    My 80yo father was contacted via email by a Canadian attorney with a suspended license who provided a copy of a death certificate for a "relative" who passed away a few years ago and identified my father as the inheritor of the estate. This "attorney" has multiple reviews online discussing the same scam happening to other people. He stated that my father would get 45% of the $10mil payout, the attorney would receive 45%, and the remaining 10% would go to "taxes" and "fees" on the inheritance. They have been corresponding frequently via phone and email for about two months and this "attorney" kept coming up with reasons for my father to send him money in order to release the funds (e.g. he must send $300k to prove he is not a money launderer, he must send $125k to prove his relation, etc.)

    He has sent this man over $40k that he absolutely cannot afford (and has tried to force him to empty his retirement account) and I am wondering who the proper authorities are to contact. I only discovered their correspondence while home for Thanksgiving when my father left these emails up on the family computer. My Google search directed me to the phone number for the FBI field office nearest us but I am wondering if anyone out there has any insight that could help me reach the right people to hold this man accountable. We are located in NY and the scammer is located in Toronto, Ontario, so I am unsure if local police would be the proper avenue. My father is so embarrassed and I am so devastated at what this "attorney" has done to my dad and that he has seemingly gotten away with this scam multiple times.     I was physically assaulted by one of my students and now I’ve been subpoenaed to appear as a witness. Do I need to get a lawyer and what can I expect in the court room?

    I am a teacher in Ohio. Last year one of my (25F) 5th grade students (11M) physically assaulted me during class. He had to be restrained by three adults to keep him off of me and was taken out of the school in handcuffs. I really am not sure the legal process at all, but I think that I "pressed charges" on him. I went down to the juvenile detention center and had to fill out a statement.

    I've gotten a letter in the mail every month saying that the case has been continued until x date. Two days ago I received a letter that says the trial happened, he denied the charges, and that I am now required to come to court. I'm not sure what happens next, do I need a lawyer? And what can I expect to happen in the court room? I am very anxious about going. During the school districts expulsion hearing for the student, his dad screamed at me for about 10 minutes about how horrible I am and how I'm ruining the boy's life. The only experience with court I have is what I've seen on TV, so I have no frame of reference for what will happen.

    Bonus question: Is this a criminal, civil, or some other type of court case?

    I just found out today that my grandmother (date of death 2004) did not have a will. In Indiana.

    My uncle fraudulently transferred all of her property to himself. He and my father who died in 1999 were my grandmother's only children.

    The final deed on land was transferred Dec 1, 2010. Can I do anything at this point because probate is closed?

    I need to leave my house in 2 hours with paperwork to be the clerks office before they close.

    Am I at risk legally watching someone's kids? Can CPS tell people who called?

    I recently moved into a new house and my neighbors have several kids ages 11yrs-10months.

    I don't think they're necessarily neglecting the children, but the kids have started coming over to my house for 3+ hours a day, and once told me their parents weren't home.

    Am I at risk legally if one of their kids harms another in my home? A younger child (3M) is aggressive and tries to hit his younger brother (10months) often. I considered calling CPS when they said they were home alone, but when I first moved in the father told me that a different neighbor called CPS on him for setting off fireworks and that it did nothing because he knows all the CPS agents because he went to school with them (we live in a very small town).

    If it happens again and I call CPS, can they tell him I was the one who called? If I allow them to continue to come over while their parents aren't home, could I have any legal trouble?

    Sold a car when I was still in the military last year in Germany to another military member. Sold it as having a dead starter because that's what I thought was wrong with it, now he says it won't start because of compression issues and wants me to give him his money back.

    I definitely don't have to give this guy the money back right? I sold the car as having a dead starter to which he agreed and to my knowledge that's what I thought was wrong, I'm not a car expert. Now he's claiming it won't start because of compression issues and that I should reimburse him. I'm no longer in the military or located in Germany so I feel like I should just tell him thats not gonna happen and leave it at that.Am I in the clear here or what should I do? I'm in the US if that matters.

    My friend’s wife is threatening to show up at my job.

    I don't really know how to start this but basically my friend's wife thinks my friend and I are screwing around with each other and now she's threatening to show up at my job and kick my ass. I've been very upfront with everything and answered all her questions but she doesn't believe me (which is understandable) or her husband. She's asked for me to leave him alone and for a few days I did but he's my coworker and our jobs require us to give updates and communicate on a daily so it was inevitable that we had to resume texting. Right now, he's out of town for family matters and she's been calling me non stop for hours. They also have foster children so even if she says they're gonna try and work it out I know she can't have an criminal records on her but like...??? I don't know what to do. Should I call the cops? Do cops even handle this? She's showed up at my job already and caused a huge scene, where my manager had to get involved but I have camera footage of that. I have the text message history to prove that we were chatting as mutuals. I never hid the fact that we texted I wish he would have done the same....

    I think I'm being stalked.

    Recently a man who I don't know has been following close behind on my daily walks, trailing me in my car coming home from work, and I've seen him in front of my home twice.

    It could all be a coincidence, but I've never seen this person before and this has only been happening over the last month. I could just be paranoid, but this just feels weird, y'know? I've never interacted with him, and when I've seen him outside my home, it's not on the property but just around. I live in a townhouse with a roommate but I don't think this person has moved in.

    I really don't know what advice I'm going to receive but this whole situation has been stressing me out.

    Ageism case? Fired just before retirement

    I'm hoping to get some legal help/ recommendations for free legal aid. My father-in-law has worked for a retail giant for many years. Recently, he decided to make plans to retire by mid-2021. I've been told that he put in a formal request with managers so they knew he planned to retire. Today, he told us that he got fired for not meeting expectations.

    I've heard this story so many times but has anyone successfully tried suing their retail employer? Isn't this ageism. I would appreciate any help finding free legal aid in Massachusetts.

    [NM] Apparently, my mother owned something called a "Royalty Interest" and someone wants to buy it?

    My mother passed away a little over a year ago. We've never been in the best financial shape, so there wasn't much in terms of inheritance or any assets. Just a car and some personal affects.

    Today, I got a call from someone in Idaho who had apparently gone through the county records and saw that my mother had something called a "Royalty Interest", which I think has something to do with land? I don't exactly know what it means, but he gave me the name of the company as well as the unit and section number.

    Neither me or my brother were aware of this, and apparently it's paying yearly interest somewhere? I'm not sure if this is a legitimate thing or some sort of scam, and I just wanted to know a bit about it before I go sending emails containing personal information to what might or might not be a legitimate company.

    Does this sound like something above board? Is it likely some land speculator legitimately found my mother's name and contact information on some record somewhere and wants to buy it? Is there a way I could double-check those records without contacting the land company directly, in case it's a front?

    The interest in question is in our home county in New Mexico, and the person calling me says they're from Idaho.

    How to Handle Summons for Previous Homeowner?

    I just bought a house in West Virginia. This morning a process server came by to attempt so deliver a summons to the previous owner. I told them that they didn't own the house any more and do not reside at this address. He then tried to make me accept the summons which I refused. After I closed the door he left the summons on the door step.

    Is there anything I need to do? I want to be completely left out of this process. Can I just leave the summons on the doorstep until the wind blows it away or something? I don't want to touch it at all. Any advise will be helpful.

    I moved into an apartment without ever signing a lease and now the landlord is saying she is going to keep my $400 deposit because I don't have a lease.

    I'm in Houston Texas, and this happened this year.

    The background is that I applied for a short 3 month lease for a small studio apartment and was approved. I gave them my necessary paperwork and then payed the fees, security deposit, pet deposit, and first months rent. The security deposit was only $150 but I also had to pay a $250 pet deposit. This $250 was refundable on top of a non-refundable $250 pet fee.

    After I handed her the check she handed me the keys, and it wasn't until the next day that she emailed me the lease to sign but the lease she sent was for 4 months. I sent a few emails saying that she sent the wrong lease and to please send me a corrected one to sign, but no one in the leasing office ever replied. I also tried calling, but no one ever answered. The front office is also closed and locked because of COVID, so I gave up and lived there without ever signing a lease. They never contacted after that.

    In October, after 3 months, I tried emailing them again so that I could move out, but again they wouldn't reply or answer my calls. At this point I didn't know what to do, so I decided to stay for an extra month since their automated system said I had a 4 month lease anyway. Starting a few weeks ago though, I started emailing them again telling them I was going to move out and asking about the possibility of transferring to a larger apartment, but again no replies.

    At this point I had never received more than a few automated messages from them saying the hot water would be off for a day or two. I'll also say that though I'm in my 30s, I've only ever rented from landlords I've dealt with in person, so until a few weeks ago I had no idea you needed to mail a move-out notice. On top of this, without any notice their automated system was saying that next month's rent was a month-to-month rate of $2000! This is a 515 square foot apartment, and my current rate is around $950, which I was already overpaying for because of the short lease (the normal rate is $750). Because of all of this, I had been frantically trying to get a hold of them since last Monday, but unsurprisingly still without any replies or answered calls. I figured I legally couldn't be held to 2 months of $2k, but I didn't want to deal with going to court.

    This all ends with today as I load up the rest of the few things into my car and finish vacuuming. I had sent an email this morning, but now I go to the leasing office and waited outside with a printed move-out notice. First, I tried to open the door but it's locked and the lights are off. Next, I spent 5 minutes calling the number on the door, but I got no answer and no voicemail. It just rang and no one answered like usual. Finally, I just sat there and knocked on the glass for at least a minute and a woman finally walks out of a back room and opens the door to tell me they are closed, but I quickly show her my move-out notice and explain that I'm moving out and that I never mailed move-out notice. She says she saw my email that morning but she was busy, and that it's on my lease that I'll have to pay 2 months rent but I quickly explain that I never signed a lease. She just stares at me for a few seconds and then tells me to wait and closes the door. 10 minutes later she comes out pissed off and says just to turn over the keys before tomorrow and that I don't owe anything. So far I feel like I'm in crazy town. This is a decent sized apartment complex, but it all has been completely unprofessional.

    Now for my questions, first she wouldn't give me a receipt for the keys and she said she wouldn't go on a final walk-through because of COVID. I took a picture of me giving her the keys and 100 pictures of the apartment, but I'm not sure what else to do for that. What else should I have done? Second, in Texas I know legally I owe 1 months rent at my current rate for not giving proper notice. Should I just accept that I don't have to pay the $950 and forget my deposit, or should I wait 30 days and then take her to small claims? Verbally, she already said I didn't owe her anything for not giving notice, but I'm not sure if she could press me for it later. I'm not sure I buy her excuse of "I don't have to give it back because you don't have a lease" though.

    Received Notice of Mechanic's Lien

    We contracted a company to do renovations for our NYC apartment and despite not finishing the work according to our agreement and burdening us with delays that cost us over $10,000 in late fees from the building management, they declared the job done in the beginning of March and left the worksite.

    We paid $100,000 of the $130,000 contracted, but we insisted that they had to come back to finish the job and signoffs in order to receive the remaining $30,000. They ignored us and we had to bring on another contractor to supersede them and finish the job and signoffs in June.

    Now we received a Notice of Mechanic's Lien claiming that they were performing work up until the end of July. What should we do? Note that I have documentation from my apartment's management company that early March was the last time they were physically in the building and documentation from the Department of Buildings that our contractor changed in June.

    (I think this falls under Real Estate Law, I'm not sure.)

    For starters, I feel like an IDIOT and will never be helping anyone out like this ever again. I've known this guy for years and he had a bunch of unfortunate things happen to him in a short amount of time, one of them being his car being involved in a hit and run. I had a spare vehicle and he asked if he could make payments on it. We agreed at $4500 at payments of $100/mo until he was able to pay more. He missed several months. 13 out of 26 to be exact and now That I told him I was going to take the vehicle, he's saying it's in the impound. He now won't answer any of my texts or calls. This is in St. Louis and I Moved to Texas a few months ago. The title is still in my name and possession.

    How do I obtain money after winning a Small Claims by Default Judgement?

    Hello all,

    I recently won a small claims case by default judgement. The case was for my $1200 security deposit that my landlord never returned. I live in Florida.

    I "won" last week, and am now trying to see how I can receive that money... hopefully by this year (I moved out beginning of 2020).

    Any advice would be extremely appreciated! This is the first time I am having to deal with something like this. Would it be wise to call/email/write the landlord and ask how/when they plan on distributing my money? I also know about putting a lien on landlord's property or garnishing wages but am not sure which to do.

    Driver caused an accident and lied on police report, but I have dashcam footage.

    On Thanksgiving night I was involved in a car accident in MA. I had no injuries but my airbags did deploy and my car may be a loss. I received a copy of the police report and the other driver's statement mentioned that he came to a complete stop at a stop sign with blinking red lights, then entered my path which caused the collision (I had blinking yellow lights and travelled slowly through the intersection). I have a dashcam showing he made no attempt to stop. Between the police report and the vehicle accident form that he has to fill out where he may claim the same, I'd like to know who I should send the footage to, maybe the RMV? I'm waiting to hear back from the reporting officer to see if he wants a copy and I already sent footage to my insurance. This may be along the lines of petty revenge but I believe in accountability if this person chooses to lie on a police report and commit perjury on his accident form which must be submitted to the RMV.

    My son is going to court tomorrow. We hired a lawyer at the beginning of his case. The lawyer filed a motion of discovery and that is the last we heard from the lawyer. We don't know what the discovery says. We have court in the morning and we have not heard from our lawyer. We have called and texted and emailed. We get messages like, I will call you Wednesday but then no call. We got a message saying we would get a call today. No call. Tomorrow is court. What do we do? I can't hire a new lawyer between now and tomorrow morning. What do we say in court? We are beside ourselves.

    Won a default judgement in small claims court, defendant now trying to get judgement vacated

    Location: Washington state

    Other relevant locations: mom died in Washington, I live in the same county an her. My brother lives in Georgia.

    Sorry for any formatting/spelling issues. I'm on mobile. Our mom died back in January 2020. I was/am the executor. I excuted the will and a supplemental letter to the letter. She had it set up that all her investments were transfer on death (TOD) 50/50, so they didn't go through probate, but they were still included in the accounting of her estate.

    When we met with her financial advisor, he recommended that we both take 15k from our TOD shares and deposit it into the estate account to pay off any and all estate expenses. We agreed. I wasn't going to do it until he did because I don't trust my brother at all.

    When he gets back to GA, I don't know if he has 2nd thoughts or his wife talks him out of it or what happens, but he texts me that he won't be depositing the money. And to send him the bills. He will pay his half.

    I end up paying as much of the estate expenses and debts as I can with the money she had remaining, her last check, and her final bonus check. There was about $4400 outstanding. I paid it and took him to small claims court for half the amount since half should be my responsibility.

    I've kept all receipts and bank statements from the estate account.

    I filed and had him served. He contacted the court saying that since he wasn't a resident, he couldn't be sued in the state of Washington. What I found is RCW 3.66.040, line 6 that takes about a civil action against a non resident.

    Anyways, he no shows to court and I am awarded a default judgement. I send him a letter asking him to acknowledge that he lost and has a judgement against him. 10 days later, I receive a letter in the mail from the court "Notice of Civil Hearing". I call the court, the clerk tells me that he called and asked for the judgement to be vacated.

    Now we have a civil hearing. I'm definitely showing up, I already have the day off of work. Any additional insight or advice would be appreciated.

    My landlady is splitting the utility bills for the whole building evenly between three apartments.

    So I live in an old house that was renovated into three apartments. There's nothing in the lease that specifically said how utilities would be split up, but I assumed that since we have apartment numbers and no access to the other apartments, the utilities would be measured for each apartment and calculated that way.

    But today I found out that's not the case. My roommate and I haven't used the heat at all this month but the gas bill was over $200. We have the smallest apartment by FAR, so we knew something was up. We asked for a copy of the bill and found out that she just splits it evenly between the three units.

    Is this legal? I'm not sure if the fact that this wasn't specified in the lease is a good thing or a bad thing in this case.

    At what point does it become harassment/stalking?

    In a nutshell - broke up with my ex 3 years ago. Since then, he has been consistently verbally abusive to me via phone, email, social media, etc. I have blocked him on nearly every platform and haven responded to a single communication in about 2 years. However.... he keeps finding a way through. For example, my phone company only allows 90-days block at a time. Without fail, on Day 91, I've got multiple abusive messages waiting for me.

    My question is, how can I get this to stop in the least invasive way possible? I have already had a lawyer send a cease and desist letter about 2 years ago which didn't seem to have much effect.

    Should I hire a personal injury attorney? (Hit from behind)

    I was sitting at a red light the other day and someone can up behind me and slammed into me. Im pretty sure they were on there phone but I have no proof. I'm wondering if its worth hiring an attorney or try and handle it myself. The insurance company already sent me a lowball offer but I declined. The driver already claimed fault. A bit of info for you..

    • Car repair costs: 5k
    • Been to the doctors twice, referred to PT for lumbar sprain. Was also prescribed medication
    • Had to miss a few days of work for pain and appointments
    • And a number of other variables that go with pain and suffering

    What should I do? And if I shouldn't hire someone how should I go about it on my own. (Any advice is much appreciated) Thanks for helping ._. (L:Texas)

    Texas - Medical provider under new ownership, wont reimburse me monies owed

    Hi. In January, I had a sleep study done through a sleep clinic. I paid just under $600. I have since learned and confirmed through insurance that they paid for that procedure in full, and I should be refunded that amount I paid to the provider.

    Well, since finding out about what should be a large credit to my account and contacting the company, it seems that they have changed ownership. The new management is refusing to pay out the debts/reimbursements of the old owner, and has "requested" that the old owner cut me a check for the amount owed. It has been almost two months, and I have nothing to show (read as the old owner is not agreeing to pay, yet). The new management will not provide me with contact information for the old owner.

    What should I do? TIA

    [TX] Update: Dentist office decides to charge more a year later

    Still spinning my wheels. Dentist office sent another bill of the same amount ($260) for work done October 2019, claiming my insurance didn't cover that amount. This is after I paid what they said was the copay on that visit last year, and almost a year of radio silence.

    I've requested itemized bills mailed with codes of what services they claim the insurance didn't cover, which they have not submitted, or anything more than just weird threats of reporting this as debt owed. My insurance company told me to not pay this bill until I get an itemized list.

    This doesn't sound legal, that a dentist can charge one price, mess up their insurance filings, and then decide you owe more a year later. Should I consult my attorney? I don't use credit, but I have been debt free my entire life.
