By the end of July I expected to receive my security deposit..I didn't. I called the apartment complex and spoke to them several times which they were always "working on it". Finally one of the leasing managers gave me a number to call corporate as she said that's who deals with the returns. I called "corporate" which came directly to a lady who, again, gave me the runaround. Always making promises to call me right back, which after a few days I had to call her back. I finally received my security deposit early October and promptly deposited it. I now look at my bank statement to find that the check has bounced and I have been charged a fee. What should I do? The security deposit is small (under $200) but I am a single parent and that money would be very helpful. I'm trying to avoid court. Edit: I live in Georgia [link] [comments] |

Her husband has invited his girlfriend and her kids to live with him. He is now seeking a divorce so he can marry his girlfriend. He is going after full custody of the kids. My sister is newly disabled with a spinal chord injury and is in the process of being medically discharged from the military. Trying to keep this as anonymous as I can. They live in different states across the US from each other. My sister's lawyers say he has the upper hand at getting the kids. He lives in Florida and she lives in Montana. I have watch this man take literally everything from her. Please. If there is absolutely anything that will help my sister I would appreciate any advice and or resources. My heart is broken for her. He admitted the dogs he has are not his but is saying the dogs we currently have are not his either. Sounds like negligence on behalf of the clinic to me. So yesterday my French Bulldog had a litter of 6 puppies and as exciting as it sounds it turned out to be a nightmare of a night. My wife and I breed full bred AKC Frenchies as a side job. We both throughly enjoy it. From the time they're born till the time the find their furever home these puppies are cared for with the most amount of love possible. Well yesterday our female (Pua) gave birth to a litter of 6 pups and something happened at they clinic we were at and they some how managed to give her puppies away to someone else. We tried getting them back from the person who now has possession of the pups but he doesn't want to give them back to us. These dogs are of unique color and have a price range of about $5,000 each. My question is do I pursue legal action against the clinic the person who now has our pups or both. I immediately let the landlord know and they assured me it would get fixed. Since then I have reached out many many times through email and phone calls informing them the situation is getting worse and them saying it will get fixed. The wall and ceiling are suffering water damage and black mold is growing. Again, this is in the bedroom, where I sleep! I have googled some of my options and my preference is to refuse paying rent until the problem is fixed. I'm just worried that I don't know what all that in tails and I'm scared to get evicted. In Nevada for legal purposes. I had a roommate apply, and declined other applications, she signed a 9 month lease with the landlord that I am also on. she moved her stuff in immediately but never moved herself in. She complained the extra room smelled, so we had the carpet cleaned. Then 6 weeks in, mid september, she said she's going to travel the world, and via text said " I'll help you find a roommate and make sure you don't miss out on rent" She referred a single person my way, and when I asked her to help clean for showing she flipped out (i have this all in text) about why would SHE have to clean. September is what we call shoulder season here, no one wants to move here between september and december. 2 weeks after she said she would make sure I didn't miss rent, she said she would not be paying october rent and I must use her security deposit. She then disappeared and showed up last night, without warning.I came in and she said she was organizing her stuff to take it and then she was going to Tulum, Mexico for a week. I said alright, great and went to take a shower. When I came out she was gone, took the keys and garage door opener and did NOT remove her stuff. It's a LOT of stuff and makes it very hard to rent out with it there. Given that it's the last day of October, she left for a week, and she took the keys and left the stuff, I'm at my limit of frustration.At this point I'd like to recoup the rent because I keep giving her leeway (cookies) and she just keeps abusing that (asking for milk). What can I do legally? Do I need to contact the landlord or file in small claims court? Not sure how the shared lease works. TL;DR, Roommate signed 9 month lease, stopped paying rent after first month, left all of her stuff, and kept the keys and garage door opener. Unit above mine dumps urine on my window Posted: 31 Oct 2020 12:24 PM PDT I live in an apartment in Georgia. For a few months now we've heard a strange liquid sound at night. Didn't pay it any mind. 1 day my roommate left their window open and we heard the sound again. Turns out the tenant in the apartment above has been dumping urine every night out of their window which is directly above mine. Upon discovering this I contacted the apartment management. The manager inspected my window and confirmed it was urine. We went upstairs to ask the tenants above us what was going on. They confirmed that they had a new tenant subletting from them in the room. Management told the tenant to tell the subletter to stop or he would eventually evict him. The manager then had maintenance clean the outside of the window. Well a week later the urine dumping hasn't stopped. Actually as of today it's increased. We have 2 separate videos of urine being dumped from the perspective of the bedroom. The 2nd was an escalation. For the 1st time ever, it was dumped during the day. What should we do about this? Management hasn't been as helpful as I hoped they would be. I just got hired at a bar/arcade and when I asked about pay, I was told I would be making $10 an hour + cash tips. Customers have the option to tip on their credit card (which most people would given the current state) or to drop a tip in the tip jars for us to split. The manager explained that we would not be receiving any of the credit card tips because they would all go back into payroll in order to keep our "high hourly rate" (which in NC, is definitely NOT a high hourly rate). Is this legal? Can they withhold our credit card tips for the company even though we (the employees) clearly earned them? [link] [comments] |
Billing Issues Doctor's Office IL, USA Posted: 31 Oct 2020 06:53 AM PDT I have a child that is receiving services for a disability (speech). I'm on Medicaid, received pre-authorization for services, and the office completely dropped the ball on billing. They haven't been using the correct billing codes. Their office coordinator called me and wanted me to resolve all of this, but when I called the company that works through Medicaid I learned that as the parent/patient, I am NOT supposed to have to essentially do that coordinator's job, due to it being unethical and pretty much impossible. I've done my part re: pre-authorization, the rest is up to them. We have had weeks of services at this point that have not been billed correctly, and I had no clue at all until recently. The office coordinator told me that she had called in multiple times, and had sent in a claim, and I learned that that was a lie- there have been no calls, no nothing to Medicaid. In the meantime, I contact the director, and let the director know what's going on because at this point, I don't trust the coordinator. I don't care if she's inept or dishonest, I just don't trust her. The director proceeds to make excuses for her coordinator, that she's new and made a mistake, then says this is why doesn't normally take Medicaid cases, and that typically parents are far more helpful than I have been and that they get the information the office needs. This is all over email. I'm not really sure how the hell that's supposed to happen, when I specifically asked for which codes were needed and was informed that 1) its unethical to get a parent to ask that, and 2) the parent is not going to get an answer anyway. I let them know that until this is figured out, I'm not going to send my kid for services. The office is repeatedly telling me that I will have to pay for what Medicaid doesn't cover, but Medicaid is saying that its the responsibility of the office to bill correctly. The Doctor's Office is refusing to leave messages (they claimed in a text that they weren't sure it was my phone, when they've left messages before...also why are they texting me to say they aren't sure that its my phone? That is 100% a lie.) and at this point I'm half expecting them to terminate all services abruptly and say they no longer take Medicaid patients, which means I have to find a new doctor for speech. How do I protect myself from them coming after me for the billing? Also if they do just drop me over this, is it considered patient abandonment (not sure since my kid won't die if they don't have speech therapy, but this is extremely detrimental to them). After a month of no one (multiple friends) hearing from him I decided to contact his brother there has been other efforts as well and we all get the same response of he's ok and he'll get back to us. Sorry if this is a bit all over the place. I'm worried and I don't know what to think. He is the most outgoing person I know and literally everyone is concerned any advice would be great. So here are the facts that have made me suspicious: . Last time anyone I've been able to get a hold of him was September 26. He also called me that day and was upset and told me he'll be taking a step back from everything for a while after dropping out of school. He was very nervous and hadn't told his parents. . His phone is disconnected and his sisters phone has also been disconnected. . A few months ago one of his family members found out he was gay and he comes from a country where people are often killed by others or imprisoned by the government for being gay. Nigeria . One of his friends told me that he was told by the brother that he was in the hospital. They decided to call 5 hospitals in the area and couldn't find anything. . His brother seems to be dodging my questions. text between his brother and I. today was the first day I contacted him. I called him and he told me he was ok. When I asked if I can see him on video chat he told me he was at the grocery store and would call me after. I didn't get the call back and texted him instead. He didn't claim it was a family affair until I asked. . Apparently a friend of his attempted to do a wellness check on him and was greeted by the brother that wouldn't let him in. . Today I had the sheriff do a welfare check on him. There was no answer at the door and of course they call the brother and he tells them he's fine. And I'm told if the family wants to disclose they will. So my question is what should I do next? Is he in rehab? Has something happened to him? Should I higher a private investigator? Since he was coming to live with in Atlanta Georgia, we wanted to turn our half bath into a full bath with wheel chair accessibility. We hired a contractor and got schematics drawn out by a city architect in June. He was supposed to be done in mid/late August. We were told by the contractor that due to COVID the city was taking extra long to approve of inspections/permits. 2-3 weeks go by and we don't hear from them. Then they finally show up mid August to start work after inspections happen. We gave them some slack due to COVID but told them my grandfather would need to move here in September so they need to be done by then we were assured that would happen.... it didn't. Flash forward, grandpa has been living here with us and struggling to move around the house. We originally set up the first floor for him to live in. It has an open floor plan and is easy for him to move around safely. However, because the bathroom has been closed due to construction, we have him living upstairs in the master bedroom. Thankfully he hasn't fallen down the stairs yet but he is prone to falling and the stairs are right outside his room. September passed and they told us again they would be done by the end of September. Didnt happen. They came a few times but kept telling us they had to wait again for inspections/permits. October comes by, they have dug up the cement floor, installed pipes, and wood foundation for the unfinished dry wall. Again they say they are waiting for the last inspection to do the drywall, install the plumbing, do the tiles, glass handicap shower, ceiling, paint, installation, and all. They tell us they will be done for sure this time by October 30. It is now the 31st and they have no written plans for completion. What can we do? Not only is this a ridiculous amount of time for a bathroom but we really need to help my grandpa. He is a very stubborn veteran and tries to do things by himself. He's already fallen in the normal bathroom and we find him sneaking up and down the stairs without telling us. It's not worth complaining to the HOA because I believe he would only escalate things. He bothers our contractor who told us to be careful because he starts these political rants and got very close to my contract and reeked of booze. The other day he dropped a Halloween decoration or something in our front courtyard. He opened the get and let himself in. The whole time his dogs were running around our property and he was stumbling around. Later that night we left to run a quick errand and one of our lights "wasn't on". He covered a porch light with a cardboard box to make our yard darker for his decorations. He also covered our iron fence with tablecloths. Our fence had just been painted the other day and he saw it being painted. I know legally he hasn't done anything wrong but what can I do to protect our property and my family. Write down every incident? We have security cams so I have pictures. He's a man in his 60s and I'm a woman in my 20s. What specifically should I be writing down? What rights do I have for him not to be on my property and at what point is it trespassing? I don't want to start a petty fight but if he falls on my property or damages it and I have to file a report I want rock solid proof he is a problematic neighbor. The bottom panel fell off on the highway on my way home and I had to be escorted by police back to the dealership because I couldn't take the car over 18mph. While there we noticed significant paint issues – the dealership even took photos of the damage and told me to bring it back the next day and they would take care of it. However, it took 2 weeks for them to fit me in and it has now been at their body shop repair for two weeks. Meanwhile, I get a call from their finance dept saying they have lost my e-signed loan paperwork. They sent me a new credit check form and (backdated) loan agreement asked me to resign. I don't want the car - there just have been too many issues with it, and the repainting has likely devalued the car. I told them to keep the car and return my down payment. They are insisting I resign as it is too late for a 'return' - even though it's been in their shop this whole time. Do I have to go through another credit check and sign a new loan agreement? But the specialist running my background check sent me an email saying I have a treason charge and they need more information. Contractors Have Meth in my Basement Posted: 31 Oct 2020 10:43 AM PDT As I am sure you have guessed from the title, a hired a contractor to re-do two really old egress window wells at my house. It went from 1 week, to 2 weeks, to a month and before I knew they had turned my basement and backyard in to their personal workshop, and coming and going as they pleased. I finally had enough and told them that if they came back to my house I would call the cops, and that I would arrange for their things to be picked up in a few days. I was packing all their stuff up and putting it near my driveway so they could just get it and get the hell out, and wouldn't you know it, I found a HUGE bag of meth and a meth pipe in my basement with their tools. I guess I am wondering what the heck do I do? I do not want to be liable for the drugs, but I am also wondering do I need to inform the police? Could this in some way help my expedite their exit and make sure I never see them again? I just don't want to get screwed over by them over this. I am in Oregon in the USA. Escalating issues with unhinged neighbor Posted: 31 Oct 2020 09:56 AM PDT Okay, sorry this is long, but I'm at my wit's end and looking for advice, and some context is necessary. To start, we are in the United States and my husband and I have been dealing with an escalating neighbor situation. Things have ramped up in the past couple of weeks, and last night took things to far. I'm looking for advice on next steps we can take. Again, I don't want to get into too much detail. This has been an escalating situation since we moved into this house just over a year ago. Things were fine at first, but as time went on, we started to distance ourselves from the neighbor because he was getting overbearing and weird. That said, we didn't feel the need to file any sort of police report against him until this summer, when he screamed at my husband and asked him if he wanted to fight. We did not provoke him, and we called the police immediately to get the incident on record. After that, things went back to normal, but over the past two-ish weeks, things have ramped up quickly. It started with us filing our first noise complaint against him (the amount of noise he was making was rattling the doors of our house and our homes are not connected). The cops came out, told him to quiet down, but then after they left, he started to scream at our house. He also sent me a weird, vaguely threatening text. I went to the actual police station the next day to file a harassment report. I even brought them printed out copies of the texts. I've spoken to several officers since, and many of them have been made aware of the situation. After this incident our neighbor is supposed to be getting fined for his behavior, and we will have a judge-only court date about it in the next few months. While our neighbor is not supposed to talk to us (or else he'll be arrested for witness intimidation), he has now called the police on US twice. The first time, our fire pit was too close to our house, so the fire department just had us put it out, move the fire pit, and told us it was no big deal. Last night seemed a tad more extreme and actually frightened me. My husband and I were spending the evening playing Until Dawn in our TV room, which is on the opposite side of the house from our neighbor. It was probably 8:30 pm-ish, and neither of us had been outside of the house since about 6:30pm. All of a sudden, though, we see what looks like a strobe light through our shutters. I open the shutters to find a cop with a flashlight peering in the window. Then there was a knock on the door. I rushed outside while my husband was getting his shoes on to see what was the matter, as I thought maybe something had happened across the street. Turns out our neighbor called the police to make a domestic violence report. He told the police that he saw a male (my husband) push a female (me) and that the male might have had a gun. This was terrifying to hear because we were inside the whole night in a room with the shutters closed just playing a video game. We don't even own a gun. If the police hadn't already known that we were having issues with the neighbor, I anticipate that the evening could have gone very differently. I'm genuinely frightened now. I don't know if I should report him for making a false report (the police already know our side of the story since we had a long convo with them yesterday evening) or if we should sue him or something. I don't know what we CAN do. This is starting to get insane, and all we want is to be left alone and to live in peace. My Father Passed Away Monday--Need Help. Posted: 31 Oct 2020 01:12 PM PDT So I live in Franklinton, North Carolina and my father lived in Wilmington, North Carolina. He passed away on Monday, and basically since there was no will, my half-brother and I have become the executors. He's been unhelpful and told me that he didn't want anything and that we could do "whatever we decide" for his burial/cremation, I had to hassle him to send in the authorization forms (he mailed them.) and it's been difficult... We cremated him on Wednesday and such. My grandmother called me and told me that since I'm handling all the proceedings, I should just have him write down that he didn't want anything and that he was fine with all decisions to avoid him suing me (I have a feeling his mom could talk him into this later down the line). My dad, a 50 yo, returned from his hunting trip with his buddies about a week ago, and he brought home a 15pt buck. This is the highest point buck he's ever gotten and he was very excited. One of his friends is friends with a local taxidermist, so my dad's friend was able to get the taxidermist to mount the deer head for my dad within about five days. (the rest of the deer was processed for meat, don't worry! no waste here.) The taxidermist in question has some bad reviews, but my dad's choice of taxidermists was too booked up to take his deer, so my dad decided to try out his buddy's friend's service. Well, when my dad went and picked up the mount, he noticed the antlers were cut and carved. The 15pt buck was shaved down to an 8pt, and it was very obvious. This wasn't what my father wanted nor agreed to when hiring said taxidermist. My dad was appalled and confronted the guy, asking how and why this happened, to which he got the response of "some of the points were too frail and broke off when he was working on it", and my dad refused to accept that as an answer, but brought the mount home anyway. According to my dad, they are not breaks, they looked carved off with a saw or drill. The taxidermist also often sells antler points for jewelery or collections and my father thinks that he took the best points to sell. After contacting the taxidermist and asking for his money back, with return of the mount, the taxidermist has denied and has blocked my father's number. He was always very secretive, but assured me that I was to inherit his house among other things. I don't live in FL, so when he passed I couldn't immediately go see him and someone else, his sister in law, got there first. Apparently she's the executor of the will, which is why I'm writing here today. When i did get to the house i found the safe, which had life insurance docs and the will in it, open and empty. AFAIK, i was the one who as supposed to open it. I asked SIL if i could see the will. She said no. I pressed and she said she didn't have it, the lawyer did. I asked if i could speak to the lawyer, she said "the lawyer isn't a probate lawyer so they don't know anything and don't want to speak to you, we need a probate lawyer". I asked if i could speak to the probate lawyer, she said they don't want to speak to me and the reading of the will in FL law doesn't happen or a year and i should wait and they will contact me when its time. That i shouldn't worry and should calm down because she's not gonna let anyone take anything from me. That i should relax because she has my best interest in mind. Now i did a little research on my own and couldn't find anything about having to wait a year just to read the will. It sounds ridiculous to me that no lawyer wants to talk to me. I also know she's lied already as she told my father he gets nothing, but revealed to me that she convinced my grandfather to include my father in the will at the last minute. Needless to say, I don't trust her. Is anything she's said actually how will/estate law works in FL? Does she actually have my best interest in mind? Car is finally towed next day and later that day Agero called twice to ask if I had me car or knew where it was. I said no. One said he would find my car and tow it to my house and cover the cost over my 15 mile allowance. He was concerned. but 2 days later a local car sales lot and body repair owner called to tell me he had my car and was preparing an estimate for body work. I said for what body work, I just need a tire, there was no accident. He said he does not sell tires. And it sat for 5 days and I had it towed to a tire place and it took them days until 13 days later I picked it up and saw my bumper pulled away and damaged. I never knew this and wondered what they were talking about but I called the tow driver and ask if he understood what happened. He said Agero told him I would sue him but he never said for what. It's now been 3 months and Agero has denied clainm for lack of evidence. I think this is an old trick to avoid liability. Yesterday I spoke with Progressive claims manager. He said it is impossible to prove the tow truck driver damaged my car. The test seems to be anyone having their car towed must have photos of their car at the time it is being towed. Not from the day before. Progressive isn't interested in finding evidence. I did not have full coverage, only liability. But I did elect roadside assistance and paid for it in my Progressive premium and Agero is whose help I received. Where is the angle to overcome this excuse to avoid liability by requiring I take a pic as it is towed? As one of the first responses below stated, " There is no way to prove that the tow did the damage. It could have occurred after you abandoned the car and prior to it being towed. " I left the car after 4 hours as it had stopped running and it was over 90 outside. It was 40 miles from my house. Maybe no guarantee but Agero promises to respond within 60-90 minutes. I elected this coverage and used it and followed instructions until I had no choice but to "abandon" my car for my own survival. Is that when I transferred all liability from the tow driver away and if he won't take responsibility for my car he just denies any damage he caused? And he tows it to where Agero orders and that person doesn't do what I called for help with, a tire replacement. He on his own is going to do body work and not replace a flat tire. Changing a Power of Attorney after it's notarized Posted: 31 Oct 2020 10:03 AM PDT In Texas, a Power of Attorney allows the principal to grant certain powers to the agent by initialing the line in front of the power they are granting. It's assumed, I think, that no initial means the power is not granted even if it's not crossed out. My sibling has a durable POA and the original did not have my mom's initials to grant any powers … several months later the POA now has her initials on each line granting all powers. It's also clear on the official copies of the POA (with COPY stamped in red) that the initials are in ink. Mom is losing her memory and she doesn't remember adding her initials. I have concerns about possible financial exploitation and wonder if this is a red flag. Is it legal if the principal initials a line or all lines to grant a power after the POA is notarized? My brother-in-law wants to move back into his house, but his tenants won't leave. Posted: 31 Oct 2020 08:47 AM PDT 6 years ago my brother in law began renting out his house to a family he knew. There was no official lease agreement made at the time (they were well acquainted and had a good tenant/landlord relationship through 6 years), with the understanding that he would eventually return and move back in to his house. 3 months ago today (31 July 2020), via text message, he told the tenants that he would be moving back into his home at the end of October (31 Oct 2020). After 3 months of very little communication from the tenants, on Wednesday 28 Oct 2020, they sent a message to my brother in law stating they had not found a new residence and would not be leaving the premises until they did. My brother in law's girlfriend had sent them multiple ads for available apartments that met their needs with availability prior to the 31st, but they didn't accept any of these. My brother-in-law has already changed utilities back into his name as he had no notice that they wouldn't be moving out on the agreed upon date. Are there any options available that would allow him to reclaim his home as soon as possible? Or is the only option to "Officially" submit an eviction notice and wait for the required period? Posted: 31 Oct 2020 01:28 PM PDT Every month I pay my paypal credit "minimum payment to avoid interest". On October, the following happened: 16th - I paid my paypal credit card; I tried calling Paypal, they told me they can't see anything and told me to call Synchrony bank. I called synchrony and they can't tell me the reason why the transaction was declined or when. They told me the only thing they can do is remove the $28 late fee. They also said I can try to open a dispute and prove them that my bank didn't reject the transaction. I called my bank and they told me neither Paypal nor Synchrony tried to withdraw from my account and the only way to prove that is sending Synchrony my entire bank statement (which they don't recommend). One last thing I noticed is that in the Paypal credit website it shows different dates and owed amounts in the transactions tab, payments tab, and the October statement. I'm not sure what to do. This is been a horrible experience so far and I feel that since they only posted the rejection on the 29th (10 days after the due date) I shouldn't have to pay the interest or late fee.
