    We have two boys ages 7 and 10. We haven't heard from her since Christmas, when she dropped them off. Nothing. We didn't go to court and have an official custody agreement but we made it so that I would get to see them every weekend and we would switch holidays. She was supposed to get them for New Years but she's never showed up. I've asked people close to her if they've heard from her. One person told me that she left the state and someone else told me that she is staying with someone else around here. They know where she is and aren't telling me. I've been to her apartment a few times and she isn't there. I've been to her mother's house and she isn't there but her mother isn't worried in the least so I'm sure she knows where she is. I don't understand why she is "hiding" this makes absolutely no sense. Can I go to court and request that she be found for abandonment of our sons or something? She needs to come back here because they want to see her and I have no idea what to tell them.

    Company is buying condos in my community and is attempting to force out all remaining owners into selling their units to them [Florida]

    I live in a community with a COA that an investing company "A" currently has bought many units and now holds majority on the COA. They have been taking advantage of the remaining condo owners and voting for unnecessary renovations that are costly and shared among owners with very short notice to pay, leading to many resulting in liens or debt (demanding thousands of dollars with 1 month notice). It's a clear attempt to force the sales of their units. Now I received an email from a law group apparently representing some of the other owners informing me that there is a FL statute 718 that essentially allows company "A" to force the remaining owners to sell their units (at what price I'm unsure) once they reach 80% ownership to dissolve the COA.

    Is this true that I could lose the place I live because of some statute? What kind of buyout pricing should I expect? What are my options to protect myself?

    Edit: thanks for the information regarding the statute, is there anything that can be done to prevent additional "assessments" done by the company to impose more shared costs to the owners?

    Family member put renters in my house

    My grandpa left a house and 100 acres to me when he died. The only stipulation is that his girlfriend has a life estate there. She has decided to move to Texas, and she claims that she doesn't have the money to pay the bills anymore. In the will, it says that I'm not allowed to take out any loans against, or sell the property until I'm 25, but it doesn't seem right that she has moved away, and is renting the house out without my permission. She has also sold a truck and tractor while the will says that nothing is supposed to leave the property. Any advice would be greatly appreciated.

    My parents got a bill for over 900 dollars after I downloaded a movie

    I'm not sure if this is the right place to post this but I just needed some answers. So I used Pirate Bay and downloaded a few movies at my parents house (they live in Germany). I left and today they got a letter in the mail saying they owed 917 dollars for each movie downloaded. It even has the title of two of the movies. I told them that it was probably a scam or something but they seem to think it's real. I haven't seen the letter but I told them to talk to someone before paying or replying. I'm scared because I downloaded at least 6 or 7 movies and I don't want them to pay that! What do i do?

    [US WI] Being told my charge back was illegal by vendor. Need advice.

    Recently I did some charge backs on a couple transactions on my CC that I did not recognize. The largest one was for $72. I filed them as fraud at my bank because I did not recognize them and I didn't really do much research on the vendor names on my statement if I'm being honest. Turns out, the vendor is a legitimate adult website, but I still do not recognize the purchase and I am a poor recent college grad, I wouldn't be spending money on porn in the first place. I just received an email from the vendor saying I owe them the original $72 plus another $30 for a chargeback fee, and am also permanently banned from their site until paid. I'm not at all concerned with being banned, but it's the legal repercussions of not paying them that I'm unsure of. After some digging in my emails, it appears that the purchase may have actually been done either on my own computer or something similar, as there were transaction emails in my junk mail. I've had some friends stay with me recently and I have a lot of easy access/password fills for a lot of my info on my computer, so I'm assuming someone I know may have actually done the original payment under my nose, and it's a pretty embarrassing thing to question my friends over. So can I leave the $102 they are claiming I owe them be without facing any legal repercussions? Like I said, I'm fine with being banned from their site but I would really, really hate to have to face any police involvement or something like that because of a porn charge I am unfamiliar with. I don't really see a way to prove it wasn't me, and I intend to make my PC more secure.

    [California] Been vandalized, burlgerized, threatened and harassed by street gang members in the past two months. What can I do?

    I'm trying not to get into too much detail here since I've called the police countless times which cause the gang members to escalate even further. They're the same gang members that I've seen several times over the course of two months.

    So far:

    • I've been burglarized twice with well over $6,000 in property stolen.
    • Vandalized over a dozen times. Mostly tagging but they've taken a bat to my parent's vehicle which resulted in over $500 in damages.
    • Family has been verbally threatened several times. They appear smart enough to not threaten with physical harm us but that "bad shit will happen".

    The police in this area is understaffed and don't seem to have regular patrols in the area.

    I'm honestly scared for my life since it appears my house is in between the street gang's residences as they constantly pass and forth by my property as if they own it. I've patched fences they've destroyed as escape routes but it doesn't appear to deter them at all.

    I have video footage given to the police for some of the vandalism crimes but had countless broken promises of increased patrols with little to no results.

    My (heavily edited) questions are:

    • What legal options do I have?
    • Is there any chance they can be held liable for damages and theft to my property without video or a witness evidence if they confess for a plea deal or something?
    • Can the court issue a search warrant for the burglaries without evidence other than the other crimes committed on my property?
    • How should I approach a criminal and civil cases if needed especially ones with evidence?
    • Is there any legal options I can do to prevent gang members terrorizing my family? Would something similar to a harassment restraining order do anything if they were caught violating it?

    I'm sure some will say move out of the area, but that's much easier said than done. I have firearms to defend myself as a last resort, but I don't want to resort to violence.

    I'm grateful for the police for what they're able to do with their limited resources but I feel hopeless, trapped and terrified in my own home.

    Fired first day back from maternity leave. Is this even legal, what are my options?

    I live in Connecticut and I am a medical provider working for the State. My boss has always dislike me (other people have noticed, this is not personal opinion) and was never keen on hiring/keeping me, but he wasn't really able to fired me before since there were no complaints about my job performance in the 5 years of my employment. I had a complicated pregnancy and had to lower the load of work that I could do per OB orders (I have a medical letter that I gave HR), which infuriated my boss but he had to comply. I got back from maternity leave this past week and I was served with a letter of dismissal stating that during my leave they have found proof of borderline medical malpractice and this meant that I wasn't meeting my job standards. Upon asking to see proof of this he presented me with some scattered xrays and nothing else. I informed him that I couldn't even know if these were my cases and once I asked to see my notes and the patient's charts to have some context of what he was talking about he proceeded to tell me that if I pursued the issue any further he would have to contact the Department of Public Health in order to open an investigation and possibly have my license revoked. He also informed me that, out of the goodness of his heart, he was giving me 6 months noticed in order for me to be able to find another job and resigned but that if I didn't before the 6 months were up and he actually had to proceed with the dismissal he wouldn't be able to give me a good recommendation once prospective employers started contacting him for references. I am at a loss and deeply upset. Thank you for your help.

    Girl lied about her age and now family member is in jail held on $500,000 bail. Advice is sorely needed

    A family member met a 14 year old girl on an online dating website. She stated she was 18 years old. She and my family member arranged for him to pick her up at her place. They meet, the week of Thanksgiving. She tells him that she's off for Thanksgiving break. The girls does not show for school and the girl's parent's begin to look for her. They call the police for assistance. The police find the girl at my family member's apartment and they inform my family member of the girl's age, to his surprise. My family member had no idea that the girl was not 18 as he met her on the dating website, where the minimum age to register for the website is 18 and where she stated that her age was at least 18. My family member lives in a different county as the girl and brought her from her house to his apartment. The Police arrest my family member and have been holding him on $500,000 bail since 11/23/2017. They are charging him with Statutory Rape and Kidnapping (I think a B1 Charge Felony). This all happened in North Carolina and I have been doing my best to do some research on how I can help my family member. However, everything that I am reading states that there is pretty much no "reasonable good faith mistake of age" defense against statutory rape in North Carolina. I was thinking that my family member could possibly take a polygraph test to determine he is not a pedophile. I am asking for any kind of legal advice for my family member. He is still locked up and have lost his job from this whole ordeal. We are just hoping to get him out so he can start building back his life. He is 39 years old and the girl who he believed to be of age, is 14. This happened in North Carolina. Thank you in advance for any kind of advice.

    My neighbour barely maintains their yard and this is now causing me some concern because located on their property is an old dying tree. This tree has the trunk located in the neighbours yard entirely. The trunk is now cracked and splitting. Located directly next to this tree is my property line and I believe a very real possibility is this tree crashing down into my shed which I built myself and causing damage to my existing fence. If my neighbour's tree damages my property are they liable for the damages or am I? Does notifying them of my concerns have any effect on the outcome? Thank you

    Ex-boyfriend is threatening to take me to court over the assault charges filed against him

    Location: Maryland On Wednesday (1/4/18) my (ex) boyfriend and I got into an argument and it resulted in him grabbing me and throwing me to the ground after I grabbed his phone. This isn't the first time he's gotten physical with me over the past year we've been dating but I finally had the courage this time and called the cops when I got home. Long story short, after taking my statement and taking pictures of my wrist, the state is deciding to file second degree assault charges on him.

    I genuinely felt bad, and thought maybe I over reacted and took it too far with getting the police involved, and was actually going to contact the police officer and try to have the charges dropped but since the charges are being filed from the State, I have no say. And frankly at this point I'd rather not drop them. Now he's telling me "That better be gone Monday evening or we will actually be filling against you I already talked it over with my parents" and I said "What would you file against me? Are you serious" and he replied "Defamation of character and filing a false police report"

    I don't see why he's in denial over what had happened but he has always had a habit of gas lighting me in all of our arguments. Idk if he just doesn't want to admit to what he did, or if he really thinks nothing happened... I'm heart broken and now on top of this, super stressed and don't know what to do. I was planning on contacting the officer either today or tomorrow and talking to him about this and separate issue with another person, but if anyone else has anymore advice or ideas I'd love to hear them

    What can I do about my apartment complex continuing to enter my unit to turn up the heater unnecessarily high? [Michigan]

    I don't know if this is a common problem. Basically:

    1. I read the entire lease, there is nothing about me having to maintain a certain temperature while renting.

    2. They send out mass emails in the morning telling us they are coming into our apartments for "winter inspection" and crank up the heat to 80 degrees F, saying the email was their notice of entry. It's completely unprofessional – they have a young management team that uses memes to communicate. Like are they allowed to send us notices of entry through an email account they send us SpongeBob memes from?! They don't even give a 24 hours notice.

    3. They've plastered the entire place telling us we must keep our thermostat at 58 degrees to avoid burst pipes. But there's nothing legally binding me to that. And when they come into my unit, they set it higher than what they told us to do.

    4. I don't get back from my vacation and I checked my Consumer's Energy bill. They cranked up the heat so high my one bedroom apartment is costing $15 a day. I've been gone/been going to be away for long enough that my bill from just being away for home this holiday is over $130. Can I make them pay that?

    tldr; my apartment complex comes in and turns up the heat to avoid burst pipes, no sufficient notice and rack up my energy bill $130. What can I do?

    16/17 m raped 14 girl (Indiana)

    Forgive me in advance if I ramble, I'm really shaken up.

    Found out this evening that 16/17 year old Junior raped my 14 year old daughter. It happened a few months ago after him and his friend plied daughter and her two friends with whiskey and vodka at a concert. She remembers saying no but blacked out during the act and found herself in a truck later.

    She swore her friends to not tell (who didn't witness the act but saw him follow her to the location it happened).

    Anyway, it came out at a school function because he called someone out on Snapchat for sleeping with a girl and this person called him out for forcing himself on my daughter when she was drunk.

    The principal and her cheerleading coach saw the Snapchat when they heard someone whispering about it, asked my daughter if it was true and when she said yes, they called us and reported it to cps and let us file a report with the Sheriffs office. They will contact him probably on Monday.

    I guess I just need some guidance. We're going to file for a protective order on Monday so he doesn't try to intimidate her or come anywhere near her.

    Since there was no rape kit, is there anyway she can prove this happened if he denies it?

    Can we sue him and his parents civilly? We want funds for counseling at the least and for some kind of justice in case there's not enough evidence for a criminal conviction.

    Is there anything else we can/should be doing?

    Just to let you know what a piece of shit this kid is, he's already being charged with attempted murder for almost killing a 9th grader by beating him into a coma.

    A friend cancelled our flight reservation without our permission though we paid the money!

    We are three roommates decided to go on a vacation together. We booked the flight for the 3 of us using a single credit card because there was no option to split the charges on the website. One of us put the total cost of the flight on their card and the other 2 paid the person whose card was used in cash (no proof of payment). We ended up disagreeing. The person who used their card kept their reservation and cancelled ours purposefully without our acknowledgment/permission.

    According to the person behavior in the past month, we have expected him/her to cancel our reservation. We have called the airline to split/divide the reservation on the 16th of December. I have explained the situation to the representative and got a new code for the reservation. The representative "by mistake" sent an email with the new code to the person as well who have used it to cancel our reservation (neither the airline or the person asked our permission for canceling). We got an email on the 18th that our reservation got cancelled. The cancellation happened after we divided the reservation.

    We have called the airline yesterday to get a call record review which will take 48 hours.

    I want to also mention that we have also lost booked Airbnb money because she/he cancelled our flight reservation.

    I should also mention that he/she is an international student.

    Our questions are: - How can we get a legal proof for our payment? Is recording our conversation with him/her without disclosure legal in NY? Would text be a good enough proof?

    • If we do get a proof that they got our money, is this a case to be brought to court?

    • Does it help in court that we are 2 people and she/he is one person?

    • If not in court, would this be something to be reported to the international office in school that sponsored them?

    Bottom line is, I don't want this to go undocumented because I fear that she would do something of harm (especially that we still live together next semester), so we are just trying to protect ourselves.

    Academic journal asked me to do unpaid work, now they won't accept it. Could I (with legal backing) charge them a fee? [Ontario, Canada]

    TL:DR - Was asked to do unpaid job but with implied benefits for future career, then denied those benefits after having done the work.

    I was asked by a well-renowned academic journal to do a peer-review. This is unpaid work but counts heavily in an academic CV for a young researcher as myself. I did the initial review, which took about three days. In later communication however I pointed out that I was not yet a PhD, but I am in a PhD program and have a masters in the field (which is clearly evident with just a quick googling). After this they stated that they only accept reviews done by full PhDs. This was not stated in the email and in their (very long) guidelines it says PhD or someone with equivalent experience and I have two masters and two+ years in a relevant PhD field, which I assumed they would accept since, once again, they approached to do this work.

    The actual editor assigned to the paper is on my side but the journal refuses to budge. So now I'm wondering if I would have any legal backing for potentially charging them my (quite modest) consultant fee as they are denying me the, intangible but very important, benefit of writing down peer-reviewer in my CV, and have wasted three days of my time?

    Any help would be much appreciated!

    Former boss told EDD I quit even though he fired me verbally. I have an appeal meeting this week. What can I do? (Ca)

    Worked under CEO of IT consulting company (comp.A) as Administrative Assistant to comp.A (not ceo). 1 month in, he asked me to work for an airline (not owned by him, and headquartered in Nigeria, but has an office location at same address as compA). Given duties of purchasing parts from Boeing, filing customs, & overseeing contracts to acquire new aircraft. Definitely NOT mentioned in my employment contract (basic contract with salary, benefits, & 5 days vacation for the first 3 years, then increases, but no mention of job duties or anything related to company B) New work doesn't allow me time to continue my role with compA (only being paid by compA but doing 90% work for compB). 3 months in & I find out that's why he hired me. Not to actually do any work for compA, he just didn't want to pay a fair compensation for compB because he has no authority to do so since the company is in no way affiliated with his. I ask for a raise to accommodate the new workload & asked to be made an employee for compB so I can keep my hours, & job responsibilities separate. I'm told to resign or keep job as is. Also, he explicitly stated, "You're not doing me any favors by taking on the extra work." (Is it considered extra work if he, as my boss, asked me to do it?) I arrive the next day and state I'm going back to my original role I was hired for and won't proceed with CompB since I was not needed for that as it was extra work, and he "agreed that i wasn't doing him any favors and didn't want a personal assistant per my interview. "

    (I also recently found out that the owner of the airline is a notorious crime boss in Nigeria known for smuggling using his airline and while I only recently found that out, I didn't know it at the time I was fired. I was just upset I was bait and switched but would have just quit if I knew my boss was close to him)

    I was then fired and he told EDD I quit and never paid my vacation days when I left. I was disqualified for the weeks of unemployment while I was searching for the job I have now. Can I fight this? Is there anyway to report him for working with the crime boss knowingly? Or for bait and switching me?

    Neighbors Dog attacked my dog

    On Christmas day, unfortunately my neighbor's dog grabbed the leg of my dog under the fence. The neighbor's dog proceeded to play tug-o-war with my dog's arm under the fence. We heard the screams of the dog and ran to his aid. My dog's arm was being pulled under the fence through broken pieces in the stockade fence that were not there prior.

    We called the police and the EMT's to look at my hand that received a bite wound as well as to make a record of the event. My neighbor was not home at the time of the event and only returned home later that day.

    I have given him the emergency Vet bills that total to just shy of $750. He said prior that he was so sorry and that he will do anything to help where we agreed verbally for him to pick up the bill for the vet.

    Well, as you can imagine now he is pulling back on his word and offering half. I told him we agreed on the full amount and he said bring me to court then and refusing to pay anything now.

    -His dog grabbed and injured my dog. -His stockade fence was damaged where his dog was able to reach and grab my dog.

    Do I have a foot to stand on here or am I stuck with the bill completely?

    I don't want to go into detail about too much publicly because even though it's been 3 years I'm still not comfortable talking about it. I also don't actually remember anything that happened, all the information came from my housemates/the witnesses, I was passed out at the time. But during the investigation a video was acquired from one of the two men that was taken on the night, and the police would not let me see it. Is that legal? If there's anything I can do about it, is it too late now? At the time I was too stressed and overwhelmed to think about it too much after they refused, but it's been gnawing at me for years now and I just can't understand how it's illegal for me to see the video of myself, regardless of who took it. I feel like it might give me some answers or some closure.

    Landlord knowingly moved me + roommates into bedbug infested property. Problem has not been fixed and will be inherited by next tenants. Our duplex mates include an 80something yo man who has been suffering thru this for years. Owner is half-ass addressing the problem.

    I'm in Ohio.

    I moved into half a duplex in March 2017 and within 10 days began seeing bugs. None of us were in a financial position to bail out of the lease. Our lease provisions for us to move out early if we recruit new tenants, but obviously we are opposed to this. Talks with our next door neighbor revealed that this has been a consistent problem in the building for close to five years, and that there were three sets of tenants in the two years before us. There is a convoluted property management situation where our half is managed by a company, the other half is managed by a friend of the owner, and the owner is virtually unreachable in Florida. The other half is occupied by a woman in her 50s and her father who is in his 80s, who apparently can just spend his twilight years getting chewed on by bugs and nobody is batting an eye. They tell us they cannot afford to move.

    It took them close to a month to address the problem -- they actually called me to notify me of the appointment while I was delivering a complaint letter to be certified. Then when I called to find out when the followup appointment was happening, I was told the owner didn't agree to it. Obviously you need to stick to the exterminator guidelines if you actually want to solve the problem. After a literal yelling match between my roommate and our property manager, they came back and followed up, albeit several days late.

    Fortunately, we went several months without any overt signs of the bugs after that, though given what our neighbors told us I refused to buy new furniture and remained skeptical. Sure enough, at the end of October, they cropped up again full force. Again, it took them weeks to get an exterminator in. As you might have guessed, the owner refused to allow the followup treatment. By the end of December they were worse than ever.

    I was handling the situation pretty calmly through all this, but I finally had a bit of a nervous breakdown after they turned up in my bed again last week. Something snapped and I spent most of a night hyperventilating and vomiting. So yeah, can't even attempt to stay there anymore. I've taken my carefully inspected and decontaminated valuables to my father's house and am sleeping on a couch til my lease is up.

    So clearly, I AM PISSED. I want to go nuclear on my property manager and do anything possible to save our neighbors from the situation they're in. It's not right that an elderly man is in these conditions. I don't know where to start because I'm afraid that calling the city could displace my neighbors in the process, and they truly seem to have nowhere else to go.

    I am also DEEPLY concerned about the next people to rent this property, because obviously they're just going to keep renting it out and failing to disclose or properly address the bugs. I have to throw out all my furniture, and I'm a student, how the fuck am I going to afford more furniture? The next people in this house will likely be in a similar position. I can't bear the thought of these apathetic lowlives continuing to inflict bedbugs on unsuspecting people without the resources to defend themselves.

    I guess my main question is what can I do to make myself feel less powerless here, and help my neighbors if at all possible? And stop them from putting more unsuspecting renters through hell?

    My understanding is that I personally have little recourse, as the landlord is technically addressing the problem with these half-ass exterminations. There's 6 weeks left on my lease so I don't see the point of putting rent in escrow now. From what I know of Ohio law, my possessions can't be compensated for because the onus was on me to have renters insurance -- which I did not, but I have learned my lesson! My main concern is for my neighbors and future renters, but if I'm wrong and I do have recourse, please do let me know.

    [GA] renting a new place with 3 friends, owner wants us to sign under one name for "convenience"

    I'm going to sign the lease for a new place today, the owner just told us that they would prefer us have just one person sign the lease so that there's only one rent payment instead of 4.

    Does that mean the person that signs is the only one considered to be on the lease?

    I don't like the idea because I got kicked out of my last place with little warning because I wasn't on the lease. I don't want the owner to just be able to tell us to get out in 60 days whenever they feel like it.

    Can we still just send one rent payment if all 4 of us sign?

    I just started a new job and I do not get my first check till Wednesday. The tenth. I was late on my part of the rent for a few days. It was paid the other day all but the late fees that they changed me. I'm fine with late fees but now they are charging me late fees on the late fees. Is this legal? Thanks

    Am I getting ripped off by my boss?

    I work at a smoothie store currently making 8.15 an hour, the minimum wage for Florida in 2017. We are tipped workers, but in order to receive them we have to upsell an insane amount of additives for the smoothies (enhancers like creatine, multi-vitamins, etc.) for 99c each. Majority of my co-workers do not make their tips, but we have come to the conclusion that this is legal because we are still technically making minimum wage. However, with the recent increase in minimum wage for Florida (going up to 8.25 an hour), our boss is applying the same method to wether or not we get a 10c raise increase. Me, as well as my co-workers, are skeptical about his decision and are considering taking action. Any thoughts or opinions would help, thanks!

    Also Idk if it's just Florida law but minors have to have at least a 30 minute break after 4 consecutive hours of work, which none of us have ever had. I'm 18 now, but there were countless 7-9 hour shifts where I was not allowed to leave and get food, so Im pretty sure we have an argument there. Our manager is also the store owner, but has a history of sleezy behavior according to my older co-workers.

    Landlord forcing us to turn up heat higher than normal

    Question!

    Rent a first floor apartment in a Massachusetts suburb. The house isn't super well insulated so the landlord wants us to turn the heat up. Way up.

    Normally we keep it at 67-69, so basically normal room temperature. But to avoid frozen pipes for the upstairs apartment, our landlord wants us to have it at 75. He also came into our apartment tonight and put on an electric space heater next to one of the walls and then left - a HUGE no-no since I have a dog and do not want a space heater on while no one is home to keep an eye on it.

    There's nothing written into the lease about heat temperatures or requirements, only that "tenant pays heat and electric."

    So do I have any ground to say I either A) don't want to heat my apartment this much, or B) want to get reimbursed for the additional cost heating my apartment to our landlord's request? I'd keep the heat up in the 70s but not if I'm going to be paying $50 extra for the month.

    My divorce attorney disappeared off the face of the earth.

    Hey guys,

    My divorce attorney vacated her office in October with myself trying to reach her a month before that. At this point - I am going on 3 or 4 months from our last communication which was that she was to submit an agreement to my ex-wife that we could sign and file so we can finalize our divorce.

    I had to find out from her co-tenants in the office complex that she had left. Her phone still rings. Her e-mail doesn't bounce back. And yet still no return communication.

    Should I report her to the BAR Association? What are my options in this situation?

    My divorce is very simple and all we need is a separation agreement written up, submitted and approved by the courts (From what I understand). My ex-wife and I are on good terms now and just want to get this over with.

    Thank you all in advance for all of your help and input. Very confusing and unexpected situation.
