Posted: 01 Apr 2018 07:36 AM PDT The warrant is being served out of a county that neither of us have even stepped foot in, it's over an hour away from where we live. She used to work at a medical marijuana dispensary in Michigan, but it was raided and no charges came of it except for the owners. Besides the dispensary (not located in the county of the warrant) my girlfriend has been completely innocent and does not deal drugs!!! They are transferring her Monday or Tuesday to the county and I just can not stop worry about her. I'm calling both jails and neither are giving me any information. I put commissary in her current jails account and when I call to ask if she knows she has the money, the officers on the phone just say "she will get a receipt" whatever that means. I'm sorry if this post doesn't make much sense, but I'm freaking out and sooo worried and sorry for my girlfriend :( [link] [comments] |
Posted: 01 Apr 2018 07:18 AM PDT Once upon a time in Oklahoma, I smoked pot, got arrested, and earned a misdemeanor conviction on my record. Many years later I applied for the Global Entry program. I answered the "have you ever been convicted of a crime" question truthfully on the application and got back a rejection stating that any drug conviction at all barred me from approval. So I hired a lawyer and had the records expunged. Now that it's done, does the law consider the crime never to have happened? Can I now answer "no" when asked if I've been convicted of a crime? Or should I answer, "yes, but the records were expunged?" I'd like to try for Global Entry again, but I'm going to have to explain why my answer changed between applications. Edit: From the responses here, it sounds like Global Entry asks the applicant to include expunged records. I don't remember myself because it's been a while since I applied. Any input on other forms that ask about prior convictions but don't specifically mention expunged records? [link] [comments] |
Could you get fired for getting in a fight with a customer off the clock? Posted: 01 Apr 2018 09:24 AM PDT BAY AREA, CALIFORNIA Long story short, I work at a restaurant. This lady and I got into a verbal altercation in the restaurant parking lot (after my shift) because she had hit my car. She got out of her car and choked my neck, which made me react and hit her back. In short moment, her husband came out and also choked me from the side. She complained to management shortly after and the cops arrived because of that. Could I still get fired even if it was a form of self defense? Did I defame the restaurant by doing so? Posted: 31 Mar 2018 05:00 PM PDT More or less what the title says. I work for a tiny diner (it's me and eight other people, including management) and have been here for 4 years, 2 months. They know of me being trans and have never said anything... until now. They sat us down three days ago and announced, happily, that we will have new uniforms. Our previous uniform is a simple black attire. Black pants, dark shirt. Now, it's a black shirt and pants/skirt(for women). When I asked why I was given a skirt, they told me, that, legally, until I had the "correct" set, I was still a woman and would have to wear the skirt. I am years away from the surgery. They said that either I wear it or I lose my job. I... really can't lose my job. What can I do? Doesn't the US have laws about this??? [link] [comments] |
Posted: 01 Apr 2018 05:27 AM PDT A few of my neighbors started complaining yesterday after receiving letters stating how they were not following the POA covenants, and it needed to be remedied quickly. Right now, the POA is run by the guy who built all of the houses/developed the neighborhood and his brother. I remembered receiving a booklet from him approximately three months after moving in that contained specific info on my house and covenants for the POA. I didn't remember signing anything regarding a POA when I bought my house, so I didn't give it much thought until now. I believe he is enforcing the covenants now due to the following clause I found in the booklet: "PROPERTY OWNERS ASSOCIATION: Each property owner will agree to join a Property Owners Association whenever 60% of the lots of Phases I, II, and II have been sold." So, I did some further digging through my paperwork to see if I signed anything regarding a POA. I did here. I found that in a document titled "Real Estate Contract (New Construction)." With the info I found in my real estate contract, do I have to join the POA? Can I be forced to join? Location: Arkansas [link] [comments] |
[MI] We had warrents out for our arrest for something we have already been to court about. Posted: 01 Apr 2018 09:35 AM PDT Hey guys. So way back in 2016, my fiance are at a park at night time, watching a meteor shower on our anniversary. A couple of cops show up and park next to our car, so we approach and speak to them. They write us both a ticket for being in the park after dark. My fiance and I both go to the court stated on the ticket, plead not guilty, speak to the prosecutor, and get our cases thrown out. Easy peasy. Fast forward to last night, I get stopped at a routine traffic stop. Turns out we both have warrents out for our arrest for this park thing because we didn't go to a DIFFERENT court for it. I spent every last dime I had to not have both of us in jail for Easter. I guess my questions are, is there any way this is legit? Isn't this double jeopardy? Do I need an attorney? I sure as hell can't pay for one now [link] [comments] |
Can my in-laws sue for custody of my child (more details inside)? State is NJ. Posted: 01 Apr 2018 10:31 AM PDT I will try to keep this brief. For much needed context, my husband and I have known each other since we were infants. Our families were also close-knit. Growing up, we both suffered a lot of abuse at the hands of our families. His abuse may have been worse than mine. Circa 2003, when we were teens, we reported the physical abuse but nothing ever came of it and the DA refused to take them to trial. Basically our families got out of it because they made me and my husband seem like we were the trouble, and that our abuse was self imposed. At separate points in time after this, we were both institutionalized at mental health facilities against our will. We used to self harm in the past, and both of us have scars. Neither of us moved out of our parents' homes until we reached 28, and we just decided to marry each other since all my other relationships were abusive, and he could only love me...and I realized I felt that way too. Still our relationship isn't exactly super healthy or ideal. We live in a pretty shitty apartment in a bad part of town. I fell pregnant despite being on birth control pills, and we both decided to just deal with it because both of us really want to have a happy family and raise our children with the love we never had. Our parents, his and mine, continue to stalk and harass us. Most of it is subtle like just trying to force their way into our social media (we have them blocked but they make new accounts) or banging on our apartment door late at night or calling our jobs to get us fired (which has worked...). Thus the cops can never really help us out, and they basically just tell us to "resolve it ourselves". However, my in-laws found out about the pregnancy because I've been "showing". They are now stating they are going to report us to CPS. They claim that CPS will investigate and take our baby away, and get handed over to them so they can apply for custody. They say they have ammunition due to our having been placed in mental health facilities, being on depression/anxiety medication, the scars from self harming, etc etc. On top of that, they claim that we don't have the proper means to care for the baby, and that will be a huge factor as well. My husband works two minimum wage jobs, and I work one...so there is that. I have tried to do research on this topic, I just haven't found any straight answers on what will prompt CPS to investigate or remove children from their parents. I know a lot of the people here will recommend for us to speak to an attorney. I've called five in the last few days, none of them will give a free consultation because our case is apparently "complicated". We can't afford an attorney right now. The fees seem to run up to the $700s, and we just barely managed to scrape some money for the baby's necessities. I just really want to know if they have a legitimate case. Can they remove our child for these reasons? If our baby is removed, what can we do about it? Can we request that the baby not be placed with my in-laws or my family due to their abusive nature? Will my word even matter? Also, I posted elsewhere, and many people just suggested I have an abortion. We are not interested in aborting especially not because of my in-laws, we both have our hearts set on welcoming this baby and taking care of him/her to the best of our abilities. It's been our dream to have children, and to form a happy family. [link] [comments] |
Posted: 01 Apr 2018 06:08 AM PDT So thank you all for responding and giving me advice. So I ended up deleting all the nude pics of me that were online. Then I told him that if he posted any of the pics online, or sent them to anyone I knew that I would report him to the police and get a lawyer, even though this was a bluff. This got his attention and he admitted that his fetish was "exposing people" and that he didn't actually know me. I told him that I want absolutely nothing to do with his fetish and that he better delete all the pics of me. As far as I know he did because his reddit accounts have been deleted and so has his tumblr. Thank you all very much for the help! [link] [comments] |
Tenant was still in the apartment the first day of my lease. What can i do about it? Posted: 01 Apr 2018 11:03 AM PDT FTP / Mobile. If this isn't the correct subreddit just let me know where to post this. So myself and two others started our lease today (April 1st) in a three bedroom apartment. We got an early start by packing yesterday and brought the uhaul to the apartment at 7:45 this morning. However, once we went inside we realized the old tenant was still there. We decided to still bring everything inside (stored everything in a large unused room in the apartment) so we could still return the uhaul on time. However since the old tenant was still there and moving out, we really couldn't unpack as planned and we more than likely have to take some time off of work to be able to unpack properly. What can we do about this? To my knowledge this is a breach of contact but I don't know if this has any larger repercussions. We were thinking about asking for some type of compensation as well. This is our first apartment and I just want to make sure we're not getting screwed over day one. Edit: the apartment is in Massachusetts [link] [comments] |
Posted: 01 Apr 2018 11:17 AM PDT (TN) Hi writing here to ask what my legal options are for a roommate that has decided to go MIA a few days before rent is due To make a long story short I live in a house with 3 other roommates. One of them stopped staying at the house and had abandoned/neglected her cat. She hasn't paid utilities in months and now she has gone completely silent a few day before rent is due after taking most of her things from her room. (This is our last month in the house). I am really just posting on here to see what (if there are any) are our options in the legal sense. We also have noticed that she's blocked us on all social media and possibly our phone numbers. She's signed on the lease so she is liable we just aren't sure how liable she is. Or just advice on how to move forward with the situation! Any thing helps, thanks! [link] [comments] |
[IL] Dad's Car Tires Being Slashed at Work Posted: 01 Apr 2018 10:37 AM PDT So I'm posting on behalf of my dad. He works for the federal government and is fairly well liked, except where he currently works. When he came here to work, employees didn't wear uniforms, didn't go through metal detectors, watched porn on the clock, stuff like that. So my dad came in and worked to correct the problems. But this is when he realized that his car tires had started going flat. My dad has a very recognizable car, so this is no accident. He'll go to work and his tires are completely fine. He'll get off and at least one of them is flat. This has happened at least four or five times. And because this is a government building, there are no cameras in the parking lot, according to what my dad has told me. He went in today because he had some paperwork he had to do before he leaves for training, he just got transferred. He called me about 10 minutes ago and he told me that his tire was completely flat. We won't be here much longer, but this is just crazy. This isn't much related, but my dad's former boss, who got transferred last year, doesn't like him very much. He was close with a lot of the, for lack of a better word, lower employees. He let them get away with not wearing their uniforms and that sort of stuff. He actively lied about my father and the other person at the same level as my father. I don't know if there's anything we can do at this point. As I said, he's leaving for training this week and will be out of state. I suggested to him leaving his phone in the car, they're not allowed to have them in the building anyway, and have it recording just in case anything happens. Any Advice is greatly appreciated. [AL] 17/18 yr olds in a relationship, is sex between us statutory rape? Posted: 01 Apr 2018 11:16 AM PDT I'm a 17 year old girl in northern Alabama, and I'm in a long-distance relationship with my girlfriend from southern Maryland. My girlfriend is coming to visit me in a few months, and I would like to be able to sleep - both as a euphemism and getting actual rest - with her. My mother, a paralegal, has expressed (entirely reasonable) concerns about leaving the two of us alone, as she is afraid that it could constitute as statutory rape. From what I could glean about AL's age of consent laws, we're in the clear, but I would like to make sure that there is no chance of my girlfriend facing charges for this. Would any acts we did in Alabama lead to charges in Maryland, should the laws there get us in trouble? Sorry for any bad writing, but thank you for reading and thank you for any help you can provide! Delaware. Can employer make an employee pay for mistake/errors? Posted: 01 Apr 2018 08:29 AM PDT We are salary plus commission for our pay. I’m working at one company but get paid under two separate roles Posted: 01 Apr 2018 07:04 AM PDT I'm working at one company but they pay me under 2 separate roles. Let's say I work at an amusement park and I watch the lines but I also clean the rides under a separate title. They pay me with 2 separate paychecks for the separate jobs I do within the company and I work 6 days a week but 3 days are on one paycheck and 3 are on the other, so I never get overtime. Neighbors State They Own Our Driveway Posted: 31 Mar 2018 01:49 PM PDT My husband and I bought our home about 9 months ago. We get along great with one of our neighbors. The other one's not so much, but we live in the country part of New York and so don't have to interact with them that much. This afternoon we were talking with these latter neighbors, and they mentioned that they technically own part of our driveway. They stated they recently had it reassessed, and that all of the prior owners of this property have simply had a verbal agreement that, while they (the neighbors) own part of the driveway, they allow past owners, and now us, to use it. They then asked if we would be willing to enter into a similar agreement, verbally and/or written. We demurred, stating this is the first we're hearing about this, and went inside and ran to our deed. The property lines on our assessment clearly have the entirety of our driveway within it. Additionally, it explicitly states that this is the same assessment the prior owners had, back when they purchased in 2009, so the entire driveway has been drawn up inside our property lines for at least 9 years. We worry about these neighbors, because they haven't been so kind to us in the past, and they mentioned today they would put a fence up on "their" property line if we didn't enter into this agreement with them. We have a narrow driveway, which runs up a hill, so them attempting to take any of our driveway will become a serious transportation problem. Do they have a legal leg to stand on? All they're citing as proof is verbal agreements with past owners, and an assessment done by somebody and sometime. [link] [comments] |
[Update] coworker lied to cops saying I was going to kill her Posted: 31 Mar 2018 05:06 PM PDT Since my original post yesterday about the incident, I was informed today that I will be suspended until I attend a grievance meeting with union representatives. My co-worker is not being suspended and is being allowed to finish her final week with the company. I put in my two weeks today as well, as I found another job more related to the career field I am pursuing. I was told that responding to her her derogatory terms (She only referred to me as "boy" and refused to use my name, I considered this racist and sexist and had requested intervention several times about it in the past, but was told to put up with it until her two weeks are up.) was considered a violation of my contract and I will be suspended till I attend this meeting. I emailed my union rep about all of this to set up the meeting. They told me I was "violent" towards her for getting upset about being referred to as "boy" and calling her "woman" once in retaliation. [link] [comments] |
Posted: 01 Apr 2018 10:19 AM PDT tl;dr: My father died in 2012 when I was 18 years old. My sister inherited everything as I was schooling outside of the USA. Can I still contest the will? Long: My father died of cancer in 2012 in NY state when I was 18 years old. My sister was willed all assets for simplicity, as I was outside of the country, and there was an oral agreement between her and my father to sell the house and equally disperse assets. This is noted by her in an email, the same from her future husband. The will was created when my father was heavily drugged, and immediately after he was told he had 3 months to live. She was to inherit a $250,000 property, around $80,000 in bank accounts, and an insurance payout. As soon as my father died, my sister evicted my brother and myself from the property, and her and her fiance continuously stated how badly my father hated me and my brother. I have skype conversation logs, emails, that very easily disprove this. The stress from all of this led to the onset of the starts of a rare, inherited genetic disorder. My father intended for money to be left to me to finish school and to live for a few years. My sister, 6 years older, already had her schooling paid for by my father. My financial limitations and extreme stress prevented me from finishing school, and further prevented me from getting a complete diagnosis due to inability to pay for medical appointments. All of the misdiagnoses and lack of taking me seriously made me consider suicide daily because of chronic pain that was perpetually dismissed. I returned to the united states, and dealt with dozens of inaccurate diagnoses. Because I did not have a diagnosis, and could not privately afford to see a geneticist, I readily took a job that ultimately furthered joint degeneration. I eventually acquired a diagnosis through the help of a geneticist focusing on this condition, and his situational pity. I have effectively posthumously diagnosed my father with the same rare connective tissue disorder that I have. If I do not have the ability to contest the will at this point, do I now have the ability to sue my sister and her husband for unintentional emotional distress? Can her refusal to follow my father's oral contract (which she told me of through email) to financially help me and equally disperse the funds be considered fraudulent, or a cause for unintentional emotional distress? Until this diagnosis, I was forced to live in poverty, between $5,000 - $15,000 per year, and accused of being lazy by employers. Now, living in Texas, I don't have health insurance, and considering my condition, I require health insurance and pretty regular doctor visits. I can now finally file for SSDI after 6 years of stress and hope I'm approved quickly. So, how do I go about filing a lawsuit against my sister, if at all? To throw someone else into the mix, my mother prevented her divorce from my father being finalized, and inherited his pension. She has also refused to financially help me deal with my health, and I've saved dozens of abusive text messages from her. The only reason I'm not homeless now is because of significant others and their families, friends feeling terrible for my situation, and I feel terrible for imposing that on them, it's a perpetual guilt. Posted: 01 Apr 2018 12:15 PM PDT I left my camera at my relatives apartment. The cops had a search warrant for the apartment and took all the electronics. The warrant was not necessarily for my relative but for a roommate in the apartment. My camera was taken and I was wondering if there was any possibility to get it back from the police in a timely manner. The camera just has pictures of me on it from my last vacation. I want it back because im going on vacation in a couple months. This happened in NH fyi. [link] [comments] |
Posted: 01 Apr 2018 12:57 PM PDT My in-laws care for their adult disabled daughter. She has severe mental illness with psychosis and paranoia. She has periods when her symptoms are under control and when they aren't. She's been in the crisis hospital for two weeks after physically attacking her parents in the middle of the night. She is still physically attacking medical staff in the hospital. If there were any reasonable and not-astronomically-costly other options, they would not bring her back to their home. Unfortunately, there don't appear to be. She is still not stabilized on her drugs, but the the hospital won't keep her forever and will send her home this next week. Her parents need a way to monitor her in their home. They want to set up a baby-monitor type system where they have video and sound from her room to theirs, possibly from common areas in the home as well, so she can't surprise attack them again. They also are considering motion sensors and door alarms for when she leaves her room. Because of her paranoia they are considering going with a discrete (hidden) video/monitor system. They have guardianship for her. Would this kind of system be legal? Or are there any legal issues with monitoring her they should be aware of? They aren't going to lock her in her room. Bonus for any ideas for resources in Utah, or close by, for long term care options. Unfortunately, there are no obvious family members to take her in once her parents are unable to care for her. California ADA Compliance? I use a wheelchair and can't leave my 2nd floor apartment Posted: 01 Apr 2018 01:56 PM PDT So, like the title says, I live on the second floor of an apartment building in Southern California. I've lived here for about 8 years now, and began using a wheelchair 6 years ago. There's no wheelchair access to the second floor so for the most part I'm not able to leave my apartment. I've been out of my apartment maybe 5 times in the past 2 years, and those times were for doctors appointments. I can stand and walk, but for only about a minute, as it's incredibly painful. I have no way of getting my wheelchair downstairs in normal circumstances. Is the complex I live in legally obligated to provide a way for me to be able to do that? Any action I should pursue? Thanks for any advice. [link] [comments] |
[CA] Divorce during a civil suit? Posted: 01 Apr 2018 01:23 PM PDT I am in the middle of a large personal injury civil suit where I am the defendant and am worried about protecting our assets. The civil suit is still going through the courts and is probably still months away from any resolution. My wife and I have been married for over 5 years and have significant assets, but the civil suit has admittedly brought a lot of strain on our relationship. I feel really bad about dragging her into this and want to do right by her (she is the one who came into the marriage with more assets and earns more than me). Would a divorce (and splitting up our community assets) help in limiting our liability? Would her portion be protected if we went through with a divorce? As I understand it now all of our assets are at risk in the suit. [link] [comments] |
Posted: 01 Apr 2018 11:52 AM PDT Hi, so I had a friend telling me about his job yesterday, and I got so angry at what I heard. He started working for the Everett city school district as a groundskeeper nearly three years ago, and when he was first hired he was told that the position was full time and that he'd be receiving benefits. But apparently they later decided to break his job down into two "part time" jobs, depriving him of health benefits, and the part that's the most fucked up is that the second "part time job" isn't even something he does. They've made it out that one of his jobs is groundskeeper/landscaper (which he was hired for) and the other is a "bus fueler." I asked him if he had ever fueled a bus, and he said no. He really needs this job (and enjoys it otherwise) and has been struggling for a while, so I understand that he just kind of accepts the situation for what it is, but this just infuriates me to see him being taken advantage of by what seems completely illegal or, at the very least, crooked as fuck. Friend is attempting an April fools Craigslist prank tomorrow, I'm guessing it's illegal? Posted: 31 Mar 2018 06:58 PM PDT Hey all, My younger neighbor is drunk, and told me he decided to make a few fake for-sale posts on craigslist. He's invited about 20-30 people to all meet at the same place at the same time, for a transaction where he will not be. I've tried telling him it's stupid to waste people's time like that, and probably against the law, but I don't really know what law it's specifically breaking. Can someone answer that for me? Thanks Colorado Update: I posted a few CL ads warning people about his plan, and received thank you emails from a few people who were planning on going. I don't know if he's gone through with it, but I tried to mitigate anything. [link] [comments] |
[FL] Finding biological family of adopted mother Posted: 01 Apr 2018 12:45 PM PDT Hi everyone! My mom was adopted in Florida in 1972 where she grew up. She was adopted within a few weeks of birth and my adopted grandparents never met her biological family. I think the adoption was "closed", but I'm not sure exactly what that indicates. My mom has no interest in meeting her biological family. I respect this and won't proceed in searching for my family if it requires that she contacts them. However, now that I'm an adult, I'm interested in potentially finding or meeting my biological relatives. So, can I legally search for them myself, or does my mother need to consent to a search for them? Where can I find more information on the adoption laws at the time to learn whether it is even possible to find them? TIA for any advice! [link] [comments] |
