I keep on hearing that "insurance follows the car". I feel comfortable that if I borrow a car then the car continues to be covered from a collision perspective. But if I'm at fault in an accident and get sued, will the liability coverage cover me, or will it just cover the owner of the car? Thank you.

Car insurance - 2 days uninsured without driving?

    Posted: 23 Dec 2018 10:27 PM PST

    Hi all -

I am in WA state and am being gifted a car. The gifter has already put the date of transfer on the title - 12/30/18. However, I won't be driving it until the 1st anyway, and I would like to avoid having to pay for insurance for the entire month of December, which I found out I would have to do even if I only insured it for 2 days. Will it be possible to wait to insure until Jan 1? My concern here is whether or not it will make insurance companies view me as higher risk for having a 'lapse' in insurance. All I can find online is that 'No person may operate a motor vehicle subject to registration under chapter 46.16A RCW in this state unless the person is insured under a motor vehicle liability policy'. I won't be operating it, so, it seems it might be okay, but I can't find specific information for parked/stored cars.

    A couple notes:

    - He will not have cancelled his insured before the new year, but the date of transfer on the title and bill of sale is listed as Dec 30. I understand this cannot be edited on the document without voiding it.

-I do not have insurance currently, as I have not had a car for a few years (and lived abroad). Before moving abroad, I had a car and had it insured with zero lapses and a good driving record.

-It will be parked on private property

    Thanks!

    ACA subsidies for recent immigrant

    Posted: 23 Dec 2018 08:43 PM PST

I have more and more questions as I'm trying to get insurance for my mom who's a new immigrant. She's 60 and we're in Texas. She's expected to have no income as she's adjusting, learning how to drive, getting a car, all the fun stuff.

We are trying to get subsides so she won't have to pay the $700 monthly premium. I think she's eligible to get subsides because from what I found here:

"Low-income, lawfully present immigrants – who would be eligible for Medicaid based on income, but are barred from Medicaid because of their immigration status – are eligible to enroll in plans through the exchange with full subsidies during the five years when Medicaid is not available."

    Source: https://www.healthinsurance.org/obamacare/how-immigrants-are-getting-health-coverage/#recentimmigrant

However I haven't been able to do so through healthcare.gov. When I entered $12,500 income for 2019 she's eligible for subsidies and they wanted to see documentation for proof, which she doesn't have. She hasn't been working for a couple years. I entered $0 and she's not eligible for subsidies.

    Any help will be appreciated.

Was in a car crash wondering if it's my fault

    Posted: 24 Dec 2018 12:01 AM PST

I was driving down on the highway taking my exit another vehicle missed it probably and I was in his blind he swerves into my lane, I slam on the break and turn left. To avoid him hitting me. I slide across the whole highway will doing a 180 because it was freezing rain and end up on the left shoulder of the highway slammed into those metal guard rails facing the opposite way of traffic. I have a relatively inexpensive car. It wouldn't cost me much to replace it. I was wondering if I can make a claim on the insurance.

I also left the scene because my car was drivable and I was fine besides being really traumatized. I was going under the speed limit and he didn't have 3 wheels on the lane when I slammed on the brakes.

Should I claim the insurance? Or leave it can I also file a claim. If they find it to be my fault can I just drop it and pay out of pocket? I'm a new driver only been driving for about 2 years

    Additional insurance for Zipcar?

    Posted: 23 Dec 2018 08:54 AM PST

I just joined zipcar and want to know if I can buy additional insurance on top of the insurance they provide. The zipcar insurance is for the states minimum coverage and I feel that is quite low. I would like to have insurance that would cover me if I'm sued by a third party. The Geico rep assures me they don't offer a policy to cover that situation. Does anybody?

Edit: I should have mentioned that I just sold my car and don't intend to buy another. My current policy with Geico covers me if I rent a car but doesn't cover me while using a car sharing service like zipcar. So I'm most likely going to drop my current policy if I can't find a reason to keep it.

Edit: It seems that the insurance I want exists. Do any of you know which companies offer it?

Private Flood Insurance, Lloyds London, questions about it all

    Posted: 23 Dec 2018 02:24 PM PST

I am checking a few houses out and they're in the Zone AE floodplain (100 year) and will need flood insurance if I chose one. As I'm researching about flood insurance I see it can either be really costly or really cheap. From what I can tell the flood insurance backed through FEMA costs significantly more than a private flood insurance policy.

I decided to get a quote from Lloyd's London and while not a final quote, my estimate for 100k of coverage with a 5k deductible was $500/year and they didn't even request an elevation certificate.

The house was built in the 60's and flooded in the 70's, but no floods since, would this make a higher payment even if it was so long ago?

Where can I find more companies that offer private flood insurance? Is Lloyd's of London a reputable company?

Sorry if anything in my post is wrong, I've been trying to research the flood zones and what each thing means, what I need, ect, but it's a lot!

Non-owner auto policy - worth the cost?

    Posted: 23 Dec 2018 12:29 PM PST

    Hi, all.

I'm currently debating a move to a large city with extensive, reliable public transit. That, coupled with high costs of gas, auto maintenance, parking, and auto insurance in that city, means I would likely sell my car once I make the move. (I work from home, so no issues with public transit related to a commute). This also means that, since my car is paid off, the sale money would be pure profit. On any occasion where I absolutely NEED a car, I could rent one, consider a ZipCar subscription, or just get an Uber or Lyft.

If I don't own a car, I know I don't legally require auto insurance. However, I've also read that having gaps in your auto insurance coverage makes you look "risky" from the insurance company's perspective, which might (?) result in higher premiums if/when I decide to purchase a car in the future.

Would a non-owner policy be a good option for me? Does it offer significant savings compared to a "regular" auto insurance policy? Or would the potential increase in insurance premiums be offset by the savings from not carrying any auto insurance for years?

    Any advice would be appreciated.

Electing COBRA coverage with company being sold

    Posted: 23 Dec 2018 06:17 AM PST

My employer sold out and now though my job will not change we are to go through the process of being considered "new hires" with a 60 day gap in our insurance. I insure my husband and myself, so the cost of COBRA for two months is pretty staggering. The HR woman told us we can elect COBRA coverage for 59 days retroactively if something happens and we need to use our insurance, we'd just have to pay the premiums back however many days had passed at that point. Is this accurate? I don't want to take any big risks because I don't have great luck, but if we just have to pay if something happens in that window it'd be worth it. Thanks in advance

    Auto Insurance Gap Coverage

    Posted: 23 Dec 2018 03:41 PM PST

I was involved in an accident recently, and my car was totaled. In talking to my current insurer (Allstate) it somehow escaped my memory until just now that I had gap coverage through the lender I financed the car with (CarMax). At this time, the payoff transfer has begun. What do I do? To the best of my knowledge, I thought there was no gap coverage. It's a Sunday evening, so there is nobody available to pick up the phone at either place. What should my first move be in the morning? Who should I call first? I don't know if I should be excited because I have another $2,200 coming to me that I thought I didn't, or despondent that I've somehow managed to blow it. Help!

Driver violated stop sign and totalled my car. What can I expect to happen and how soon?

    Posted: 23 Dec 2018 02:42 PM PST

I turned westbound into a parking lot where three main thoroughfares all have stop signs. The responding deputy verified that I had the right of way and that drivers at the stop signs must yield to all incoming traffic. A car traveling eastbound violated their stop sign and collided into my passenger front tire, fender, and passenger door as I was making a left turn about the lot. My car is totalled. I believe the driver was speeding at about 30 mph. Driver said I didn't signal and that in making my left turn I crossed double yellow lines. In my state of FL driver's handbook it says drivers may cross double yellow lines if they're making a left turn and it is safe to do so.

We have the same insurance. Driver said some incriminating things like I can't see and I get confused in my interaction with them. They demanded that I help them input their auto insurance claim at the scene. I told everything to my adjuster. What do you guys think will be the outcome and how long might this process take. This happened 5 days ago.

Disclosing accidents/tickets when buying car inaurance...?

    Posted: 23 Dec 2018 08:22 AM PST

    In Indiana.

If you had a speeding ticket that was dismissed (yes, dismissed), it's not on your record and you don't have to disclose, right?

What about minor accidents? No injuries, tickets, arrests, lawsuits, suspensions, ambulances, hard feelings, no mention of it on your official driving record? Can it be left out of the conversation then? It was a permissive use situation, so not the driver's car or policy, but naturally, the police came and the driver's car required repair.

Will I still be charged a deductible for a car accident where I'm not at fault?

    Posted: 23 Dec 2018 10:34 AM PST

The other driver went through a red light, and has admitted it was his fault. There's only damage to my front bumper. I'll go to police for report tomorrow. I've contacted my insurance, but they said an agent will only call me at the end of the week because they're closing for the holidays. Thanks for any info.

    Proving No-Fault

    Posted: 23 Dec 2018 06:15 AM PST

So earlier this year I got into an accident while making a left hand turn. The other driver was speeding, I have a witness who would say the same thing, but I ended up getting ticketed by the officer who arrived on the scene.

Initially when we spoke to insurance (both myself and the other driver use the same company) I was told that because I was ticketed I would be deemed at fault.

Well, I just recently went to court and had the ticket dismissed. Would I have any way of making the insurance company reverse their decision? I would much prefer a no-fault, or even have the other driver be deemed at-fault.

The insurance company has paid out close to $20k at this point. Any advice would be appreciated.

    • We are both in the state of VA.
    • VA has the following code-

§ 46.2-823. Unlawful speed forfeits right-of-way. The driver of any vehicle traveling at an unlawful speed shall forfeit any right-of-way which he might otherwise have under this article.

    Code 1950, § 46-238; 1952, c. 666; 1956, c. 533; 1958, c. 541, § 46.1-221; 1985, c. 218; 1989, c. 727.

The chapters of the acts of assembly referenced in the historical citation at the end of this section may not constitute a comprehensive list of such chapters and may exclude chapters whose provisions have expired.
