The cops shot my dog in my yard, what are my rights/legal advice?

    Posted: 04 Nov 2021 06:48 PM PDT

I live in Los Angeles. This afternoon 2 police officers walked onto my property, both had their guns out, one with a pistol the other with a bean bag gun. My dog was in the backyard at the time, but as they approached, she ran into the driveway and stood there barking at the officers. Then they shot her in the face with the bean bag gun. I have the footage on 2 different Nest cams.

I don't know why the cops were called or why they came onto my property. They claimed she attacked them, but my Nest footage is clear that she was standing there wagging her tail and barking.

I'm at the vet right now with my poor dog who is okay but will need thousands of dollars worth of treatments to recover. I'm still in shock trying to figure out how and why this happened.

What rights do I have? Should I contact a lawyer? Does anyone have any advice or suggestions? My head is spinning, please help!

Edit: just uploaded Nest cam videos to YouTube https://www.youtube.com/watch?v=MLjKKUXpbI8 https://www.youtube.com/watch?v=_BdvjzRBImE

Ex wife has cut off my entire family from contacting my 15 year old son, what can I do?

    Posted: 05 Nov 2021 10:25 AM PDT

We got divorced last year, I have been paying child support since we separated in early 2019, and we have a custody and visitation agreement.

Because of distance, I see him 2 days a month and alternating holidays. It sucks, but it's what the judge ordered.

The bigger issue communication. She moved far enough away that it makes swinging by to visit unreasonable for family, since my entire family lives here and she's 5 hours away. Also, she deleted his email account and took his phone away permanently. He's a good kid with great grades in school, so it wasn't to punish him for anything, it's because she's a manipulative control freak and doesn't want anybody in my family to have contact with him.

She said as the mother, she doesn't have to let is have a way to contact him. I don't know if this is true, but it sounds like bullshit and abuse against him to cut his entire family off.

She tries to tell everyone they can call her or email her, and she will relay the message to him and let them know his response. You can see where the problem is with this. One, there's no way to know if the messages are being relayed. Two, it's his right to have provate conversations with his family without her screening the entire thing.

He told me that the last time his mother let him call my mom was 4 months ago, and that his mother put it on speaker and told him that if he told my mom it was on speaker he was grounded frim everything for a month.

She's a shit person and a shit parent. These aren't exaggerations. What she's doing is clearly wrong, my question is whether it's legal, and if not, what exactly would I file to be able to get communication opened between him and family? I even offered to buy a phone and add him to my plan, ex said hell no. She wants to isolate him and it's not ok.

[USA - OH] Landlord demanding $1700 "security deposit" for a house I've been renting and living in for 2.5 years

    Posted: 05 Nov 2021 09:09 AM PDT

I live in a large, corporate run housing development which contracts with a major military installation to provide housing. Housing is not limited to just military, anyone can live here. When I moved in in early 2019, I was active duty, but have since retired.

Earlier this year, my lease converted from a one year lease to a month-to-month lease as agreed upon in the lease. I was notified in October that since I am no longer in the military, I need to switch to a civilian lease, which would increase my rent by $300/mo.

In addition to the rent increase, which takes effect on December 1st (if I choose to sign a new lease), landlord is also requiring a $1700 security deposit. Landlord is requesting deposit by Tuesday, November 9th after notifying me on Thursday, November 4th.

Do I have any ground to stand on here? In addition to a $300/month rent increase, I don't see how charging me a $1700 deposit on a 5 days notice - to continue renting the house I already live in - is fair or reasonable.

Workman's comp is refusing to allow my doctor to examine and treat my entire injury.

    Posted: 05 Nov 2021 05:25 AM PDT

I was hurt at work a out a year and a half ago, a back injury. At the time of injury it was my mid back that was hurting pretty bad, over time the pain has extended to my lower back as well ( it took a few months just to get approval to see a doctor that could help me).

Now the doctor and workman's comp are refusing to examine or treat my injury. My current lawyer is telling me this is all 100% by the books, and there's nothing I can do.

A doctor I only saw for 10 minutes has determined that I am fully recovered, released me for full workload. Yet my pain prevents me from working a full workload.

Is there any way I can get these doctors and workman's comp to examine and treat me?

Previous owners established an easement on our property AFTER we were under contract

    Posted: 05 Nov 2021 11:10 AM PDT

My question: should the previous owners have given us a disclosure about this issue/do we have any grounds to sue them? For context, this is a newly built home in USA/NC.

    Timeline:

-At some point, previous owners prepared a document stating the home's driveway was an easement to a property that they also own behind the house

-We went under contract on the house

-One day after due diligence is due (haha) we receive the survey results and the driveway is listed as "private r / w," we didn't know what that meant and didn't notice it

-The document about the driveway being an easement was recorded with the town

    -We moved in

-Next day, people came to put a road sign up on our driveway

-We realized the end of our driveway would be extended to be a road to the other property, meaning we could no longer build a garage there or use it as a garden

Again, just wondering if we have legal recourse. We're first time home buyers and our real estate agent and the previous owner (who was also the selling agent) told us they'd take care of us. I'm of the opinion that this piece of information was submitted to the town late and not explained to us so we wouldn't back out of the sale.

Thank you for whatever information you can give me!

recently wheelchair bound & apartment with stairs isn’t letting me out of my lease without a massive fee

    Posted: 04 Nov 2021 06:18 PM PDT

Hello, this will be a long post and I'm sorry! I have no one else to go to right now.

Backstory: I have a chronic illness that affects my heart function, and this past month I've had severe dizziness and chest pain. My cardiologist prescribed a wheelchair, and although it has helped ease my dizziness a lot, my apartment has stairs. Stairs have become a lot more challenging, for obvious reasons. Any time I try to leave my apartment, I end up getting super lightheaded and will occasionally pass out and fall down the stairs. This has resulted in a mild concussion & a fear of leaving my apartment. I have missed work due to not being able to leave.

I emailed my landlord on October 22 asking if they had any ADA compliant apartments. They emailed me 12 days later and said "Currently, we do not have any ADA apartments available. If you need to break your lease, we would require a thirty day notice plus a termination fee of $2800."

Is there a way around this? I can't afford to throw away $2800, especially with my hospital bills piling up. I don't know ADA law very well, but I thought if my landlord denied me a reasonable accommodation I would be able to break my lease no consequences? They didn't even offer a compromise

I live in Austin, TX if it helps. I've reached out to Austin Tenants council but haven't heard anything. This is urgent because I am at risk of losing my job due to absences.

Edit: my lease says "my right of early termination is not limited to a particular fact situation" Idk what that means?

Toronto, Ontario - I am selling a puppy and a family came to view them and dropped one.

    Posted: 05 Nov 2021 01:12 PM PDT

Hey everyone, long story short what happened was I was selling puppies on behalf of my uncle and a family came to meet them.

While playing with them, one of the family members picked up the puppy and it dropped out of her hands. Now it is limping.

They lied and said that the puppy was limping when they came, but I have cameras in my house that say otherwise. I also have the recording of when the puppy was dropped by the family member.

If the puppy does not get better and she has a broken leg, what can I do in terms of rectification from the family?

I am very upset at what's happened. They have denied everything and they left shortly after.

On my cameras I also have their license plate and a video of the incident

Is it considered ransom if a friend says they will self-harm/commit suicide if you leave them? What actions can I take to prevent them from hurting themselves but also stay away from them?

    Posted: 05 Nov 2021 09:14 AM PDT

I posted about this on r/relationshipadvice but I'll sum it up: My toxic FWB made me feel guilty for saying no to sex. I blocked him on everything and have tried to better myself. But he got a new number and came to my house telling me that basically he needs me and will self harm if I don't unblock him. He is high risk (depressed, history of self harm and suicide attempts, and a close loved one recently committed suicide) I know short term solutions would be calling the police for a wellness check, but it hasn't helped in the past.

What can I do to stay unfriended with him, but prevent him from hurting himself and getting him help?

    Food Plug

    Posted: 04 Nov 2021 06:03 PM PDT

I recently used a "food plug" service, and was confronted by a chipotle manager. Food plugs are people who sell vastly discounted fast food over social media sites (in this case snapchat) to customers through online orders. They use stolen account info to make the order for free, and pocket the all of the payment, sent over a third party service. The plug I was using services hundreds of customers daily, by estimate.

After making a Chipotle order with the food plug, I went to pick it up with a friend. An employee asked me what order I was there to pick up, and after I told him he said he would be back in a minute. The manager then came and said the order was made with a fraudulent account, and the order was cancelled. The manager then said that the account owner was pressing charges, and they had our (my friend's and I's) faces on camera. I said thank you for letting me know, and left.

Because the manager already knew the account was fraudulent, 10 minutes after the order was made, I was not the first person to be turned away then.

I knew how the plug worked before hand, and I'm not going to pretend like I did a good thing. I would like to know the potential legal trouble I'm in, however. Thank you.

Is it legal to copy the source code of a site and modify it?

    Posted: 05 Nov 2021 11:35 AM PDT

I hired a web designer recently and it looks like he completely ripped the source code off of a site and then modified it for my website. He didn't steal any text or images from their site, but the layout is exactly the same. I'm not sure if he reverse engineered it or if he straight up stole the code. Is this legal? Can I be sued? I just will fire him if it's a big issue but honestly it looks really good and I'd like to use it if possible.

[Pennsylvania] I worked for a major healthcare company in their customer service department. They handed out slips to employees for "HIPAA violations" to have employees pay fines to the company.

    Posted: 05 Nov 2021 01:54 AM PDT

In my company there's a standard script to follow when dealing with inbound patient calls to the call center. It's done for HIPAA verification. Ask first and last name. ID number or SSN if they didn't have it. Date of birth. And finally phone number. And all answers had to match. Even the phone number, and I would get into loud screams from customers because they have a new phone number and it's not on record. We couldn't engage in the call unless those questions were asked and answered.

Some employees didn't ask the phone number question and I saw managers putting yellow slips on their monitors when the employee wasn't there. These were "HIPAA fines" which amounted to $20-$50, that employees had to pay to the management?! They told employees that they could be personally be sued by patients if they didn't ask the HIPAA questions. So they can be sued for not asking a phone number? But phone numbers change all the time, and people don't update it with us right away. Is this legal?

Bought car, seller won't get new title [VA]

    Posted: 05 Nov 2021 01:10 PM PDT

Bought a car from a guy, he gives me a title and bill of sale. I go to the DMV to title/register the car. Problem is that it's a "floated" title. The title is actually in the previous owner's name, signed to seller. Seller thinks that that plus a bill of sale is good enough for DMV, DMV disagrees.

I message the guy and ask for him to title the car in his name then sign over the new title. He thinks it's unnecessary, and after a lot of back and forth his best advice is, "try a different DMV."

He's now stopped replying to my messages. What can I do? Is there a way I can move on without this guy or do I need to get a lawyer. Right now the car is sitting as I can't get plates without registering it which requires a title.

How does one look for and go about getting/paying for a divorce lawyer when a child is involved? Wisconsin

    Posted: 05 Nov 2021 07:00 AM PDT

My husband told me saturday that he wasnt in love with me anymore and felt lost on what to do. He didnt want to seperate because nether one of us has a place to go. Didnt want to divorce because "im an amazing wife and mom" and didnt want to wait it out because thats what he had been doing for months.

We made the decision to seperate to give us time to think and reflect. I got myself an apartment for me and our daughter. I move out tomorrow. We have been very civil, understanding and cooperative so far. Its been a roller coaster emoationally for me. I am thinking in the best interest of our daughter.

As much as we are getting along I know things can turn sour fast. I am not keeping her from him nor his family. We are agreeing on what we are splitting so far. We've discussed whos paying what amd he got a seperate bank account. I am willing to work with him but i feel that a lawyer is the best option. I dont know what to look for in a lawyer, how to pay for one, where to begin. Iv never had to do anything legally before really.

FL-Ok Got letter yesterday they were suspending my license on the 8th. I moved from Florida to Oklahoma.

    Posted: 05 Nov 2021 01:28 PM PDT

We recently canceled my insurance from Florida as we were moving from there to Oklahoma. This was the 13th of Oct. We had insurance the same day. Yesterday, we got a letter stating that because of no Florida insurance, they will be canceling my insurance. I have repeatedly called all day and cannot get through to an operator. I tried to put in my insurance from Oklahoma in and they will not accept it. It days it will be canceled the 8th at midnight.

I'm a loss on what I can do. I just moved into my new residence the 20th and I cannot afford to lose my license. What can I do to stop this?

Husband is retaining a lawyer over fence dispute- I don’t want anything to do with it. Advice?

    Posted: 05 Nov 2021 10:21 AM PDT

My husband had two in person conversations with our backyard neighbor who's fence is about 6 in onto our property, on about half of the width of our back shared property line. It's a beautiful fence, doesn't bother me at all. Apparently she had a text convo with previous owners that that would be ok (I think because there are trees that straddle the property line so she didn't want to cut her fence a foot or so short on her property- which obviously she should have just done that but that's a different point).

Husband doesn't like her, she did at one point actually say "take me to court then" according to him a few months ago but since then I thought communication was open again and we'd try to talk it out and be reasonable before getting to that point. She also offered to move it ASAP is we pay half (which obviously rubbed him the wrong way.)

I don't want lawyers involved. I'd rather have at least one more text (documented convo) just to follow up and ask one more time what her timeline is for moving it. He wants to go straight to lawyers and have her pay all legal fees. He's now saying that I'm leaving myself open to risk if I don't sign this lawyers retaining contract but he does sign it. Am I doing anything wrong by not signing this contract/ getting involved?

(Also, for whatever this adds to the story- She also has a tiny house lifted up on a trailer (to avoid permits- were in a flood zone) that's directly up against the fence and all the windows look directly into our yard and main living space. She ran gas and electric to it against city code and Airbnb's it out. So having strangers constantly looking at us isn't fun, not illegal though if permits and all are in the picture though. One last piece to the puzzle is that she is a little crazy- microchips in vaccines kind of crazy. I just don't want to rattle the potential hornets nest if we can attempt to gently relocate it first. )

    What does meth smell like?

    Posted: 05 Nov 2021 09:12 AM PDT

So we've just moved to this apt building and everything seems to be OK. However, there's this distinct smell very late at night, like 3 AM till just before 9 AM, since management office opens at 9 AM.

Extremely strong smell comes through the common vents to our unit, makes it feel like we are suffocating. We stay up all night, barely get a couple of hours of sleep because of it. Smells nothing like cigarettes, weed, hookah smoke, food or anything like that.

Our manager is pretty rude and doesn't like anyone to complain, she told us to call the cops. My bf called the cops, for some reason like someone heard us and smell was weaker so he didn't smell anything, and told us it's late and I can't knock on doors now, and lights are off. Also told us manager should be able to do something about it.

Weirdest part is, we have cameras in the building and we keep telling management if you could look who's walking in the hallway around 3 AM, they refuse to do it.

Anything we could do, besides just moving out?

Last year I got fired the day after I got hurt on the job. Is it worth it to threaten legal action?

    Posted: 05 Nov 2021 02:23 PM PDT

Around this time last year, I hurt my knee at work and the next morning, management called me up, tossed some transparent bullshit at me, and terminated me.

I could barely walk for awhile and spent a couple months in 3x a week physical therapy, which my former employer covered (Work Comp) without any fuss, probably to keep me quiet so I wouldn't sue.

At the time, I was really overwhelmed and didn't have the mental energy to consider legal action - I was pretty hurt and suddenly unemployed in the middle of a pandemic - but a lawyer in my family recently let slip that they probably would have settled out of court with me for a decent sum just to keep the whole thing quiet.

Obviously I could use the money but I would also love to make them think twice about doing the same thing to somebody else. Aforementioned lawyer grumbled at me that he's "not a court attorney" and zipped his lips so here I am.

How do I know if it's worth it to look into legal action? How would I go about doing that? Is it any different because it was a temp job?

Employer Accessed Personal Email & Withheld Paycheck

    Posted: 05 Nov 2021 02:17 PM PDT

    Location: Texas

    Hello,

A few months ago my employer accessed my personal email account, found out I was searching for a new job, and decided to fire me due to that reason. The board tried to step in and reverse it, but didn't have the authority, however, they did offered to pay me an certain period of time so that I could find a new job (roughly 5 weeks), and allowed me use of company property (laptop and cell phone) until I got one. I 'm not sure if it's legally "wages in leu of" or "severance."

I found a new job, however, they withheld my last two paychecks until I returned company property. I was more than happy to return it, but held onto it because they wouldn't release my personal phone number (one I had prior to working there). By the time they released it and I returned equipment, almost a month had passed between the time I should have been issued my final (wages in leu) paycheck. Is this a violation of payday law in Texas, and if so, what are my recourses?

    Thank you in advance.

No Contract, Cancelled Wedding, and Caterer Won't Refund My Deposit

    Posted: 05 Nov 2021 02:11 PM PDT

In December 2019, I paid a $2,000 deposit (as a check) to a caterer for my October 2020 wedding. The wedding didn't happen due to Covid. There was no contract (I know this was dumb). The caterer wrote: "We do not have contracts, we just need a 'formal' email from you stating that you are hiring us to cater your wedding."

She did note in one email that the deposit was non-refundable.

I communicated with the caterer throughout quarantine in 2020 to let them know we were postponing. Now, though we've decided to just cancel the wedding and elope. I let the caterer know and asked if it was possible to get the deposit back. I was told they couldn't but would hold it for us if we changed our minds.

What options do I have, if any to get the money back? Is this a sort of implied contract based on the email exchanges? Or is there any hope for getting even a portion of the money back?

Edit: The caterer is located in Vermont. I am located in New York.

Can the police take my friends dog away for this?

    Posted: 05 Nov 2021 09:12 AM PDT

Asking for a friend! Advice needed ASAP please. Located in Michigan.

So my friend has a dog that she has had for ten years. She allowed her friend to "foster" him as an ESA for her friends daughter. All paperwork/registration remaining in my friends name. The person is not a registered foster or anything. That's just what we call it since it was temporary. Most of the time that the dog was staying with the foster they lived on my friends property so there were no problems. However, since the foster moved off the property there have been several issues. Most recently: The foster lost the dog (who is elderly and completely blind) and wasn't even going to tell my friend about it until my friend pressed her and finally was told that the dog was lost since that morning. That was Saturday. Despite going to search for him that night and posting online/calling shelters and vets we were only able to find him and bring him home yesterday (Thursday). The foster has been completely ignoring her for days so my friend did not notify her that she had found the dog for some hours since the foster would not even respond to her calls or texts. The foster is now harassing my friend and her family and threatening to call the police on my friend if she does not give the dog back. My friend is obviously no longer comfortable with her dog staying at the fosters home because of how the foster handled the situation and didn't seem to care about the dogs well-being. Would the police take my friends dog? Could she face any legal repercussions for taking her dog back? How would you handle this situation?

Apartment Complex won't Pay for Electricity I was billed for time period AFTER my lease ended

    Posted: 05 Nov 2021 01:05 PM PDT

    Hello,

I recently moved out of an apartment complex in TX. Lease ended in late August. However, my electricity provider is charging me for electricity used in September. TLDR, my electricity plan had expired but I was, unbeknownst to me, still under contract. Fine, whatever.

I checked my complex's website and saw my former unit is still unoccupied today, meaning the complex, not another tenant, was in possession of the unit in September.

I asked my complex for a credit for the amount I am due to pay my electricity provider for September. This is because I'm being charged by my electricity provider for a time period in which the complex, not me, was in possession of the unit. My lease had expired by then.

My complex is refusing to provide said credit.

My question: what advice would y'all have for me to obtain this credit?

My thinking: I was technically still under contract with the electricity provider for September, thus IMO no wiggle room with them. However, it's not right for the apartment complex to be in possession of the unit and not be paying electricity. Rather, the complex is having a former tenant pay for a time period after their lease expired. Regardless of any onus on me to cancel my electricity, the complex is still free-riding by using electricity and not paying for it, leaving me to pay for it after my lease ended.

    Any advice/comments/thoughts appreciated. Thanks

TLDR; apartment complex won't credit me for electricity used by them after my lease expired

[Update] Do I have legal ownership of a lost cat? [Florida]

    Posted: 05 Nov 2021 01:03 PM PDT

    [Update] click here for original

hey! so got back from the vet just now time for an update. so the chip was in fact there but the reason it didnt pick up on scanners is because its broken into 3 pieces. found that from an xray. also found a bb gun bullet in the cat (far away from the chip so unrelated most likely). we told the vet that we think this cat was being neglected since she ate 7 cans of tuna within 24 hours of finding her, was left to wander the streets for 2-3 days at a time (told this directly from the alleged owner) and had ear mites when found. this paired with the broken chip and bb gun bullet in her makes it more likely to be true. vet said he only knows 3 ways it could have been broken, either whoever put it in messed up and didnt notice, someone purposely went in and broke it with tweezers, or some sort of trauma to the area caused it to break. the vet called the alleged owners vet clinic and explained the situation and the receptionist said that i would make a better owner given the situation. but since theyre only vets they cant intervene to transfer ownership and it has to go up with law enforcement. given that the woman has no evidence as far as i know and blatantly lied to a officer about the chip being functional (or he knew it wasnt and is also lying) i dont think theres much grounds to arrest me. my mom is still concerned i may get arrested for this but im going to sit down with the woman and officer today when they come back for an update and tell them everything and demand some sort of proof of ownership. if they fail, how would i go about claiming ownership?
