HOA is trying to stick it to me Posted: 07 Sep 2018 07:12 PM PDT I have a rental home in GA that has an HOA. In the years I have owned it, I have never had any issues with them. I take care of the property, promptly pay my dues, and have great tenants. I have a property manager that handles the day to day. The HOA has a requirement to keep a current lease on file with them and have a professional company maintain the yard. My property manager ended up dropping the ball and did not provide the updated paperwork to the HOA when my last tenants changed over. My house went out of compliance about 9 months ago, but the HOA never notified me. I am pretty sure they had no idea that it was even out of compliance. They recently did an audit of all the homes in the neighborhood and just sent me a notice with a $7500 bill for a daily fine of $25 per day. I immediately responded and promptly got everything turned in. I asked them what they were going to don about the fine and they said they are going to run it by the board. I just heard today that they reduced the fine to $1500 but still WTF! My question is can an HOA in GA impose an absurd fine on a homeowner after letting it accrue for 9 months when they never notified me at the time it went out of compliance? I can see starting a fine from time of the first notice but to let it accrue for 9 months and they slap it on me is ridiculous. I was also on a combat deployment for a good bit of the time the fine was accruing so not sure if the Servicemembers Relief Act would come into play at all. Thanks in advance. [link] [comments] |

Has anyone tried also listing on Zillow for sale by owner and then directing any calls to the agent? I wasn't aware that Zillow only listed from certain sources until after we got the house on the market and while I have no idea about their business practices, I know that they generate a lot of traffic. Update: After stressing to our realtor that we wanted it listed on Zillow, she sent an agreement for us to sign which states that we understand that Zillow can be inaccurate, etc. and that we'd still like to post to Zillow. But for now, I know I need to end their lease and create a new one solely in the wife's name because she'll be staying in the unit. The security deposit is in an account that's only in the husband's name. The bank only permitted it to be in one person's name. So what should I do with it? She works, so presumably she contributed toward it. Do I refund the whole amount to him and let them work it out? Can I split it? First time landlord here, I appreciate all your input! I've been been given the opportunity to purchase a 300 Sq ft storage unit in my condo building for around 45k. Some details: -I live in a very desirable metro area in Miami. -These units, along with parking spots, almost never trade -The unit is air conditioned -The ppsf for condos here are around $400-500 -The general cost for a unit of this size in typical storage spaces is around 500-700 a month -Because these units never trade, almost impossible to find information on the the average selling price. -Typically these units rent for about 300-400 a month. -There are no property taxes or HOA fees associated with these units I would buy this storage unit strictly for investment purposes. I got married in May 2018 and am thinking about adding my wife's name to the mortgage. This mortgage is currently the only debt I have and my credit score is 780+. However, my wife is also listed on her parents' mortgage since she has a more established credit history than them (in other words, my wife already has debt to her name in the form of another mortgage with a lender in another state). If I add my wife to the mortgage now, will this have any implications in getting a favorable interest rate when we refinance our 5-year ARM before June 2022? We're currently locked into 3.3% until then, but as we all know, rates are going up. Will I get a more favorable rate at that time if it's only my name on the mortgage? Or does it not matter? I'm also new to the condo association board and I've recently noticed issues with the company that has been managing the property. Fixes not done in a timely manner, things repaired but not optimally, etc. I thought I would start looking for possible alternative companies but I'm not sure what I should be looking for specifically. The current company covers maintenance issues, property upkeep and improvement, manages the association finances, and enforces rules set by the association. Should I be looking for a property management company or a HOA management company or both? I'll be honest I don't know much when it comes to these things. Even in Seattle prices, i could pay cash. This has been the case for several years. However, i've continually convinced myself that the next crash must be right around the corner, and that it's better to bide my time - another 6 months, year, etc., - and things might buckle again. No news flash is required to say that i have been wrong to this point - on an epic level. i can live wherever i want in a major metro area - but i must admit - i do sort of like the PNW - the place, politics, and people. Right now I also work as a transaction cordinator for my real estate office (which does ALOT of bank owned homes) and one of my jobs there is to go to all of our REO properties and get new pictures of them every two weeks. These properties range from about 30 minutes away from me up to 2 hours away. So there are some days where I am driving around for 6+ hours straight taking pictures. I bought my car before I even started at this office and it is relatively new, 2015 with 25,000 miles when I got it ($22,000). I make pretty close to minium wagew doing this office job, but I don't get any beneifts or even get my millage paid for the driving. When I took the job nothing was said to me about exactly how much driving I would reall ybe doing, becuase the driving was supposed to be just a side part of the job and now it has completely taken over. I am on salary, $2000 a month but find my self working 10+ hours a day, 6 days a week. I need this side job until I can live completely off of my real estate transactions and I love the people I work for, but they can't afford to give me a raise at all or pay me for gas. So now I am spending $400 a month on gas and have put 3000 miles on my car just in the last 1.5 month. Should I get rid of my car and buy a junker to be driving around? I feel like my car is too new and too nice to be doing this to. A raise and paid milage isnt in the mix, and neither is quitting. What should I do? Posted: 07 Sep 2018 11:32 AM PDT Location: Dallas, TX I'm trying to figure out what I should've done instead so I can properly learn from the experience and close the negative chapter. We're both pretty young ( 23 and 26) and this is our first property. He was one of those unavailable/real estate as a side gig guys and we didn't realize until his nature was revealed once we went under contract. Dude was literally on vacation in London for 8 days at some point while we were trying to wrap up closing. We relied on the kindness of the selling party's agent a good handful of times to get something done, etc. and I felt incredibly guilty for that each time and will definitely be doing my best to get him more business. There's a lot of extremely poor customer service anecdotes I'm leaving out here for sake of brevity but I'll lay this out - in the end, we were awarded a $1,000 credit from the seller for a home warranty. When I reached out to the title company to figure out what the next steps were in implementing that credit, we were told our agent already authorized a home warranty contract on our behalf. This was completely without our permission in every way you can think of. We never even had a conversation on which company we were hoping to use the entire time he was our agent. Getting this contract cancelled and refunded to us has been a slow nightmare because of course working with home warranty companies is often a slow nightmare. This situation totally brought us from "Let's just close and get rid of this guy" to "We're going to have to react to this." Things we did: Reached out to his supervisory manager who was absolutely no help from start to after close, literally couldn't care less. Reached out to the real estate group office (like Ebby but a virtual one, not a major one) and asked to either refund the $500 transaction fee to us or we file a complaint with TREC, who "took note of our complaint" for us and probably now has my number blocked since I can't get through to the front desk anymore. Filed a complaint with the TREC today. Things we wish we did: closed everything either without an agent or in conjunction with a new agent. We signed one of those documents that essentially says Realtor X is your realtor until this date next year so we weren't sure how dropping him would've went and we were really, really trying to close on time. I'm expecting "That was dumb, you should've gotten a different realtor then and never sign those" comments but I honestly wasn't sure if this was common practice or not. Do you guys know if there was a better move I should've made during this transaction, knowing I was "tied into" one of those representation contracts? Did I just not have the courage to ask to void that contract and move on solo or would this have not been worth the risk of delaying stuff a bunch? Any general tips for dealing with bad agents? And those of you reading this and thinking "Wow, that was dumb" - you are totally right lol. There are just as many of us dumb buyers are there are dumb agents, believe it or not. If you're not happy at any time with an agent, ask to drop them and see how their attitude changes or go through with your threat. Posted: 07 Sep 2018 09:56 AM PDT I've been talking to realtors in the greater Seattle area for months, the ones I am close friends with are telling me that inventory is sitting on the market for months going unsold in the Seattle metro area. It's a bad sign, price reductions are happening daily on listings that are just not moving. So, why are they not moving? ... well, according to several agents I've spoken to, the problem is the market is completely out of sync with reality, and the banks are having none of it. One realtor recently had a 1.4m dollar home sale fall apart because the bank refused to appraise it for the 'market value'. Another realtor has had the same problem multiple times, however they are telling buyers to just pay the difference in cash between the appraisal and the purchase price, essentially they are buying homes upside down and hoping the market value becomes the 'true' value in time. These are really bad signs, the same shit we all saw in 2007. The Seattle real estate market may be ready to implode. [link] [comments] |

Today is the second day that a crew is here packing everything and loading my furniture on a truck. They're awesome, friendly, competent, doing a great job and taking care with my things. Yesterday I bought lunch and plan to do the same today, but I also want to make sure I tip if it's customary - these men deserve to be thanked! There were three guys yesterday, and today two of them are here with another third guy. Should I tip? How much? And can I ask them to pass on a portion to the guy who was here yesterday? For reference, it's three bedrooms, lots of heavy books and records, and I wasn't prepared so it was kind of a mess which they've worked around graciously. Landlord failing to fix shower, have to move. Posted: 07 Sep 2018 03:41 PM PDT Orange county, ca My shower has been unusable for over a month, approx end of July. Long story short poor maintenance of the building has lead to the shower being in danger of falling into the basement-- so I've been without a shower this entire time. I've scheduled several appointments with the property managers and their employees have failed to show, wont return calls, emails. Or anything. It came down to me submitting a notice of intent to withold. I finally got a response. The landlords attitude was no rent reduction since I still have use of the rest of my apartment. I informed him that I was leaving. He is trying to prorate the days for this month, which will be 15 days. It is my understanding that in ca there are habitability laws and I can leave under civic code sections 1941.1-1942 without paying, without notice. Or some sort of agreement needs to be made. When I spoke with him, he said I can either have someone eventually come out to look at the shower or leave. I told him at this point I wanted to leave and he approved it. I'm not sure what I'm supposed to do in this situation. They have in the past violated my lease by withholding access to a parking spot that was written into my lease for 4 months. I also did not have hot water in my kitchen for approx 7 months before they actually came to fix it, so they arent really on the up n up. Recently I have received information from an attorney representing my neighbor who has sent me information regarding a boundary line issue that impacts both myself and my neighbor's property. This is coming to me 6 months after purchasing my home. My neighbor is currently in the process of selling his home. They are asking me to sign a new deed to "correct" the boundary lines due to setback requirements. Based on the new plot plan, it looks like I'll be looking at my neighbors backyard from my backdoor which I'm not okay with. I have contacted the attorney who did my closing and we are meeting next week but I just wanted to know if anyone has seen a similar situation like this in their experience and what the outcome was while I wait for my meeting next week. I'm really not interested in losing property that I bought when buying my home just so my neighbor can meet setback requirements. There is no talk of compensation or anything in the deeds they gave me to sign and I don't plan on signing anything that doesn't benefit me. Any advice is greatly appreciated. Thanks!
