in family court and the judge basically said that this is ridiculous and as long as we agree to just never going onto his property again without his permission she was tossing everything out and negating the restraining order and stuff. Divorce decree comes down and NOTHING is in it pertaining to my oldest sister and I And everything from my baby photos to high school diploma are at his house (or so I believe unless he's thrown them out already) my mom literally left in the middle of the night with the clothes on her back and my younger siblings so NONE of us have our stuff and for obvious reasons were terrified of contacting him to try and get it because he's literally taken my mom to court for things for yrs and finally has left us alone for the past 2 yrs or so and now or of the blue texts to get our stuff? So I have two questions; Even though I don't have an active order of protection if I call my local sheriffs office will a cop come wait at the end of his driveway with me so I can get my stuff without funny business? Also, he says he's throwing anything out by Friday so IF there still is or of my stuff at his house which I believe there may be and he's just trying to play games with us, can I take him to small claims or family court and "sue" him for my personal property? Posted: 30 Jun 2019 07:33 AM PDT Location, Kansas Paid a motorcycle shop to tighten my chain on my gsxr 1000, chain had 2 links removed then 40 miles later the chian slipped the sprocket and, damaged sprockets, chain, water pump, chain cover, coolant lines and broke 2 mounting screws off in the engine block. The shop originally wanted to hire a welder to weld the metal together but no one would touch it, They decided that epoxy was the "best route" i contacted the MFG of my motorcycle and they advised that epoxy was absolutely the incorrect method of repair and would place me at substantial risk and fixing the bike would require a block replacement $3,500 + Labor. The shop is offering me $2,000 to replace the bike but finding a comparable bike is $5,500. I purchased my bike for $4500 and think it would sell in this area for that much if it were in good shape. I am sick of dealing with the owner and would like to contact his insurance but he will not provide his insurance information. So my best friend called me today (since I moved away for school and she can't just drive around and see me) and seemed really stressed. When I asked her what was up she basically explained that she had been working and hadn't been getting paid for the last 2 months which totals up to about $2000 (it's casual work)and she only got paid about 6 weeks ago and only received $200 from that. Any advice I could give her? Also she mentioned that the lady she works for has been complaining that she's going bankrupt and into debt but still manages to buy a new car, some land for her work (runs a petting zoo) and a frickin boat. Posted: 30 Jun 2019 08:32 AM PDT North Carolina. Rented duplex where the old neighbor decided to smash a downstairs window then move out. There has been no glass in the window for around 4 months. I have communicated that to the leasing office several times and it has not been addressed. Now with summer coming on I have started noticing signs of rodents on my side of the duplex. In the breezeway I have seen bees coming from under the neighbors door this is an issue because I am extremely allergic and if they have built a nest and get into my place it could be bad. My landlord and leasing office do not have an email address (or they just won't provide it) so all communication is through phone. I recently contacted my local housing department but have not heard back. My first instinct is to just buy a window and include a receipt and deduct off my rent but that is probably a bad idea. We live in Tx and we have a geographical restriction to this city. We have joint custody but she still gets $2200/month in child support since she doesn't work. Recently, ex wife went for a month long vacation all of June with the kids and has decided she be staying longer now (by herself) with her family in AZ. Kids will be back here as of this week. I found out from s15 she is planning to move there permanently. She has not told me any of this in person yet but I have suspected this for a while. Is it possible for me to bargain full custody of kids and decreased child support for her to be able to do this? She doesn't take care of the kids and I've done 90% of everything since the divorce anyway as she is constantly 'ill' or 'not feeling up to taking care of the kids'. Any suggestions? Ideas? Posted: 29 Jun 2019 03:00 PM PDT So I've been working in a post office within a drug store in British Columbia, Canada, for just over a year now and when I started it was very clear to me that we did not get breaks regardless of how many hours worked however we were to get paid for the full amount worked (ie if we work 8 hours we get 8 hours pay). Instead we are allowed to put up a sign that says "Be back in three minutes" and that is our so called break. Recently I discovered from a co-worker that the company has been paying the remaining staff (cashiers, merchandisers) their 15 minute breaks while we do not get that added onto our pays I am wondering how we can go about handling this and what we can do about this because the money we don't get adds up after a while and I feel it is unfair since we don't receive breaks in the first place. Threats to park my car in handicapped tow zone Posted: 30 Jun 2019 08:39 AM PDT In Maryland. A few months ago my husband and I let his 16 year old daughter start using a car (Nissan Versa) of ours. It is still registered to me, she is an insured driver. She lives with her mother (husbands ex wife) most of the time and the daughter has been driving the car exclusively and keeping it at her mothers' house since February 2019. Husband received threatening texts from his ex yesterday saying if he did not give her more $$ for car repairs, she will park the car in Baltimore in a handicapped tow zone and abandon it there. We are traveling out of the country for the next 10 days (which she knows) and will not be in the state/country to deal with this if she follows through. Thoughts on what we can do preemptively? Or what will happen if she does this and we can do anything about it until 2 weeks after she does the deed? [link] [comments] |
Posted: 30 Jun 2019 10:40 AM PDT Hi! Looking for some advice. I was renting a winter condo in Maine while my landlords spent the season in Florida. I was there from September-May and put down a $700 security deposit. I emailed my landlords on the last day of May to let them know I'd moved out, they were supposed to return the following week. I didn't hear from them and after several voicemails, emails, and texts, I finally got a reply saying they'd hired a professional house cleaner to come by before they returned and she called the place "filthy" and "inhabitable." They told me she'd charged them $500 to clean the unit (a 1br 1bath shoebox) and they would be using the remaining $200 for further damage costs if they needed to. I was furious, I'm OCD about cleaning and organizing and anyone who knows me knows how crazy I am about it. I emailed them to let them know how upset I was (kindly) and requested photos from the housekeeper. I had photos too but they didn't show the details the house cleaner had mentioned (inside the fridge, for example). I've emailed them countless times, again left voicemails and texts requesting that we meet when they get back in town. I've heard nothing. What are my next steps here? Ohio: Mother-in-law's new CEO is incorporating Christianity/Christian ideas in formal team meetings. Posted: 30 Jun 2019 08:27 AM PDT Hi, r/legaladvice. Thanks for taking the time to look at this post. My mother-in-law recently got a new CEO at the company for which she works. It is a private company with no previous religious affiliations. In their first meeting lead by the new CEO, the CEO introduced himself and told the team he was raised as a Catholic and believes, "everything that happens is supposed to happen." He then said he likes to start every meeting with a "generic meditation to give thanks," and asked the whole team to participate. The CEO opened the "meditation" with a line that referenced God, and closed with the CEO saying, "in Christ, Jesus." There were no other overt references to religion or Christianity in the "meditation." This left my mother-in-law (not Christian) feeling very uncomfortable. She felt as though the invisible line between the workplace and religious practice had been crossed, and that referencing Christian ideas so overtly in a professional setting was inappropriate. So far, this has only happened once. FWIW, the CEO seems to be doing an excellent job otherwise - performing well as a manager and leader for the office. My question: is language and practice like this, in an office, legal? A brief google search brought up laws against religious discrimination and laws enforcing an employer's responsibility for reasonable accommodation, but nothing about asking employees to engage in religion-inspired activities.
