He does not live there and we do not have a working thermostat or access to a working thermostat. The temp in our apartment is below the legal limit about 95% of the time and when we ask him to come turn it up, he tells us "No" followed by condescending comments such as "just put on a sweatshirt". So, after several attempts with nothing being done (along with other health and safety issues) we called the town inspector to come and see what goes on. He took his readings as promised and also told us that our landlord doesn't have a permit for our apartment. Our lease also does not state a move out date on it. Child heard his voice but never saw his face. When my child told this man they were getting their parents he deleted the chat history and it cleared on our child's computer as well. but his username is still active. Ive already brought the computer to the police and filed a report. Local police dont have the budget/ dont care enough to be a real help. Since I have moved in, one particular parking enforcement officer has made a habit of trying to ticket cars parked on my street. Here is the relevant law. 7.05.03. - Continuous parking in same location. No person who is the owner, agent, operator or other person in charge of any vehicle shall permit said vehicle to remain parked, standing or abandoned upon any street for a continuous period longer than 24 hours. This section shall not be construed as affecting any other parking regulation now in effect or that hereafter may become effective but shall be construed as additional parking limitation. The purpose of this section is to prohibit the continuous longtime parking and the storage of vehicles on the streets of the city. This is a very broad law and is obviously not enforced on every single street, mostly just the ones near downtown. They used to draw a chalk mark on your tire to check, but some time ago a law was passed stating that was illegal so they resorted to drawing a chalk mark on the ground at the base of the tire. Where the issue began is my street USED to have a small goverment office in it years ago, and so they used to be strict on parking, this office hasn't been open in years and is now totally residential, but this one particular parking officer still comes by and marks cars. My roommate 3 different times got ticketed falsely because they would park too close so a chalk mark left for another car, or left for work and parked in the same spot on the street later. I started talking to neighbors and found out that she was even going after an older couple up the street who have no driveway and have to park on the street. Now they are forced to leave their home and move the car every day just so they dont get blasted with fines. I think this is wrong, but I'm not here to talk about morals because I know the law doesn't care. I just wanted to provide some backstory as to what I was about to do. I started erasing the chalk lines on our street after she would come by. Just a little water and a rag and I'd go up the street and erase them all. This actually has gone on for almost 2 years now. She would come by and Id erase everything. Idk what changed but I guess one day she sat and waited somewhere and got a picture of me doing this. I only found out when I was stopped by a police officer while walking home one day and questioned about it. He took my ID and said that I should be expecting paperwork, which Im guessing is gonna be a summons for a court date. So Im guessing ill be charged with Interfering in a Police Investigation, but that is a broad charge with broad penalties. How do I verify that my mother's irrevocable trust was properly funded? Posted: 04 Feb 2021 08:43 AM PST (California) My mother passed away a few years ago, and shortly after that I received a copy of my family's trust. My stepbrother and I are the only two beneficiaries of the trust. The trust is an A/B trust, which was usually used for blended families to help minimize estate taxes. Once one spouse dies, half of the assets of the trust are moved to an irrevocable trust, where they are held until the other spouse dies. Their trust specifically splits all assets 50/50 between my stepbrother and me. Sometime between her death and the middle of 2019, my stepfather decided that I didn't deserve my part of the trust, claiming that the employees at his small business deserve it more than me. His son (my stepbrother) is the manager of the business, and I have a feeling they discussed this. The last time I spoke with my stepfather (and stepbrother), he told me that he explored ways of dissolving the trust in order to cut me out of it. During that same conversation, he tried to bribe me with a payout that would help my new business (which would have amounted to about 3% of the trust's assets). In the discussions I had with my mother prior to her death, she warned me that they might try to do something like this and told me that she later verified with the attorney that the irrevocable part of the trust could not be changed after she died. I've spent some time reading up on California's trust laws, and I don't see a way for my stepfather to actually break the trust, including trying to "decant" the current trust into another trust (which was something he told me he would try to do). My concern is that he will try to find a way to drain the assets out of the irrevocable side of the trust. Is there any way to determine if/how the irrevocable side of the trust was properly funded? I've considered asking for a trust accounting, but since my stepfather is currently both the surviving settlor and the trustee, he is not obliged to provide that (per the terms of the trust). He never had a lease but paid rent on a monthly basis. He recently met a girl last year and they started living together in the unit. Unfortunately, he was recently hospitalized around Christmas. He's fine now but isn't planning on coming back and his family has moved all of his belongings out of the unit. The problem is that his "girlfriend", that he just met 1-2 months before his accident, doesn't want to move out. At this point, they aren't even together anymore. So now the original tenant is gone, a complete stranger is living in the unit, and she hasn't paid a month of rent yet. To make matters worse, I have reason to believe that she's a heroin addict and I'm afraid that she might be prostituting herself from the unit to support her addiction. We're dealing with an upset teacher, and a 12yo boy. Music teacher brings in a french horn (his personal property) for the children to play. When they were dismissed, my son knocked over the french horn and stand it was on, and tripped on it damaging it. According to the teacher, he's told the kids that they aren't supposed to be exiting "up front". He said my son was in a hurry to get out, and was careless. I do believe that is a probably true. What I'm not sure is, when bringing your own personal property into an area for use by children, do you carry no risk to accidents such as this? Certainly my son can do a better job listening, and I don't claim 0 responsibility. I'm just looking for what is fair. To clear one thing up, myself and the two people I consider my friends are rather well off financially; the mutual friend isn't so much. So anyways, I lost control and I hit a pole. I don't remember much due to shock and I don't have a good memory anyways; but I was dead sober and I was going 40-45 in a 35 -- no faster. Everyone had seatbelts on except for our mutual friend. The mutual friend was drinking and smoking pot as well, and he has a legal record. My friends were totally fine, and I had a not too bad concussion.. BUT the mutual friend (was sitting in the back seat) wasn't wearing his seatbelt and he suffered pretty bad injuries. He has to wear an eye patch, he suffered some other head injuries, and he ran up the hospital bill and it exceeded my insurance so some came out of pocket. *I PAID HIS MEDICAL BILLS HE DIDN'T PAY SHIT AND IF HE WOULD'VE WORN A FUCKING SEATBELT HE WOULD'VE BEEN 100% OKAY* So now, I hear he's trying to claim I was drinking, road-raging(?), and he claims I was smoking pot too. My toxicology report came back clean for everything. He now has a lawyer and is trying to sue. Will I likely have to pay more than I already did? Key part, and I can't prove this but I requested when I first picked them up that they wear seatbelts. I'm pissed because it's 100% on him that he got severely injured and he's trying to do some slimy shit. When we went in, we didn't have any financing prepared, but she told the finance person she would prefer to use our local credit union (bank A). After a while of waiting we were told that Bank A wouldn't give her a loan for the car, but their preferred lender (Bank B) would give her a loan. The interest rate on bank b's loan was about 15%, but we needed to get her a new car quickly so she decided to take it. Well, then a few days ago my fiancé applied for a credit card through Bank A. They called her the next day and while going through the info on the credit card application, the subject of her "denied" application for a loan on her car came up. The person on the phone told her that they had in fact approved her for that loan, and at an interest rate of 4%. So now she is refinancing it so everything can be through Bank A. Today she got a call from Bank A again asking her to confirm that the dealership did actually tell her that she was denied for a loan through them, which they did, so she confirmed it, and the person said something about reporting it to the "higher ups". Is there any way to sue my workplace for not enforcing mask rules? Posted: 04 Feb 2021 08:27 AM PST I live in Texas and work at a grocery store I'm not going to name for safety reasons. The government mandates that people have to wear masks in public stores and establishments for safety. We have signs that encourage people to wear masks and social distance. At the customer service desk we offer free masks to anyone who wants one. N95s and gloves are given to me every day as an employee. But if someone comes to my register without a mask, I am not allowed to say anything about it to them. We are not even allowed to politely ask if they'd like a free mask, or management will get us reprimanded. It's driving me insane. I haven't cought Covid yet that I know of, but the anxiety of seeing more and more maskless people is making me physically nauseated at work. We are told to call a manager if we feel "uncomfortable", but calling management because someone isn't wearing a mask is discouraged and frowned upon, because when given the chance even managers fail to ask these customers if they would so much as like a mask. Is there anything I can do legally to change this? At one point you can clearly see an underaged child sleeping in the bed adjacent to the one she is in. I found other videos of hers and it is very clearly not an environment a child should be around, yet I've seen the same kid sleeping in the background of other videos of her. In all of them it is her having hardcore sex and filming it next to her sleeping child. If the details of the video are important I'll tell you guys I don't feel like it is so I'd rather keep it out. Posted: 04 Feb 2021 02:43 PM PST Around the beginning of the school year, we received a notice in the mail that our 15 year old son had been referred to a nutritionist from an outside company contracted by the school district, according to the notice because his weight and height suggested he was at a high risk of long-term medical complications due to his obesity. This notice also stated that these services were not free, and that all participation was optional. At the time we were confused, as our son is not overweight or obese (he is five foot ten and 145ishlbs as of August), but not overly worried as obviously we would decline services. We also reached out to the school as indicated and stated we were not interested. Sure enough in October we were contacted by someone claiming to be a nutritionist with the third party company who outlined again the program and we responded politely that we were not interested, and explained that our son was a healthy, average weight active boy and that we already tried to offer healthy meals and encouraged activity/exercise when appropriate. Since then we have been receiving 4-5 calls per month from this company, most from the same individual who continues to pressure us into purchasing their services. At this point, we are tired of these calls and have told them in no uncertain terms we have no interest and want to stop receiving calls regarding it. My question is whether we have any legal recourse to stop being contacted by the company. I don't want to go this route but am at my last straw, especially as my son picked up the phone a couple times and one time as soon as the 'nutritionist' figured out who it was he went on a long rant about how he was obese and needed help to regulate his eating. New landlord hasn’t contacted us for rent Posted: 03 Feb 2021 10:47 PM PST Hi, I have a unique situation on my hands. Sometime around mid December our apartment building in Sacramento, CA was sold to a new owner. I've lived here for about 3 years and the property always been managed by the same management company (Mynd). So come January 1, I go to pay my rent online through the Mynd website per usual, but immediately realize we've been booted from the portal and can't pay rent. Mynd tells me the new owner discontinued the contract with Mynd and that the new owners would probably reach out to us about rent soon. They could not provide me any contact info for the new owners. It is now February 3rd and we have not once been contacted by the new owners nor provided any direction on how to pay rent or who to pay rent to. The bigger issue now is that we just bought a house and are moving out in 30 days so I need to provide notice to vacate. With no idea who to provide notice to, I'm at a loss for what to do here. Why these new owners don't want to collect rent money is beyond me, but I do not want to be contacted 6 months from now with some claim that I owe 6 months of rent. Not to mention, I'd like to recover my $2200 security deposit. Mynd won't provide me any contact info for the new owners. We even reached out to the selling agent realtor and she had no info for us. Background test for new job reveils unknown pety theft charge Posted: 04 Feb 2021 01:28 PM PST During the first 6 months of the covid nightmare i lost my job of 6 years in the credit dept for a major dept store. while timing sucked i knew i had a great work history and resume . while it took a little bit longer then i expected i was offered a job doing the same type of work for a different company. and started training right away even though i had to do a drug screen and a background check. which is not a problem im 47 years old and lead a normal boring life.so i did both tests and accouple days later on a Friday i get a call from the employment agency who found me that job saying that i had some sort of flag on my background check from a petty theft charge that i got from from 8/14/2020. i about fell over i have never stolen anything much less get a charge. thinking that the company had made some sort of mistake i went to company and filed a complaint asking them to check again . they said they would but tit could take up 2 a month to get the results back . i took what info they had and went back to work. . then next day bright and early i get a call saying that the company doesn't feel that i was a good fit and. they didn't say anything abut the background check it was pretty clear. i called the police dept for info but was told i would need to speak to the officer filing the complaint and was told the she works the night shift and o call back after 10 pm. which i did and was told the she hadn't come in yet and try again in like an hour which i did only to find out the she didn't show for work. I was told try her tomorrow . so over the week i have faithfully made attempt 2 reach her but no response . on day seven the person answering the phone said that if i came in and went to the clerk window they should be able to pull a copy for me. which i did only to find out after waiting in line for an hour iwas told due 2 Florida state statue does not allow me to get info on an open case even though its about me , but somehow they can give to 3rd party background check company. Again i was told to contact the officer for more detail. so so never have i gotten any response . then a week later i get another job offer this time a bigger company for more money and exactly what i was hoping for. so i start training and do the drug test and background test and don't hear anything till 3 days later, when setting up my home office to stat the work from home perk of the job. i get a call from the head of the hr dept telling me that it shows i have an active warrant for a petty theft charge and that he would be at my front door with in the hour to pick up all the computer equipment and my services were no longer wanted. . he did give me a bit more detail on the charge not only showing the date of the supposed theft but also the date the charge was filed which was a 40 days after [link] [comments] |
Building manager is stealing my rent money Posted: 04 Feb 2021 09:42 AM PST I moved into an apartment complex in July of 2020 with a section 8 voucher. I paid 2 months rent in July so I could be ahead one month. Long story short, I found out in October she is keeping my extra month and denying I even paid it. This payment reflects on the rental website and my bank account. I've given her this proof physically on paper AND I emailed it to her also. She denies getting it. She gave me a copy of her ledger and it doesn't show my extra payment. Even after showing her my proof, she still denies it. She tells me, "My (her) information is 100% correct and there are no glitches and it's perfect. You should contact the rental website (where I make my electronic payments that show on my bank account). I've been to the bank, they say it's the weirdest thing they've ever seen and its cut and dry, I paid. I've had calls with housing department. They say the same thing. Housing even called her and her reply was, "Had I had that information before this wouldn't have happened and I'll call her (me). I never received a call. I emailed the rental website. They emailed me payment history, saying yes, you have paid it. I have my rental payment history proof as well, which I already gave to her two times. This woman is outright stealing my money and after talking to my neighbor, this isn't the first time shes done this to a tenant. Should I not pay my rent and let her take me to court or take her to small claims court? Also, I don't have much money due to being on disability so I'm wondering what is the cheaper option. Posted: 03 Feb 2021 09:00 PM PST Writing this from Long Beach, CA. My dad resided in Wake Forest, North Carolina. He passed away in Grand Cayman, in the Cayman Islands. My dad unfortunately passed away January 3, 2019 while on vacation with princess cruises. He was on a cruise excursion snorkeling and drowned. My dads wife had to spend a lot of time after his death in Grand Cayman wrapping up lose ends. Long story short, she wracked up tons of money. She reached out to my siblings and I today letting us know of her intention to try and sue the cruise line and the Catamaran company. She wants to make an estate in my dads name to do this. I guess she filed a claim with the cruise line, but it was rejected due to her filing past the one year timeframe. When I questioned her on this, she stated she had time stamped correspondences of filing it the day before the 1-year anniversary but the company didn't oficially file it until the next day. She sought out numerous attorneys who refused to take the case on: 1) she filed the claim passed the due date 2) my dad had signed a waiver prior to snorkeling acknowledging the risk of bodily harm or death. However, she found one attorney willing to take the case stating she can have my dads estate sue claiming neglegence, hence why she wants to start an estate. I obviously worry this will be denied. The coroner inquest found his death accidental already. She also wants to make herself head of the state, but needs mine and my siblings signatures to do so. She did say she will be willing to have one of us be the head of the state as well. I have several reservations. I don't know if it is worth it. Most of the witness accounts sound like he said she said. There was 69 people total on this excursion. His wife states all three employees on duty were on the cataraman at the time. It wasn't until on employee spotted my dad in the distance, about a hundred yards away, that someone jumped in the water. however, the gentleman who reached my dad first stated he was in the water already. The captain also stated my dad was outside the recommended area and that he disobeyed instruction. Everything seems so unclear. Posted: 04 Feb 2021 01:46 PM PST Using a throwaway account. I signed a lease in June 2019 for a 3-bed San Francisco apartment with 2 of my friends. We did not have a formal housemate agreement (lesson learned). My housemates sent me their share of the security deposit, and I paid that in full using a cashier's check (not sure if it matters that I'm the original payer). Landlord agreed to put us on month to month when our lease came up for renewal in June 2020. He is generally unresponsive and didn't provide a formal document for this despite us asking, but I have text message confirmations as evidence. I gave a 30 day notice on August 01 and sent that via email, text, and certified letter to the landlord and notified my housemates via a phone call and text message. I paid my share of rent for the entire month of August and moved out early in the month and mailed back the key to the landlord. At this time, I repeatedly asked him about the security deposit and he said he would return it to all housemates when the apartment is fully vacant. He also didn't provide an inspection for my room at this time. Fast forward to December and I asked my former housemates if they are still living in the apartment. They said they are working out "internal expenses" and waiting for the deposit from the landlord. They moved out in mid-January. Now, they are saying that I owe them for things like Uber rides, dinners that we split, etc. and are trying to withhold these expenses from my security deposit. In other words, instead of sharing exactly what deductions the landlord made, if any, the housemates put together a doc of what I "owe" them and have basically admitted that they have my deposit and are withholding it until I confirm their expenses so that they'll reimburse me for the difference. Note: we all took turns paying for dinners, social activities, etc. and there are plenty of these type of expenses that I did not charge them for. Regardless, my understanding is that the security deposit should only be impacted by any itemized deductions from the landlord for the apartment itself. It basically restrained me from working for a company that was in direct/indirect competition with all the companies owned by the same person I used to work for within certain counties. I just recently accepted an offer from a company that pays a significant amount more in a different sector. However, this company appears to have a branch (that I will not be working in) that is of a similar type as one of the other companies (that I did not work for) that my former boss owned. I don't think that I have any trade secrets, as all I really did was call contractors and collect invoices, as well as keep track of a budget. I was paid $20/hr while I was there, and was subjected to bullying behavior by my boss throughout the entire 9 months I worked there. It was honestly a nightmare. Now I am worried about my ability to work at this new job, but have heard that unless it is proven that you are actively causing harm to your former employer, that non-competes are extremely difficult to win in court. He made half in 2020 of what he made in 2019. There were times we had no food or water. My cell phone was shut off long ago due to nonpayment. Needless to say, I didn't have the money to pay over $1000 in rent if I couldn't afford to buy a pack of Ramen. The only times I've paid rent was when we were given the stimulus and I had the money to pay it. My disability was denied in February 2020 and my appeal was denied in September 2020. So I have to file all over again which I am with a better lawyer. But now my landlord is asking for payment receipts for rent for the past year. I don't know if it's because they're trying to sell their units or if they've realized we haven't been paying. I told them I couldn't get the receipts because the bank account was compromised and closed. But she insists I call the bank and get the receipts. I'm scared if I can't get them we'll be evicted. I can't afford any other apartments in the area and I don't want to move away because all my doctors like my psychiatrist, orthopedic, gastro, PCP, and everything is here and I'm in the middle of applying for disability. Even though she is my mum her asking for a copy of my birth certificate makes me just as nervous as anyone else asking. I've not done citizenship in the US so I don't know what's actually needed. Not unlikely, but seems odd to me that my mum needs a copy of a divorce certificate from my dad, they don't talk and have been split up for 15 years, my dad is quite well off since their divorced too. Not that I suspect anything specific, but it makes me uncomfortable to ask my dad to give me a divorce papers for my mum. Does someone need a copy of a divorce document to apply for USA Citizenship? Ended up having my scales on me cop was SUPER cool and explained to me that I could ask for a plea of judgement for the speeding and something about a 66. . ? Dealership has not transfered title Posted: 04 Feb 2021 08:52 AM PST Goodmorning from California. My GF's son purchased a used vehicle almost a year ago now, and the dealership still has not transfered the title. Calls to the dealership at first were answered with "do not worry, were taking care of it" but they no longer answer, or respond. (Dealership is about 130 miles from us) She (gf) then turned to the lending bank, and is largely getting the same run around. Less and less responses, and always "well we're not sure what's going on, but we'll call you back..... but still keep paying us." Nobody seems to own this car, so should payments still be made? Would you guys consider this stove needing replacement? Posted: 04 Feb 2021 10:22 AM PST My apartment building is charging me $750 for a new stove / oven after moving out. We moved the last week of November and they are just now sending me pictures of the "damage." They emailed me a receipt saying they are keeping my full deposit amount at the end of Dec. and are asking me to pay an extra $100 so that they can cover the cost of replacing the oven. I asked them if they could replace the glass top of the stove and they said that that's the same price as just buying a new oven. I am in PA if that matters. It took them 2 months after moving out to send pictures. I thought this type of communication had to be done by certified mail but it had just been emails. To me the stove doesn't look all that damaged and I think because it is fully functioning that they should chock it up to normal wear and tear. [link] [comments] |
