He has problems with self regulating and can have extreme meltdowns. He was having a meltdown on the playground and a teacher tried to use her personal phone to call for assistance and during the course this he hit her hand causing her phone to drop and break. I don't believe he was deliberately targeting the phone, but when he is having a meltdown all logic goes out the door. I've paid 284 a month for 6months and they've charged me a 300% interest rate for this and I am now having to pay on this loan for another 6months. Is this illegal when I looked it up everywhere it says my state has a max 100% interest rate but when I spoke to some guy named mike he tells me they are allowed to charge this interest rate. I have breast implants as well and will need to make sure they are not ruptured. I know who she is and where she works - she knows all the bar staff well so no one even did anything when this happened. I am livid. I realize maybe not much can be done but I figured I'd post here in case someone has advice on what to do. I am in the state of Oregon and the woman who did this was intoxicated and I was sober. The past week my girlfriend and I, who live together, got sick and have the same symptoms and everything. She was getting symptoms a few days before me so her tests were taken before I did mine. Her rapid antigen came back negative but her pcr 5-day came back positive. This was Thursday night and I was scheduled Friday night. So I got my tests Thursday night and the rapid came back negative as well but my pcr has yet to come back. I told my boss immediately Thursday night what happened and she didn't seem to care that I was at least exposed and have symptoms still and said to come in anyway. I agreed reluctantly. So Friday night when I go in to work I ask the bartenders if they feel comfortable with me working and they all agreed they can handle the shift without me and that they don't want to be exposed. Boss calls today ( saturday) and says I should have stayed at work Friday and that was unacceptable to her to I was let go. Seems ridiculous to me that I was just trying to be safe and got the shaft. I am constantly exhausted as I only get 4-5 hours of sleep on these nights and cannot recharge during the week. I cannot afford to break my lease and move. Because this has so affected my quality of life only halfway through the semester, I have been calling the non emergency line around 3 am to file a noise complaint. I am very anxious and worry that I will get in trouble for calling so many times. Will that happen? Can I get charged with a crime for calling so often? TLDR: Dealership who sells plenty of Teslas is advertising them with the $10K self-driving option, but they don't have it. We have been in the market for a Tesla as a family car for us and our two toddlers for a while now and finally decided to pull the trigger. We found a suitable Model Y Performance with Full Self Driving Capability (FSDC) at a local exotic car dealership that appears to buy Teslas new and flip them for a small profit so you can avoid the 6-12 month wait. Window sticker has FSDC listed at a $10,000 installed option and the purchase agreement states that the window sticker is a primary document in the contract. We agree on a price (over full retail, including the extra $10,000 for this option). We pick up the car late one evening, give them the check, and sign up for our Tesla accounts. A few days later after the accounts are set up it shows that FSDC is not present. Tesla support confirms that this vehicle has never had FSDC, and that the dealership falsely added it to the window sticker. We call the dealership and their response is essentially "That sucks, not our problem…no way in heck are we paying for that option!" I don't want this to turn into a huge battle; simply to get what we paid for. At this point even a return wouldn't really help us all that much as prices have gone up at Tesla. They have a pretty decent online reputation that they are really putting on the line with this kind of behavior IMHO. The singer agreed all the details are good. The day of the event, the singer sent an EMAIL stating she wouldn't be at my cousin's event; then the singer refused to provide a refund stating she has a clause in her contracr that allows her to cancel at any time without providing a refund. Is this even legal? (It happened in Dallas, TX) The singer told my cousin not to give bad reviews or she'll regret it. Singer messed with the wrong woman (plus as her family we have her back). My debit card was charged for the game, and it shipped out. A few days later, the game arrived, I opened it and played it, and everything seemed fine. I rarely use this website to purchase things, and only chose to buy this game from them because it was on sale there, so I didn't have any need to revisit the website after I got my package. As far as I could tell, the transaction was complete. But then, a few weeks later, I received an email saying that my package had shipped. I was like "I didn't order anything...", so I logged in to the website to see what it was talking about. The order for that game was now active again, saying that it had just been shipped. I checked my bank, and no, I wasn't charged again... so I assumed maybe there was just some kind of mistake and nothing was actually being shipped. Like it was just some bug in their notification system or something. But sure enough, a few days later, another copy of that game was delivered to my door! So of course my immediate thought was "lucky me, I could probably go exchange it for something else" (which I haven't done yet, for the record). But then I went to the website again and it still listed it as being on the way. So... a few days later, once it passed the estimated delivery date, the message then says that they'll try and get the package out to me... and sure enough, about a week later, as of yesterday, I get another email saying that my package has been shipped! A third copy of the game is now being shipped to me, despite me ordering it, and only being charged for it once! So um... What do I do? I mean I know ethically what I should do is inform support and return the games... but... do I legally have to? I mean, it wasn't like I deliberately messed with their shipping system or something to get them to infinitely send me free games... it just happened. I don't know why it's happening either. But anyway, can I get in trouble for not sending the extra games back? Will they approach me and expect me to pay later if they realize the error? Homophobic neighbor threatening my nephew Posted: 30 Oct 2021 06:47 PM PDT My neighbor who we've never had problems with until my nephew moved in had a confrontation with my nephew and called him a fruity boy a few months ago. I emailed one of the board members about his actions (he is a member of the board also) however she said she would deal with it when she returns to the country. Today he knocks on my door threatening that if he runs into my nephew he doesn't care if he has to do time or we call the police he's going to "handle him, and he's acting like a fucking tough guy" I informed the board about him today and said just a heads up I would be filing a police report and the board threatened that if I do that they will file a police report on my family which I believe is retaliation but not sure. They also accused us of illegally renting out a room in our apartment and want to come into our apartment to meet everyone who lives here. what steps can I take legally to protect my family? We can't live in fear because this guy is an immature homophobic 40yr old. If he doesn't mind being in prison and coming to my home to threaten us I'm going to completely destroy him legally and I have the assets to do so Advice is appreciated Thanks! U.S OR - Employees not allowed Lunches or Breaks | Help/advice needed Posted: 31 Oct 2021 08:58 AM PDT So myself and most of the employees at my company are kind of in a screwed up spot. We are required to have someone else cover us in order to take breaks or lunches as we cannot leave the call system empty (Remote IT company) and as we have had multiple firings and resignations, there are some of us who are not allowed to take lunches or breaks at all during their 10 hour shift, because nobody comes in to relieve them until the last hour of their shift, which sometimes isn't even on time. Example 1: I work 8am to 7pm, I am the only person who works this shift, the next person on shift HOPEFULLY comes in at 7pm. They work until 6am, there is supposed to be two people on this shift, and one of them stays an extra 2 hours late every night to cover me until 8am because we cannot leave our shift until someone else takes over. If one of those people isn't on shift then they can't take lunch or break either. LEGALLY we are allowed lunch/breaks but we get written up or fired if we leave the queues empty, and as it is an at will state they can and WILL fire us if we try to take our break/lunch regardless. Is there anything we can do short of using money we don't have to hire an attorney we can't afford to fight this? Because if we try to stand up for ourselves and get fired, we have to magically prove they fired us for this reason and not a made up reason they can legally get away with because.. employee protection laws aren't real? No one seems willing to do more than issue warnings and then he avoids the police if called back to avoid citations. Police have confirmed I am more than 100ft away and the music is perfectly audible in my home, lyrics and all, and the bass can be felt in my home. I don't know how to find a resolution for this problem. It is causing mental and physical distress to myself and my partner. I have tried to speak to him several times and he just ignores me or claims some sort of prejudice. Do I have any grounds for legal action of some kind? Who could I talk to? I am desperate. Posted: 31 Oct 2021 06:25 AM PDT To preface, the houses in our area (including ours) are pretty old like 100+ years. 1) While we were initially moving in, my wife stepped through the floor finding rotted/squishy wood. We immediately notified the landlord and a contractor came out and nailed a 2x4 over it saying they will try to source replacement flooring to fix, which still hasn't been resolved. 2) The floor beneath our bathtub is squishy and we often have to clean water from underneath the the bathtub. We notified the landlord and they haven't addressed or made an effort to address it. We noticed the bathtub itself has a crack and is probably the cause of this. 3) As the weather is starting to get colder we found that the heating is not working, the landlord sent a guy out and confirmed it's not working and have been waiting on parts for 2 weeks. This issue may get resolved but I feel the need to mention it because it is yet another issue with this house. 4) 2 weeks ago my wife was walking into the kitchen and saw a massive rat running across the kitchen. We moved the stove out from the wall and saw a stack of our dogs food behind and rat droppings as well. We noticed that there is open space below our cabinets and a hole in the drywall behind the stove. We called the landlord and he covered the hole in the drywall. An exterminator came out and put bait in places we suspected they were coming from and also identified the crawl space below the house as an obvious opening for rats to get in, which was covered. We removed the dog food from the kitchen since then and haven't found any visible evidence of rats until today. We found this morning that the bait was pushed out onto the kitchen floor from below the cabinets so the rats are still here. Our upstairs neighbors told us that the previous renters had issues with the landlord fixing the issues and they themselves and are trying to setup a rent escrow account to get their own issues resolved. However I am not confident (or knowledgeable) if this is a viable or effective solution. I don't have any confidence in the landlord fixing the rat situation let alone the floors in the kitchen or the bathroom. How can we get out of this lease if these issues don't get fixed? They had a month to month agreement and my aunt would occasionally stop by to do some cleaning and repairs. Recently, a pipe burst and my aunt told T that they'd be stopping by to fix the pipe but T wouldn't open the gate to let them in to fix the pipe. When my aunt told T that she needs to enter to fix the pipes again T said she'd be vacating the property by October 29th, then asked for my aunt to wait till October 31st (that being today.) My aunt called and texted T to confirm that she is leaving and T will not answer. My aunt then drove to the property (but didn't enter as I believe that would be trespassing?) but T refused to speak to her again. What should my aunt do if T refuses to leave when T is the one who said she'd be gone? Edit: changed leaving to vacating. Being Harassed, what can I do? Posted: 31 Oct 2021 01:39 PM PDT I have a ongoing issue with a neighbor who has been harassing me and my family because I parked on "his" side of the street even though it's public parking. He doesn't even own or live at the house, it's owned by a woman who is currently trying to sell it. I parked on the street, not in the driveway, not on anywhere near the property besides on the street. The actual owner of the house has tried to assault me when I stated they need to stop the harassment over a parking spot they don't even use or need. When the police were called over these issues the man stated that he is allowed to do these things because he is FBI, when questioned on this by the police he wouldn't give any info proving such and eventually admitted he lied. Is that not a violation of the Stolen Valor Act? To state you are current FBI to try to coerce another to do what you want? He also admitted to running all our license plates to try to get info on us. When the police didn't immediately arrest us for legally parking on the street, he then started telling them my husband and I do drugs in our car and started naming off drugs that he claims he sees us do. I sit in my 11yr old car for 10mins before I leave for work to warm it up or it will stop on the highway, so my husband keeps me company and we sit and talk. I never done drugs in my car, in fact I get drug tested for my job. Before today the man has never been at the house while I was warming up my car for him to witness anything I'm doing. The police made him sign a paper saying he'd stop harassing us and would no longer come onto our property, even gave us a card with the case number and said to call if we continue to have issues. But did nothing about the multiple things he admitted to doing. Well today as I came out to warm my car, Which was parked in front of my house, before work he started recording me and talking shit trying to antagonize me. I didn't engage with him, nor did my family when they heard him. I called the non emergency line to try to get assistance and the police said they were coming but didn't show up. He recorded me the whole time, he has repeatedly tried to increase his bs. He has a Disabled Veteran plate on his vehicle , does that allow him to harass people? I'm not understanding why he's allowed to continue this behavior. What can I do to protect myself from this man? Can i sue for defamation? We are both located in poland and the same town She has always been a lot more mature thats why our friendship exists, i have noticed that she cuts herself and when i got further into the topic she started crying because of her father he threathens her that if she doesnt get rid of all the bad grades in school until friday he will do something to her so bad that nobody will recognize her He has told her a lot of times that she was an accident, that he will kill her one day because shes pissing him off i can list even more of situations like this if needed. He also has repeatedly hit her and her mother in the past, her mother being afraid of him hasnt done anything to stop him. During the pandemic in a tantrum he broke my friends headphones and her phone which she didnt have for over a year. From the outside everything seems normal even money-wise but thats not uncommon i have looked through the internet and polish law but i am unsure if reporting everything to the police wont make anything worse... Especially since her mother can deny everything and who will believe a 13 year old girl that cant go out because of bad grades? He worked as a subcontractor out of Utah for an employer based in Wisconsin. For the 12ish years he has worked for this company, we (my mother, sibling, and me) knew my dad's boss was generally behind on paychecks. However, after his passing, we knew he had a job he had partially completed and his boss said he would pay him for what he completed on it. We sent in the partial job about two weeks after he passed and have waited another two or so weeks for payment. After reaching out multiple times and receiving nothing, my family started looking through my dad's emails sent to his boss and his boss' accountant. We have learned that there are likely 2-3+ paychecks my dad has yet to receive. After reaching out, his boss initially said he had no information because he didn't track the pay since my dad was a subcontractor. Later, he let us know he did have a few paychecks he needed to send to us. We have now started going through and have found multiple jobs my dad was never paid for, some appearing to be from 2-3 months ago. We are beginning to go through his files and print out his payroll and attempt to compare it to his paystubs that he has held onto to see what jobs he never received payment from. After looking into some of the laws for subcontractors, it appears UT law requires payment within 30 days or interest can be added. However, with the boss being located out of state, we are wondering if anyone knows how that would work as far as getting paid in a timely manner is concerned. Can I use the photos I took at my cousin’s wedding? Posted: 30 Oct 2021 06:47 PM PDT I am currently at my cousins wedding in Atlanta, Georgia, taking photos with a camera I was given for Christmas. (Canon EOS R with a 70-200mm f/2.8 lens) it's the very end of the night and as I was taking the last few photos, the photographer that was hired to be there taps on my shoulder. She tells me that I better not post the photos I took tonight online, as she has an exclusivity clause in her contract that demands that she is the only photographer for the event. Is this something I have to follow? I don't make money from my postings online, and I am not a professional photographer in any stretch of the imagination. Would this be an interpretation of what "photographer" is? Because there are hundreds of people here, almost all of which have taking photos on their cameras and they intend to post them online. The only difference is that their photos were taken on phones and not a dedicated camera. Is there any law that demands a plaintiff apply something like that equally? And when she says not to post online, what are the boundaries for that? Is it legal if I have it saved to the cloud? What if I share it with immediate family members through something like Google photos or drop box? Finally, who would be hurt by this? Would I, the photographer be sued? Would my cousin be sued? Would they be denied their photos? What are the repercussions if I go through with this? I don't care if I am hurt by my own actions. I accept the possibility that I could be taken to court, but if this would mean my cousin who I love would lose the photos of the most important day of his life, I wouldn't mess with it. So originally we were going to buy the house but my aunt kept raising and lowering the prices so she eventually was playing with us and decided to not move forward and hand us eviction papers due January 26th. Now since I have to move all of our stuff out I started moving into my Brother's house I decided to turn off the electric and Gas since we are about a month or 2 away from moving all my things out . Since I didn't want to be locked in for the gas or electric for another cycle I decided to turn it off because why would I pay for it when I'm almost done. Now my aunt has housing visits during the weekends and she tells me that it's a liability hazard to turn off the electric and Gas and if I don't turn it on she'll change the locks to the door Can she do this even tho I have an extra 1-2 months of my eviction notice ?
