Legal Advice Lost a Hand at Work!

    Lost a Hand at Work!

    Posted: 04 Nov 2021 06:25 AM PDT

Lawyers of Reddit. I was hurt about 7 months ago due to raw sheet metal at a job site. I fell off of a ladder and gripped the sheet metal on the fall down resulting in cutting all of my tendons in my dominant hand. 2 surgeries later and I still cannot make a fist…this is my first time being hurt at work and from the sounds of it…I won't be able to perform the job I've put so much time and money into…any workers comp settlement is going to be peanuts compared to what I would make continuing my career…I need some advice for my families sake because I'm at the end of my rope here. Anyone? Thank you in advance…

EDIT: I honestly didn't think I'd get this many responses. This is my first time using Reddit like this. I can say from the bottom of my heart I appreciate the support! This injury has put me in a real hard place in life and a lot of these comments have pointed me in the directions of answers I wouldn't have found alone…thank you very much!

Springfield Mo- Landlord sent me a bill for $822 5 months after moving out, claiming my carpet had to be replaced. The carpet was already was already several years old when I moved in.

    Posted: 04 Nov 2021 06:45 AM PDT

I moved into this apartment in 2019. Lived there for 2 years and I moved out of the apartment in late July of this year. When I moved in they mentioned that the carpet in my unit was already a few years old. But we did and inspection and it looked fine. I paid a $100 security deposit, a $190 non refundable restoration fee, and a $200 non refundable pet fee when I moved in along with my first month rent. I lived there 2 years, never missed a rent payment and paid on time. When it came time to move out I did an inspection with the manager at the time, but he is no longer with the company. He told me the apartment looked okay except for some drip pans they have to replace and that they may charge me for a carpet cleaning. On November 2nd I was sent an email from the company stating I owed $822.88 to replace the carpet in the apartment. I've been sent pictures of the stains on the carpet that they say I caused, but all of the stains are on the underside of the carpet and not visible if the carpet isn't pulled up. Obviously when I moved in I didn't think to rip the carpet off the ground to inspect the underside for stains. With the pictures they also sent a list of the charges, but the only charges listed are $7.80 from 2 drip pans and a $97.73 restoration charge for flooring replacement. Then their email says I owe $922.88 - $100.00 security deposit so a total of $822.88. I don't understand how $7.80+$97.73= $923. I also don't understand why the $200 pet fee and $190 restoration fee haven't been applied to this balance, isn't this exactly what those fees are for? I've tried to look for rental advocacy groups in my area but have only come up with law offices and I don't want to pay a lawyer if the answer is I'm screwed anyway. Any advice you could give would be appreciated.

Update: I've already recieved some helpful comments. I thought I'd post my response to them here as well. I responded to their email with this:

I've recieved a bill for replacing the carpet in the old unit I moved out of. I know I had paid a security deposit, a pet fee, and a restoration fee that all should have went toward cleaning the apartment after my move out date. Additionally the carpet was several years old when I moved in and we were told it was on the verge of being replaced anyways. The carpets condition is as to be expected after normal wear and tear. It seems odd to me that I'm getting this charge now, nearly 5 months after moving out. I did a walkthrough and moved out according to my lease agreement with the manager at the time. Due to your consistent office manager turnover he is no longer there and the new manager had no knowledge of my situation. Additionally it has been well over 30 days and I have not had my deposit returned, nor received an itemized list of damages as required by law. I'd like to know where I can go to pick up my security deposit from you.

Anonymous death threat sent through email.

    Posted: 04 Nov 2021 05:32 AM PDT

    NY, USA

There was a shooting in my town a few weeks ago. The suspect was arrested, and luckily nobody died.

I recently got an email from an address I don't recognize. At all. The email consisted of a link to a news article about the shooting. They knew my full name and address, and said, "Be on your best behavior… or else you'll be next".

If you check my post history, you'll see that I've been getting harassed through welfare checks. I suspect that the person behind this message is the same person who has been harassing me in the past. Advice?

I'm leaving a cult and changing my name, but my state (NC) requires an affidavit of good character from two unrelated adults for a name change and I have no friends to sign it

    Posted: 04 Nov 2021 12:56 PM PDT

I was born into an abusive, religious cult. Me and my immediate family are cutting ties with the rest and separating from the cult.

Changing my name is more symbolic than anything, but it's very important to me. In North Carolina, it says you need two people to sign an affidavit proclaiming you have good moral character and that they've known you for years. Due to the way I was raised, I've been sheltered and have no friends who aren't part of the cult or related to me in some way.

Is there some loophole to get around this? Can I not get my name changed until I make two good friends and have them sign the affidavit?

EDIT: I'm 20 years old, incase that matters

Boyfriend cut his foot open on hotels pool light. Getting attitude from the front desk staff.

    Posted: 04 Nov 2021 06:42 AM PDT

Swimming last night with the family in a Sleep Inn, there was a pool light partially unbolted which my boyfriend found with his foot. Alerted hotel staff, filled out an incident report. Last night it didn't look so bad (I guess because it was waterlogged) but this morning it's huge and bloody. Front desk clerk was rude and asked what she was supposed to do about it and called EMT. EMT says too late for stitches. Maintenance came in and asked to be shown the light. We have pictures of his foot and the unbolted light. What is the next step? Thanks for all help! This is in Virginia if it matters.

Edit to update: After going down to the desk again before checkout, found the front desk clerk filling a first aid kit. Manager on duty was actually available and refused to give insurance information. Said to go to the Dr and they may or may not pay our bill. This "hospitality manager" refused to comp the room even after the girl the night before told us it'd be comped. His advice is just to tell us we could have just checked out last night. We called the 800 number this morning and have gotten an email offering a free night. I told them I did not accept and updated with the awful attitudes we were met with. We were never rude, but can't say the same about the employees. The maintenance man even told the bf the camera isn't facing the right direction and that the light along with the stairs are often removed so they know it's a huge problem.

Took a court ordered substance evaluation and changed my responses entirely.

    Posted: 04 Nov 2021 06:39 AM PDT

I have been dealing with a Drug Misdemeanor LV2 since April of 2020. I was ordered in July of that year to complete 1 year of probation, 1700 in court costs, 24 hours of community service, and a substance evaluation with several classes. Everything went smoothly, my court date for the deferred sentence was supposed to be in July of this year, until my probation officer pushed it back for the following evaluation. The issue is I completed everything I could, besides the recommended treatments for my substance evaluation because I've been waiting on the results for three months now. I called my probation officer countless times, at one point I called everyday for a week and got nothing back. Finally yesterday I get a call telling me where to get the information, and upon receiving the evaluation I find that it's full of lies that incriminate me. It claims I don't know why I was charged, it claims I don't know why I have back pain and as a result a med card (scoliosis), it claims I've never tried other medications like ibuprofin and advil, it claims I started smoking weed at the age of 10, which is far from the truth of 17. Lastly, it claims I thought I got arrested for speeding which is also wrong. I explained the entire situation and how we got pulled over and why.

Long story short, I have court on the 16'th of this month and only got the treatments I was supposed to do yesterday after waiting months. Because of the misinformation on the report I am required to take a 12 part course and a cannabis education course, and I only have 13 days to do it now because I didn't have access to the information until yesterday.

My main question is, do I have any repurcussions? I would get a lawyer but I don't really have the money. For reference I'm in Colorado, got charged originally with 3 charges which the DA reduced to the drug misdemeanor.

Landlord refusing to fix collapsed ceiling

    Posted: 04 Nov 2021 05:58 AM PDT

    Hello,

So, a few months ago the ceiling in our living room collapsed from water damage. I talked to the neighbor and apparently this is relatively common in the neighborhood due to the way the house is built (flat roof with split-level balcony that essentially funnels rain water into one area with no drainage.) The handyman told me the leak was an issue in our house with previous tenants (of course we weren't told until quite a while after we moved in) and the landlord just temporarily patches it up and waits until it happens again. Told the landlord about a small leak in early August, she sent the handyman, he "fixed it." Then a few days later it rained really heavily and a huge section of the ceiling collapsed. Messaged the landlord the instant it happened (she lives in the Philippines, like a 12-hour time zone difference, making communication very spotty and difficult.) Two and a half months and like one hundred requests later and we are still without a living room ceiling. We are considering withholding rent until it's fixed but she threatened to evict us. What should our next course of action be?

Keep in mind, we are not exactly in a position to pack up and move houses right now.

So my business has been using Uber eats since august of 2021. Since then, they owe me about $8,000 in profit. I have been emailing and calling them every single week since September and every time they tell me that there's issues with my account and they will deposit my money once I update my Information. I updated my information two weeks ago and they told me that there's technology issues so they can't pay me. What can I do?

What are my friend's divorce options?

    Posted: 04 Nov 2021 06:55 AM PDT

I (33f) live in Central New York near Syracuse NY. My husband (35m) has a best friend whom I'll call Dave (35m) and he's married to "Jenny" (29f).

Dave and Jenny have an open marriage and have been married 4 years. About a month and a half ago Dave met this girl "Lori" (not sure her age). About two weeks ago Dave told my husband him and Jenny decided to have a trial separation. I was worried about Jenny and called her asking if she was okay. "I'm fine why?" She asked and I replied "Dave said you guys decided to have a trail separation." Turns out he never talked to her. So she found out her husband left her through me. (I felt absolutely awful for this and everyone is saying not to.)

Then a few days later Dave says they talked about a divorce. I held my tongue because I figured Dave had 't actually talked to Jenny. Turns out I was correct. Jenny found out her marriage was over through Facebook. She also has screenshots of Dave saying he wasn't returning and everything in the apartment he doesn't care about. He and Lori have been calling and harassing Jenny if she doesn't pay them money and calling her names. She's cut contact with them and is looking to file for divorce. I know in NY state you can file for divorce abandonment after 1 year.

My question is can she file sooner since she has proof that he doesn't intent to return and has been threatening her?

$6k cleaning fee 2 months later?

    Posted: 04 Nov 2021 10:23 AM PDT

My boyfriend and I moved out of our old place and into our current house in September of this year. (Kenai peninsula AK) We had to move because the 4plex we were staying in was sold and the new owner was so excited to kick everyone out that our previous landlord came to warn us. Not 3 days after the shift in ownership we got a letter for stupid fees about everything - including using a "hot plate" in the living room. Uh- if you're not standing IN the kitchen: you have to eat in the living room. Have they never heard of an electric grill for your table??? It's seriously not much bigger than a dinner plate but I digress.

I had been shopping around as soon as he told us, because it is nearly impossible to find housing and we really couldn't live in a car and keep our jobs. Fast forward it's 2 full months later and my boyfriend gets a letter saying we have to pay "$6,142.97" for replacing ALL CARPETS AND THE FRIDGE. Like- this is a fridge that smelled like death when we moved in and it was empty. Like I'm serious when I say we were just looking to not be homeless.

In our lease we left a deposit of $1850 and we're liable if he decides to clean the carpets. But like…where the FUQ do they think 6k is coming from? It's cruel and I feel like they're banking on us being afraid. But ya, disposal, receptacles, labor, a new mf fridge, and carpeting for 3 bedroom apartment. All after we paid whatever first fees that almost eviction notice came with.

I am 23 years old. My boyfriend is a teacher and swim coach, I'm running a small office in town…we don't deserve this, I just don't know what to do. Is this reasonable?? Please help. It's like I'm in high school but the mean girls can ruin my financial future just bc I presented as poor and crushable.

Tow truck company stole my laptop and duffel bag full of personal items

    Posted: 03 Nov 2021 09:33 PM PDT

The police officer said my laptop was in the car when he was searching through my vehicle after I drove my car into a ditch. I made sure my car was locked and I pulled on the handle before I left my car, so it was locked. The officer said the body cam was on up until the tow truck company came to pick up my car and my laptop was in there up until the tow truck company came. The tow truck company is saying that the police never documented my laptop. I have voice recordings of my aunt that passed away on there and I've been going through so much stress and anxiety the last few days due to the whole situation and I am totally distraught. Is there anyway I can sue someone because this is more than a laptop. These are emotional damages and something that cannot be replaced and I'm literally about to have a meltdown.

Dad lived with his girlfriend rent free in her home for 20 years. No lease. After his dementia became too difficult she sent him away and is refusing re-entry. Does he have tenants rights? CA- USA

    Posted: 04 Nov 2021 12:55 PM PDT

Oooff. It's a rough situation, and I am dealing with the elder abuse/medical care situation separately, that is mostly under control. What I'm looking to understand better through this post is wether or not it is legal for the girlfriend/homeowner to refuse him re-entry without legally evicting him after 20 years of cohabitation. There was never a lease, he paid zero rent, they were romantically involved, she is the sole owner of the home, he is not on the deed. They were never married. I have confirmed all of that already. Does he have tenants rights of any kind? Thanks!

EDIT to add: she was not his legal guardian, he had no POA at the time (I have it now). She was his primary healthcare directive designee, but has since revoked her position, and he was/is self directing (although he REALLY shouldn't have been his, Alzheimer's is raging). He did not agree to any kind of termination of tenancy, but I found a "mutual release of claims" form that she made him sign before putting him out that was not witnessed or notarized.

Pharmacist at CVS. Work 9-13 hour shifts and not given a designated lunch break. How is this legal?

    Posted: 04 Nov 2021 11:15 AM PDT

I am located in NY. Long island to be exact Is there something that exempts pharmacists from getting a lunch break? I usually work by myself and technically am not allowed to leave the store without closing it down because the pharmacy legally cannot be open without a pharmacist present. But we get no designated lunch break. I try to go to the back and quickly swallow my food whole but i cant even do that without customers yelling "WHERES THE PHARMACIST?! YOU DONT DO ANY WORK AROUND HERE!" I feel faint every day, ive passed out in front of customers. How is this legal??? Who can i talk to?

Harassment from neighbor in NYC coop apartment

    Posted: 04 Nov 2021 11:47 AM PDT

My family (mid-30s couple and 20-month-old toddler) and I live in a NYC co-op. Some relevant facts:

    - We own
    - Our downstairs neighbors own
    - Our apartment recently had sound proof flooring installed before we bought it
    - We are +80% carpeted

The day after we moved in, our downstairs neighbors called us complaining about our toddler toddling around the apartment early in the morning. We apologized and have since not allowed him to make any noise before 8am on weekdays and 9am on weekends.

The second day after we moved in, downstairs neighbor began banging our ceiling any time our child moved about the apartment (always between 8am and 8pm, never at night). This banging happened all day, every day, any time there was any movement from us (including vacuuming, accidentally dropping something, etc), which has all been within reason. We don't let the kid stomp or run around a whole lot because of the chaos that will ensue with the downstairs neighbor. Sometimes it's hard to avoid but we curb it and stay out of the apartment as much as possible.

Neighbors downstairs then started cursing at us out the window. They started vibrating their ceiling (our floor) with what seems to be a theragun or some other loud thing, I don't know. They will vacuum their ceiling, blast music at the highest volume, do anything to make noise to retaliate.

Both my husband and I called the husband downstairs to try and work things out. We asked him nicely but firmly to stop the banging on the ceiling. We offered to keep the toddler out of certain rooms on certain dates/times but after several text exchanges it was clear that these people didn't actually want to work with us, they gave us no information as to ways we could help, they just want complete silence all the time.

I complained to our management company 6ish weeks ago. They were supposed to forward this complaint to our coop board but I didn't hear anything for 3 weeks. Fast forward to 3 weeks ago when our neighbor hooked up a microphone and yelled threats to my safety out her window. I am 100% certain it was her. I took a video. I called the cops. They wouldn't take a report at my home so I went to the precinct a few days later and filed a harassment report.

Management has not yet done anything but claims they want to set up mediation with the neighbor. We follow up constantly about this because nothing seems to change and we have been given no info and no plan of action. Our coop board won't do anything, either, and is deferring to management who, as I said, is dragging their feet/doesn't care.

These people did similar things to the owner here before us and before them. We were not notified of the severity but it's not clear whether or not it was documented well enough to actually be enough to take legal action, according to our real estate lawyer. I also consulted an attorney who works on civil matters including housing/tenant type things and she said it'd be very hard to litigate directly with the neighbor.

At this point I want to put pressure on the neighbor for the threats she made to me and/or the coop to do something about these people harassing us for almost 3 months. What to do here? Any advice or experiences would be very helpful. Thanks!

Wedding venue charging us $900 to replace a table, what do we do?

    Posted: 04 Nov 2021 06:16 AM PDT

Our wedding was earlier this month at a restaurant. While there, a candle caught fire and burnt patches into a table.

The tables are solid wood and made by the Amish. We requested an estimate by the makers for the cost to replace or repair it. They were quoted $900 to replace it.

We have renters insurance through Lemonade, which includes liability insurance. We believe this means they will cover the damage to the table, but my question is, what happens to the old table? It's by no means unusable, just a little burnt. We've seen pictures and they could easily buff it out. Does the resteraunt have any duty to try to repair the table before replacing it completely?

Should they be filing a claim with their insurance instead?

    Workplace Fines

    Posted: 04 Nov 2021 07:26 AM PDT

I work in an industry that surveys customers post-visit in a satisfaction index that allows them to select level of satisfaction with various experience factors on a scale from 1-5.

My employer has decided to institute a $20 fine in the form of a deduction of wages for every survey received that has an overall score of 3/5 or less.

Experience satisfaction questions also rate things that are completely out of my control as an employee and in fact are actually in the control of other employees that are not subject to the fines.

My question is if the employer has made accepting this fine a condition of employment, is it legal in Florida to have this fine in the first place, and what recourse do I have as an employee to refuse to pay these fines?

I'd like to make a website to raise election awareness including endorsement and criticism of political candidates. Will I run into legal trouble?

    Posted: 04 Nov 2021 12:09 PM PDT

I know there are strict rules around non-profits but as a private citizen, or as an LLC, can I do this without regulation? I can't seem to find any examples of what I'm looking to do - even the post partisan websites don't seem to endorse or criticize particular people.

This would be a broad "campaign" that supports any candidate with a certain political values profile. Not limited to any individual state or election.

Letter to step kids regarding deceased dad's items she was holding for them

    Posted: 04 Nov 2021 08:18 AM PDT

My kids's father passed away in August of 2020. His wife got everything he had which was fine since she never paid child support or any other type of physical support. He had gotten a settlement of around $30,000 the year before. In October of 2020, my kids's stepmom of 3 years stopped by with a basket for each of the kids containing some of his belongings like knives and small crafts he had made. In each basket she had written a letter signed and dated stating she had other things that belonged to their dad that were put up and they would get them when they were adults and settled in their own house or she died, whichever came first. Well she passed away a couple weeks ago and I heard that her daughter was cleaning out the house and giving things away. So I sent a very nice message explaining what she had said to me and in the letters and she said she knew nothing about it and that all of Joe's things were already passed out to family. Which he had no other family. The kids's dad had told me he had tools and some of the larger craft items he had made that he wanted them to have so I am assuming that's what it was. Do I have grounds for any type of legal action?

Advice on Grandmother’s senior citizen apartment complex situation

    Posted: 04 Nov 2021 12:59 PM PDT

Greetings everyone, I have a complicated situation in which the "community director" of my grandmothers living complex who is being difficult over something trivial.

My grandmother lives in a complex where to get inside you need a digitized key where it's basically a chip. My grandma, her caretaker, and my father all have one. I accidentally lost my fathers key at work, but it was no problem because I could buy it from the complex. However, when I asked the community director she fabricated some story about not having enough chips. However, when my grandmother asked to buy a new key she told her no because she was going to give it to me. Her caretaker asked as well and she declined her.

She's being extremely difficult with this whole situation and it's quite frankly annoying, for one every morning when I visit my grandmother I see her follow me around the complex and making it uncomfortable for myself to visit. I am not loud, rowdy, messy, or obnoxious. I visit my grandmother every Monday-Friday in the morning at 7 and during the afternoon. I understand if I come late at night or early morning but regardless I don't cause any problems.

I don't know who to contact as she seems to be the only one running the office for the simple request of buying another key.

How should I go about this?

    Thanks for reading and replying.

Hit a massive pothole that I could not have seen and I do not feel right paying for anything (deductible/ materials cost) Colorado Springs, Colorado

    Posted: 04 Nov 2021 03:07 PM PDT

I have basically hit a pothole the size of a kiddie pool (5 ft long, 2ft wide, 8 inches deep) in the middle of the night and completely ruined my car. It does not feel right that I have to pay 1000 out of my 4000 estimate. I have called an attorney but I was blown off because it wasn't enough money for them to try and I talked to my insurance company and they basically just said "it is what it is". What can I do? (I can pay for it, I just really don't want to)

    Undisclosed house issues

    Posted: 04 Nov 2021 02:57 PM PDT

I recently purchased a home. After a crazy summer of storms, there are cracks appearing in my drywall under and above windows. Like, a lot of cracks. Upon closer inspection, where ever the cracks are appearing, the texture of the wall is slightly different, and it is pretty obvious that the previous owner patched the cracks and repainted. The cracks are opening again. I suspect that there is some movement in the foundation, as it is an old home and there is some slight bulging in the basement walls.

If it turns out that there is a serious issue, Would I have any ground for recourse?

Boy exposed himself to girls at school- Mom refuses to sign off on any behavioural help at Dad’s request

    Posted: 04 Nov 2021 12:43 PM PDT

First post here, please let me know what other details I should fill you in on. Location is California.

My sister is engaged to a man who has 2 kids with his previous wife. My sister and her fiancé (I'll call "Joe") have long suspected that the 6yo boy (I'll call "Bobby") may have some form of mild autism, or another behavioural issue that would benefit from early intervention.

In the past, Joe has tried to have discussions with his ex-wife about taking Bobby to see a therapist or seeking some sort of behavioural intervention. She has always refused, saying that she will not sign off on anything of the sort. They split 50% custody of their two kids.

Today Joe received a call from Bobby's school. While sitting at the lunch table, Bobby got the attention of two girls and told them to look under the table, they did, to find he had his penis out.

Joe called his ex-wife and again said that Bobby clearly needs help and again asked her permission to take him somewhere. Ex-wife says absolutely not, and she would fight him "tooth and nail" in court to prevent him from taking Bobby to a doctor. She said there is nothing wrong with her son and it's just normal little boy stuff.

Joe is very upset and wants to do what is best for his son, but he also doesn't have thousands of dollars to drag his ex-wife through the court system. He's not trying to take custody from her or anything of that nature, just wants her to sign off taking Bobby to be assessed.

What should Joe do? Is court the only option? Is there any way he could represent himself?
