Car Insurance changing their claim decision after 2 months

    Posted: 01 Aug 2018 09:02 PM PDT

This is what happened to a friend of mine in NJ -

    The event -
He was driving on the interstate in stop and go traffic around 35 miles an hour, when the car in front of him suddenly puts the brakes on, and he puts the brakes on and stops in time without hitting the car in front. The car behind him does not stop in time and rear-ends his car, which pushes his car in to the car in front. So now the first car in the chain has rear damage, my friend's car is totalled from the front because of the impact that the car behind him hit him, and pushed him forward. So my friend's car is completely gone. The police arrive and note the Incident exactly as described above. The guy in the 1st car in front can barely speak any english and he drives away after talking to the police. My friend gets a ride back (his car is totaled), and the guy behind him is completely at fault, and there was just 1 impact to the 1st car, 2 impacts to my friend's car - and that is clearly noted in the police report as well. The insurance company (Geico) pays my friend the damage of his car being totaled.

Fast forward two months - Apparently the 1st guy in front must've lawyered up or what, but he goes back to my friend's insurance (Geico) and says he's had an injury. Now that is absolutely a lie because he was able to drive away - and is the first person to drive away - after the interviews at the accident scene. The police asked everyone if there were any injuries and everyone said no. The same is also noted in the police report. So anyway, given that my friend did not have collision on his car, Geico is coming back to say that he now owes half of that damage, since the 1st guy gave a deposition or statement where he says he felt two impacts (not 1 impact as described above), but two impacts - get this - 7 seconds apart! Now 7 seconds is like an eternity when the cars are close to each other going at 35 miles an hour. But that aside, so Geico is now saying my friend owes half of the damage.

    Questions -

    • 1) What are his options? Even when there are lawyers dime a dozen in NJ, most of them are injury lawyers and will only take your case where there has been an injury.

    • 2) What kind of lawyer does he need? A property lawyer, or a 'bad faith' litigation lawyer that will file a civil case against Geico?

    • 3) Is Geico just trying to take the money away after they thought that taking the 1st guy's word is beneficial for them - given that they won't have to pay for front end damages since there was no collision?

    • 4) What are his options?

    • 5) Any advice for the next steps?

Any help will be appreciated. Thanks.

Contractor screwed up a flooring job

    Posted: 01 Aug 2018 12:24 PM PDT

    Hello all,

I hired a contractor to install 2000 sqft of vinyl plank floor in my house. Within a month, dozens of planks were popping out at the seams leaving it pretty unsafe to walk around on. I had him come and attempt repairs, but even the repairs are failing. I went and got an independent flooring inspector to come out and he pretty much said this is one of the worst jobs he has seen and that the floor is a total loss. The contractor rejects the report and blames the material. Each passing day, the floor continues to fail and I am unable to let my newborn crawl on it for fear that she will get hurt.

I am in the middle of making a claim with his insurance because he did have completed operations and products liability. But the company is making it sound like I am SOL until their is actual bodily injury. Is this really the case? Would they really avoid my $15k claim now to have the possibility of a much bigger one down the road? Do I need to take the guy to court? Any advice or info would be great.

    Auto insurance question

    Posted: 01 Aug 2018 07:54 PM PDT

I rear-ended someone today and I had a question regarding how the insurance payout works. I use state farm and they gave me a list of preferred shops I could work with to get my car repaired, I just have to pay the $500 deductible.

However, I went to a non sponsored shop (collision repair shop that focuses on luxury cars and it looked reputable judging by their clientele cars) to get a general quote and they said they would get a guy from state farm to assess the damage but I wouldn't have to pay them a deductible. They also told me not to tell state farm they weren't charging me a deductible. Sound legit or should I just use a preferred shop that will cost me more?

Long Term Care Insurance Question(fun right i know stay in your seats)

    Posted: 01 Aug 2018 09:51 PM PDT

    Missouri

Hello! First thanks for taking the time to read and hopefully give me sage guidance in this issue.

I implore thee, Insurance Gods, give me wisdom. Should a 25 year old healthy individual purchase long term care insurance now so as to lock in a very low premium, or wait until they are older and more frail but risk a larger premium?

Also, is it possible to get a rate that is not variable? It would please me to see a rate that does not grow over time.

Again thank you everyone for your services.

    Holiday insurance won’t pay out

    Posted: 01 Aug 2018 04:36 AM PDT

So I recently went on holiday to Japan and got trapped in the Hiroshima floods. I was unable to leave my hotel for 5 days (people who were attempting to evacuate were literally getting killed) and as a result ended up needing to pay an extra 3 nights in my hotel as I was trapped in there; this cost me an extra £300 (it's also worth noting that all public transport out of Hiroshima was cancelled due to landslides over the train lines) My holiday insurance covers 'catastrophes' which includes floods.

As I had purchased the 'gold standard' insurance which cost me over £50 i was pretty confident I would be able to make a claim, and when I returned from my holiday I contacted them and they assured me that I am covered (via phone call) and would be able to claim my money for my accommodation and also for the food I purchased as there was an official warning for everyone to get 'emergency rations' due to food shortages. However, today I've just received an email from them declining my claim. I don't care about not being able to claim for the food, but the accommodation is important.

The reason they gave is essentially because instead of being unable to GO to planned accommodation because of flooding, I was unable to GET OUT of my current accommodation and that scenario is not covered. Their policy states:

"We will pay up to the amount shown in the Schedule of Cover & Limits for additional accommodation and transport costs incurred if You need to move to substitute accommodation on arrival or at any other time during the Trip because You cannot use Your booked accommodation as a result of the following events: 1. fire, flood, storm, explosion, landslide, avalanche, hurricane, earthquake, tsunami or volcanic eruption making Your accommodation uninhabitable"

I understand that the policy is very specific, but I wondered if anyone has any advice as to pursuing this further. Is there anything I can do/say which may persuade them to accept my claim? I really cannot afford to lose £300. Or is it hopeless?

I'm annoyed at the fact they advised me that I could claim the money back and then went back on this, but unfortunately this was over the phone so there is no evidence they said this to me.

And just the sheer concept that I purchased the best insurance and they haven't honoured their side of it really pisses me off. I don't want to just leave it because I feel so cheated! I want to say or do something to oppose it.

Could anyone give me advice? I'd really appreciate the help. £300 is a lot of money for me and I'm very worried financially.

    Thank you in advance :)

    UPDATE:

Thank you for everyone's responses, I appreciate all the help. I have sent them an email appealing it and informed them that I will be taking it further and contacting an ombudsman. Hoping for a positive outcome but I'm doubtful. Keeping my fingers crossed.

Can you negotiate an insurance pay out?

    Posted: 01 Aug 2018 04:51 PM PDT

A tractor trailer merged into me a few nights ago. The police deemed him at fault and I've been working with the trucking company's insurance. I'm in CT, they're in MA. No injuries, my car was towed while he was able to drive away. I'm just wondering how much room, if any, there is to negotiate what they'll pay me since my car is considered non repairable. I've had a lot of people tell me they'll low ball me, but I'm not sure how to go about asking for enough to replace my car with something that has similar milage and reliability, or if I just have to take what they offer. I had bare minimums on my insurance, so I'm not getting anything from them.

Co-worker victim of hit and run car crash...need to know options

    Posted: 01 Aug 2018 12:49 PM PDT

So my co-worker has had a terrible run of luck lately. A few weeks ago her car was backed into (collision A) in the parking lot at work. She just got her car back (covered under the other person's insurance) when her car was slammed into in the middle of the night at her apartment parking lot (collision B - hit and run). She was parked under a covered parking spot and her car was hit from behind and smashed into a support post in the front. The frame appears to be significantly damaged and she is waiting for the final word from the adjuster. At this point she believes her 2 year old car will be totaled.

A small complication: from collision A she is still owed reimbursement to get her permaplate paint protection re-applied (supposed to be covered under 3rd party insurance) however, she didn't get the chance to get the permaplate done before the latest accident. The 3rd party insurance company won't pay for the replaced permaplate without proof that it was applied. Obviously she can't do that now that her car is totaled.

    So questions:

    1. How can she still get reimbursed for the permaplate cost that she incurred when originally applied prior to collision A?
    2. What are her options with the hit and run totaled car? Can she still get the totaled car back to try and fix it herself or otherwise to part it out to recoup as much value out of the car as possible?
    3. Anything else she should be doing?

    Younger sibling’s insurance

    Posted: 01 Aug 2018 01:39 PM PDT

So my younger sibling just began driving and is about to start college. He's 18 and just got his license. I gave him my old Chevy Malibu because he needed a car, but looking up quotes everyone is charging around 700-1200 dollars a month for insurance! Is that normal? Are we going about it the wrong way? It just seems too expensive to insure him at this moment. Just looking for some advice as to why is it so high, is it normal, and should we just forego insurance and find a different means of transportation.

How much to request reimbursement for car seat replacement?

    Posted: 01 Aug 2018 03:44 PM PDT

Hello r/insurance- I apologize for the long post in advance. I'm looking for help on throwing out some numbers to replace my car seats. I am in Utah if that helps.

On 6/14/18 my husband was rear ended by a third party. Third party carries insurance through United Insurance Group. Got the check for repair of the vehicle on 7/20, took the car in for repair on 7/23, just got it back yesterday 7/31. Body shop knows to bill directly to the insurance for supplement on repairs- the check they gave was $400 short. Car rental is billing the insurance directly. We're all good there.

I had two car seats (originally purchased in April 2017- paid $167 total) that were in the car at the time of the accident. I went out and purchased replacements out of my own pocket the date after the accident- 6/15/18. Paid $145 for the replacements. Same brand, same type of car seats (5 point harness and booster, different model names).United declined to reimburse the purchase, citing NHTSA guidelines that they were ok. I emailed back with Utah law and a statement from the manufacturer that said using the car seats post accident is not recommended. Utah law says you have to use the seats the way the manufacturer states.

United has now changed their mind and said "we won't do a full reimbursement, we will have to take a betterment on the car seats".

The original seats were 14-15 months old at the date of loss, and expiration dates were good for 6 and 7 years. They owe me for seats with a life span of 57 months on one (6 year expiration date) and 69 months of life span (7 year expiration date) for the second seat. How much should I be asking for in terms of reimbursement?

    Need input

    Posted: 01 Aug 2018 01:22 PM PDT

Been 10 years since I was in an accident. Anyways I was coming home on the 25th of July and a driver was turning left, while I was driving straight. He tried to cut the corner too fast and we both collided (both tried to avoid one another, I used my horn). I called 911 and stated where I was, etc. Cops came, but they never even bothered to fill out a report afterwards. Fast forward, the insurance company on the driver at fault wants to claim 70 while considering me 30 at fault. Also, the driver stated it happened at a different intersection to his insurance and they tried saying I was lying. I told them I'm going to FOIA request the 911 call, and most likely the body cam. Anything else I can do?

Unresponsive Subcontractor Moved Dirt to Other Company's Property

    Posted: 01 Aug 2018 01:11 PM PDT

    Hi /r/insurance.

I work for a small general contractor firm doing commercial construction. We currently have an issue, where we have a unresponsive subcontractor (that will not respond to our calls), who have hauled excessive dirt next to a property that we don't own. That property owner recently requested that the dirt pile to be removed.

In this case, should the property owner directly contact/file claims against the subcontractor? The subcontractor owns a commercial general liability insurance. Will the insurance payout, if the subcontractor continues to be come negligent? Thanks!

Got myself in a slight dilemma

    Posted: 01 Aug 2018 06:37 PM PDT

Hey everyone, i could definitely use some advice on this situation im going through right now

So in 2016 i had a pretty brutal year for tickets. I got 8 minor tickets. (no majors thankfully though) I was young and dumb. It was definitely a learning experience for me. I thought i had gotten away with it but regardless to make a long story short, 2 years go by and someone hits my car in a parking lot. (not at fault) I file a claim to have the damage fixed and the insurance finds my tickets and cancels me.

Now even with high risk companies im looking at upwards of 1100 per month for insurance, which i definitely cant afford. I dont really want to sell my car as i still owe a decent amount on it and would probably lose a couple thousand dollars .... but one of the terms in my financing contract states i must have full coverage on the car at ALL times.

does anyone have any suggestions as to how i could get insured without it costing me an arm and a leg or having to sell my car? any advice would be very much appreciated...

(P.S. im not sure if its relevant but i live in Windsor, Ontario, Canada)

Building custom home : Do I need Umbrella Insurance?

We have already added Home and Builder's risk insurance. The agent we are working with also stated we should get an Umbrella policy.

Can someone tell me if we really need it or is just overkill on this project?

    Homeowner water flood

    Posted: 01 Aug 2018 06:09 PM PDT

Not sure if I'm at the right place, but the hose connecting from my fridge to the sink exploded the other night. I contacted our insurance ASAP and they sent contractors over that morning. The contracting company is great! However, the damage started in our kitchen, moved to the living room, and also flooded a good part of our basement.

My question is regarding our kitchen. The contractors said our whole kitchen will be demoed. What can we do for food compensation? Our contractors said they MAY be able to work around the fridge and move things around, but a our moisture in the kitchen is 45-99%. Should we push for a hotel? Or ask for grocery compensation?

Also, our house is hot as fuck right now while they are drying everything. We are basically forced to live in our bedroom. We have 2 dogs and are able to keep them in our room where it's cooler during the day. However, we can't use the kitchen sink for their water. Granted, I know we could probably fill their bowl up with water from the bathtub, but I'd like to avoid that if at all possible.

Roof Age Wrong on Policy, Insurance Won’t Change It

    Posted: 01 Aug 2018 10:09 AM PDT

When I signed the contract to purchase my home, the seller estimated the roof was 10 years old, so that is what the underwriter put on my home insurance. The owner had bought the home to flip it so they only owned it for a few months and could only guess how old the roof was.

However, right before close, the seller contacted my agent and said there was a leak and they were just going to replace the whole roof. I've learned a lot from buying this - my first house - and one of the things I should have done is gotten a paid invoice as proof they installed it, but I didn't.

My insurance still has the roof listed as being 10 years old and they won't change it until I provide either the permit (which aren't required in my township so there isn't one) or the invoice (which the seller paid and she won't respond to any of my calls or emails). They also won't let me have a roof inspection done to prove it's newer than 10 years old.

What do I do now? Seems shady they were fine with taking an estimated age of the roof at 10 years but they won't accept the email from the seller and photos proving a new roof was put on. They also won't accept a roof inspection to use that estimated age.

What kind of problems is this going to cause if there's nothing I can do to make them correct my policy and I need to make a claim?

My Detached garage sunk in one corner , splitting the concrete pad. It's leaning quite a bit now and the doors are getting tough to close.

I believe it happened a few winters ago when water made its way in after heavy snowfall/melting. Would my home owners insurance cover this?, The garage is still usable but I fear in the next year or two it wont be.

Claim process with a collision claim: get a check from insurance company to pay body shop. But also trying to keep my cost under $1500

    Posted: 01 Aug 2018 11:26 AM PDT

Last month, I had driven my car against my friend's fence, which was held by bolts. The two bolts dented and bent the front side panel of my car up to the front passenger door. The passenger door just does not open because of the metal protruding the front panel. No damage was done mechanically at all as it is all cosmetic other than the door not opening.
I had filed a claim with my car insurance company. My deductible is $500. I had talked to them how much my rates would go up after this claim and the insurance agent had mentioned that it will go up if I pass the threshold of $1000. The estimate they had given me based off the multiple photos I uploaded to them is approximately $1300. Minus my deductible, I would be well under $1000. They sent me my documentation to give to my own choice of body shop and the body would take care of the rest of the admin and paperwork if they find something after opening up my car and it will cost more.

I had brought my vehicle to my preferred body shop and the shop gave me an estimate of $1400. This body shop has near perfect 5 star reviews on yelp. They had just opened a 2nd location in the same city so it looks like they're expanding. I had asked what are the chances of additional costs or potential things found after opening my car. The shop says really small. The damage in my car was just two bolts on the side of a fence that grinded/dented on the front side of my car. I had told the body shop that I would like to keep the price under $1500 as it will not jack up my rates significantly. With the documentation from my insurance, the shop said the price will be higher if the shop used the materials and labor rates from my insurance company. Plus the insurance co will likely send out a rep to inspect the car and add additional requirements such as removing clear bra and a panel or two. So the body shop had asked me to to cash out a check with my insurance company so they would not have to be bound by their rates and they can promise me the total price will be kept under $1500. Since I had just paid off my car a few weeks ago, I now own the car outright and shouldn't have problems getting a check.

I still have two body shops to get a quote from as I need to take the vehicle in their shops. I have signed nothing yet with either the insurance company or the body shop.

I am not competent to filing a claim and dealing with a body shop doing repairs under insurance as I rarely, if ever, get into an accident. So my motive is to keep it under $1500 but my question is. What are the red flags in my situation? and what I have I done wrong?

Worse case, my insurance company decides to jack up my rates on my next term and I just go to another company.

At fault accident, filed claim with Geico. Have questions for adjusters.

    Posted: 01 Aug 2018 08:47 AM PDT

Hello. I have some questions for adjusters that I hope you can help me answer.

For context: I smashed my 18 Forester behind a small platform in a 74 Chevrolet carrying a lawnmower. My car is mildly fucked. I am at fault. I was stupid and was looking left when making a right turn, pushed the accelerator and the guy in front was still stopped.

The guy did not care to file a claim because, well.. there was no damage for him. I called cops to make sure we had some sort of report in case he changed his mind later, they came and gave us an incident number, but said they would not file a report because well, no one was injured. We exchanged info and left.

I filed a claim with Geico. Adjuster came back saying he has a 55 line item repair for front/front passenger side damage. My deductible is 1500 and the repair is estimated to be 7000. This is the damage: https://ibb.co/ifVOfe

I feel so sad for being distracted and stupid and this costing my family (household of 2) for years to come. He never had a claim before in his life. This is my first with only 2 years driving here. I know we can expect rate hikes and a loss on vehicle value. All because I was looking left when I should have been looking ahead.. and of course not pressing the accelerator if I was not paying attention.

The car is not brand new (I believe a re styled 2019 is out there now, or soon), but it was in excellent condition and had only 6K miles on it (bought Nov 2017). Adjuster event noted that there was no prior damage whatsoever in the report (no dings, no scratches. Nothing but of course the damage related to the claim: a fucked up grill, fender and right side of the hood).

    Now onto questions:

    - Is being "made whole" accouting for OEM parts to repair?

    - If so, how do I go about that with Geico?

    - I have enough money to pay out of pocket for this. Should I pay out of pocket and cancel the claim?

    - Would cancelling the claim help me avoid the insurance rate hike?

    - Is it better if I have the insurance company handling this so the repairs are done properly?

I don't want to piss anyone off here, and I know i need to be patient. And I know no one is out there to fuck me. Clearly I am darn well capable of doing it myself :( I really just want your take on this. The car has 6K miles on it and I have 2 years to go on this 0% financing. I know the car will never be the same again and will never be worth as much. God I am so fd and it is all my doing.

Any insight or help to navigate this is appreciated.

Cigna in TX now live in NC urinalysis quest and averro. Insurance paid 200.00 to each lab os this balance billing?

    Posted: 01 Aug 2018 01:01 PM PDT

Hi thank you first of all for having area for people to learn and understand. My Cigna isurance is now over due to job and state move. When I had it, I paid 600.00 per month from my paycheck. I was a patient at a out of net work doctor that I started with as self pay. Almost every visit she would ask do you have insurance I asked why (I thought they would drop me) and she explained it was routine to have a blood panel on all her patients thyroid etc. We planned to give my insurance card as soon as the enrollment and card came from my new job.

Well this Doctor was a family doctor that prescribed adhd medication to me. The other doctor (pm shift) never asked me to consent to a drug test. But It was easier to see her due to my work schedule. I asked her but did not get this in writing "I will give my urine sample to make you feel comfortable prescribing but since this is for your peace of mind and not mine I cant pay for it" she told me it was a simple marijuana test because the influx of crime or patients that would be selling or dealing drugs.

But it looked like a pregnancy strip test. Anyways I always said yes after that, afterall I had nothing to hide. I even asked her how would I get my perscription if shes waiting on labs and she laughed and brushed it off saying it wasnt going to be sent off!

I think it had to be maybe 6 times they had me give a urine sample. Well the last two is what it looks like was submitted to a averro and one to quest. Quest said this was the mercedes of urine labs that it tested for every drug under the sun. They told me this because 300.00 for a urine sample was quite high. She admitted that it took 6 months for insurance to pay out so that it was already to be sent to collections. Insurance surprisingly paid for this urinalysis once to averro 300.00 and once to quest 300.00 so total was 400.00 for each lab and they sent me the 100.00 remainder. There is class action suits against some labs doing over charging and I am lost as to what to do.

Should I call Cigna to ask about this, see if they will confirm that I am being over charged- we no longer have them as our insurance and now have aetna. I don't know what questions to ask or where to start.

In your opinion is this balance billing is it illegal in TX or NC? I just really need help.

    Thank you in advance.

Will my car insurance go up if somebody hits my car while it is parked and I am outside the vehicle?
