Not at fault Subaru claim, update #3

    Posted: 30 Jun 2018 12:41 AM PDT

Well, I've been getting lots of discouraging replies on these posts, but I figured I might as well see it through to the end.

I FINALLY got my comp cars. The $1.7k offer was made based on three cars: a coupe, a sedan, and a wagon. I specifically asked for manual wagons because I know they sell for roughly double what the sedans and wagons do.

The coupe they actually sent me was based on a one photo Craigslist ad from a city 600 miles away. Very low standards, I'd say, but nevermind that. I asked the owner for additional photos and he had rust under all the fender arches, major body damage on both sides, a mismatched hood, mismatched wheels, and blacked out blinkers for some stupid reason.

The car was a rolling pile of garbage basically. The listing was for $2300, but they added on an adjustment to $2800 because of the high mileage. There was no condition adjustment for the rust or damage.

I talked with him again about the difference between coupes and sedans and wagons and asked for him to find only the coupes. He told me this:

We have requested our vendor run a second report and with a unit this old, currently there were none available on the dealer market for them to pull. We are not bound by identical, comparable is accepted across the industry. However if you feel that those 2 features will enhance my offer, I have no issues returning it, until a time when identical units are listed.

I can't believe they are STILL offering me only $1.7k even though their own comparable car was shown to be more expensive and in much poorer condition.

They did discuss one of the many reasonable comp cars I sent them. They one we talked about was within 10k miles and one model year. It was in overall good condition, but had some scratched paint, a mismatched hood, and stained seats.

I would say that overall, the comp car was very slightly nicer. I has the alloy wheels and stock truck spoiler, which are nice touches. I doubt the cheap coilovers would add anything to the value.

Anyway, my adjuster refused to write up a market valuation report using this car and a few others. He could have adjusted down or up for any of these cars, but just refuses to do it. His main reasoning now is that since I had removed my seat and door panel prior to the accident, my interior was in far worse condition that any comparable. I ended up sending him a list of every classified and dealer Impreza Coupe in the country (about 20 cars). Apparently NONE of these cars are reasonable enough but the single photo craigslist ad car was fine.

I did reinstall the perfect condition seat and door panel back in the car soon after the wreck, but I guess it doesn't count. I guess I should have prepped my car for sale before getting hit.

Here is an album with the comp car I offered and was refused, along with photos of my car and photos of the only Impreza Coupe they were able to find me.

    https://imgur.com/a/JZ3GFOi

Anyway, I've talked to a number of adjusters who have advised me to file a DOI complaint and possibly pursue a small claims case.

    I'll update you whatever happens!

PS: Please run a quick craigslist search on 1994-2001 Impreza Coupes. You won't find many and any that you do find will likely be listed at $3500+

Just had a baby and due to technical difficulties can’t signup baby on insurance. What to do?

    Posted: 29 Jun 2018 02:27 PM PDT

I had a baby two weeks ago. My wife and I both have insurance through the New York marketplace. Both of us have fairly good plans.

Baby has 30 days from birth to get on insurance and have all the expenses paid retroactively. When I called the marketplace the initial representative royally screwed my account and now I get an unknown error when trying to submit the application online and even stupider is the marketplace representatives are getting the same error when they attempt it. They tell me they cant help me because their troubleshooting ticket system is down. Now i have 15 days to get insurance and no one from the marketplace can tell me what to do. They've escalated the issue countless times but it always ends in "call back in a few days". Apparently until their tech issues are fixed i simply cannot get my childs application submitted.

Any ideas would be great. Thanks!

I just found out my independent insurance agent is being investigated for fraud and has been issued a cease and desist order. [Mississippi]

    Posted: 29 Jun 2018 10:28 PM PDT

I have homeowners insurance through an independent agent. My policy renewed in March. I pay my premiums myself, not through escrow. After my payment cleared I was sent my policy and all related documents. Just saw on the news that my agent is being investigated and there are at least four cases with strong documentation that premiums were not properly forwarded to the insurance companies. I will be contacting the insurance company directly on Monday, but worst case scenario if my documents are fraudulent, where does this leave me besides uninsured? Obviously I would have to secure a new policy, but would I be subject to penalties or delayed coverage periods because of a lapse in coverage? Any recourse for recouping my premium outside of the normal criminal legal procedure and resulting restitution order?

Here's to crossing fingers that I don't need to file a claim anytime soon.

Is renters insurance enough for dog liability or should I purchase a separate policy?

    Posted: 30 Jun 2018 12:02 AM PDT

I have a 100lb bulldog and though he has never bitten and it a giant marshmallow, he's still a dog and you never know.

I have a geico policy that includes 100k of dog liability and it's reasonably priced. I searched for dog liability only policies and they are much more pricey.

Is renters insurance with a dog policy attached enough?

Anyone have any experience with VPI pet insurance?

    Posted: 29 Jun 2018 11:51 PM PDT

I have the ability to buy it through work for a very reasonable. $40 a month. It covers everything besides pre existing conditions with a $50 deductible and $7000 yearly cap.

Can someone break down how pet health insurance works and if it's worth it?

I need help picking the right offer

    Posted: 29 Jun 2018 11:43 PM PDT

I have two offers for a career in Insurance. One is an established agency and has been in business for 25 years that specializes in health insurance and risk management, nursing homes and assisted living the owner said he will "invest" in me and teach me the business. The other specializes in mainly property and casualty and has been in business for less than 5 years and they told me they will train me and teach me everything I need to know. I'm being offered to help build the company and be one of the "founders" (no partnership talk yet). I don't know much about the insurance industry but I got a taste of it and I like it but I'm not sure which offer to take up. Any suggestions??

Got into a collision a month or two ago, does this outcome seem right?

    Posted: 29 Jun 2018 10:46 PM PDT

So I got in a collision driving the family car, but I wasn't on the policy at the time and our car received very little damage. However after the collision and speaking with both the insurance companies for the other driver and our own insurance company, they put her at fault, not me. I talked to her insurance to make my claim and said that it lined up with what they already had on file and that they were taking responsibility. Thing is, I get in the mail today a letter from them saying I owe $4900 in damages for her car. I don't see how this makes sense? I plan on disputing but it doesn't make sense to me since even her own company found her at fault. Is it really just because I wasn't on my own policy? I know that hurts my side of things but this seems ridiculous to me. And I don't know if it matters but her car was a really old toyota and the fender was gonna need replacing but that looked like the extent of the damage from what I saw.

EDIT: Also while talking to the other insurance company they applied a number to how much fault they were claiming. 85% if i remember correctly.

    collision damage insurance providers ?

    Posted: 29 Jun 2018 09:41 PM PDT

I am interested in (CDW/LDW) COLLISION damage insurance providers ? I do take rental cars often - so wanted to avoid the charges levied by them . Generally i utilize the visa credit card for that but now i am thinking of redeeming all my points in hertz for car rental . My understanding is that if a vehicle is rented it has to be fully paid by visa credit card for any collision damage insurance coverage. Please correct me if i am wrong.

    Thanks

does car color makes a difference?

    Posted: 29 Jun 2018 07:30 PM PDT

I am about to lease a new car, so I went on Geico and put in the vin number of 2 different cars on geico's website to get a quote

first car have MSRP of $51,940, will be a lease and I got a quote for about $1200 a year (this one is red)

2nd card have MSRP of $84,740, also a lease same brand and model with a bigger engine and more options (this one is black) I got a quote for about $1100 a year

so the more expensive car gets a lower premium? could this be a glitch or does the red makes a difference?

(i put in the vin number for both vehicles, I am unsure other than the color what else can caused the difference, no points on license (at least not currently), no accidents, and I am in NYC by the way.)

Was wondering if it would be possible to put in a claim for my house for this situation. Michigan

    Posted: 29 Jun 2018 07:25 PM PDT

Hey guys, I live in Michigan. My family and I went on vacation last week and came back a few days ago. While we were on vacation, there was pretty hard winds and a lot of rain in Michigan. This caused one of the bedrooms in the upstairs to leak. That room currently has mold in the insulation and the drywall is sagging off the ceiling. Had a contractor come by and quoted me $8000 for the roof replacement. Said the winds caused the shingles to curl up and cause the leak. Said there were other parts of the roof with the same exact damage.

There was also some water seeping in the corners of my basement while we were out. Came back to water on the walls of the basement and a small puddle on the floor. I didn't get a quote for this as I literally just saw it a few minutes ago.

What are my options here? I have Home owners insurance with a $5000 deductible. I don't mind paying that but is this something they'll cover if I make a claim on it? Or would I be better off having a contractor coming by and doing it themselves. Or is there something else I can do? Really need to get it taken care of ASAP.

Please let me know my options. Thanks

What will happen to my medicaid if I get a higher paying job in a few months? I am needing a dental procedure that may take longer than that to happen.

    Posted: 29 Jun 2018 10:32 AM PDT

I am a Michigan resident, just graduated college from an out of state school, and was booted off of my mom's health insurance this year because she doesn't get it through her employer (we were told it doesn't matter that I was still a student, under 26, and otherwise a dependent, because she is not on her employer's insurance...they kicked me out and I am now considered independent.)

Because my student income was technically only like $5,000 a year, I qualified for Medicaid. Once I returned home, I have tried to play "catch up" on my health, including seeing the dentist. I have three wisdom teeth that have to come out, and my local office referred me downstate.

The problem being, I am in the process of finding a higher paying job at the end of the summer, and it will probably take a few months to get the surgery appointment. I can only afford the surgery because it's covered though Medicaid, and I will make more than $16,000 a year with a new job.

I know I have to report all income changes, and in order to pay my student loans I will have to get a new job within the next 4 months, so I can't just wait until after the surgery. My understanding of most dental insurance plans is that wisdom teeth extraction is not even covered, so it's not like I'll luck out if my new job offers dental.

How quickly does the process work for losing Medicaid? Even with a new job, if I make less than $16,000 before I have to file again, does that count? What should I do? It's making me want to put off finding a job which is NOT how Medicaid is supposed to work, but I can't afford the surgery otherwise.

Warranty on car with aftermarket parts.

    Posted: 29 Jun 2018 05:52 PM PDT

I hope I'm following the rules here but I have a question about voiding a warranty. I have had aftermarket headlights on my car, my car was experiencing electrical issues all over the place including the window the dashboard and also the headlights, I even tested and found the battery was bad. I brought my Hyundai to the dealership and told them about the issues.

He tells me they noticed I had aftermarket headlights and would need to replace them with factory parts before they do anything. Eventually they did it with my (implied? ) approval without giving me an estimate and it totaled over $400 dollars to essentially change the headlights since they declared the warranty void. I conversed with them and they said they could not prove that the headlights were the issue but they voided the warranty anyways.

I got the car back not thrilled about the whole ordeal, and notice that no issues were resolved. At this point they are closed so I can't call them back till the morning.

    I guess my questions are:

    • Were they in the right voiding my warranty?

    • If I bring it back to the dealership will they charge me a deductible (since I bought the car in a different state and can't return to the dealership)?

    • Would it be possible to go to a different Hyundai dealership and have them honor that the work was done by the same company or would they charge me as a new client? This is because im not thrilled with them for several reasons including telling me they could drop the price a large sum and then charging me the full price, and getting rid of the headlights that were probably fine.

Any advice would be great, even telling me to suck it up and deal with it. Thanks.

Quick Question About Insurers, Policy Owners, and Beneficiaries

    Posted: 29 Jun 2018 05:15 PM PDT

Hello! I am studying for my CA life and health exam and there is a simple concept that I unfortunately cannot grasp. On my Kaplan exam prep, it states that insurable interest must exist between the policy owner and the insured, but does not mention whether or not there has to be an insurable interest between the beneficiary and the insured. Isn't the latter more important since the beneficiary is the one that receives the benefits when the insured dies?

Also, since in most cases the policy owner and the insured is the same person and insurable interest requires the policy owner to be subjected to loss if the insured dies, does that mean a person with a record of suicidal ideations cannot be the both? I apologize if these questions are nonsensical. I am just trying to fully understand the concept. Thank you!

Cash back on a windshield replacement? (AZ)

    Posted: 29 Jun 2018 09:35 AM PDT

So this guy I know runs an auto glass company and has been egging me to let him replace my windshield, (he says I will get $75.00 cash back from it). Due to the fact that we live in a 'no fault' state, it apparently won't fuck with my insurance rate and will even give me a cash rebate.

So my question is: is there any negative side to this? Will it bite me in the ass in any way? Also, obviously this dude is getting some commission from this; is there any way I can cut out the middle-man and arrange the repair myself to get both the commission and the cash back?

Qs about injury precedence and pre-existing/historical issues

    Posted: 29 Jun 2018 03:11 PM PDT

Was rear ended about six months ago.

Had vision, memory and balance issues, still in vestibular therapy and speech therapy. This was the 5 or 6 head injury since childhood, only the third diagnosed concussion. Looking back at other head injuries (going back to 7 years old) I now realize I more than likely had concussions each time. So now I have post-concussion syndrome and losses in balance, proprioception, memory and organization that are likely permanent. I want to make it crystal clear that I have never ever had the problems I've experienced after this accident, at any time before when I took a hard knock to the head.

Also developed POTS which is linked to trauma and the area that controls regulation of circulation is also the same area my other brain issues originate from.

Also had unrelenting lower back pain and numbness and snapping, eventually diagnosed with labral tear and something about hip flexors. Had surgery recently to fix labrum and cut through flexors and tendon.

My attorney insists this is a hip case with a concussion. He doesn't even want to bring up POTS. I keep trying to insist the hip can and will improve, possibly up to 90%. While my brain symptoms and heart issues (I'm 35 and on heart medicine!) I've been told I'll deal with for the rest of my life. Why is the brain injury and associated problems not more important? The balance and systems testing I've had done show significant deficits as well as my improvement over time, so it's not just my self reporting of ooh I feel funny. Why would the attorney avoid bringing POTS into it entirely?

Adding new wife to my job's insurance

    Posted: 29 Jun 2018 02:02 PM PDT

Hello, to preface, we got married at the courthouse today. I currently pay $60 a month through my full time job. If I add her, it goes to $236. Is that a good idea? She is not yet a US citizen, I am going through an immigration lawyer soon to get that process going.

The other option, is she needs to buy her own insurance. Not sure if that would be better than joining mine.

My insurance details: $5000 in network annual deductible, 10k for in network family

Individual annual out of pocket: 5k for individual, 10k family

Office visit co pay: $30 in network

Specialist, urgent care: $50 in network

    Hospital emergency: $250, then deductible

(I dont know what some of those numbers mean)

Can you lovely people shed some light on this messy situation?

    Posted: 29 Jun 2018 01:57 PM PDT

Going to try to keep this anonymous. Someone I know asked me about this one and I have no idea how to answer; I don't even live in the same state. (I live in a No-Fault State, so I'm not much help in unraveling this situation.)

Basically: Policyholder visits a Friend in Ohio, neither state is No Fault. (Don't wanna get specific with states if I don't have to) Friend borrowed vehicle. Girlfriend of Friend was only other passenger. Friend read ends another vehicle and totals Policyholder's vehicle. Only person injured is Girlfriend, no other property damage.

Whose insurance policy would pay what in this situation? Neither of their insurance companies are being helpful and they're both frustrated. (They're still friends. Lol)

EDIT - I know that not naming companies or the other state isn't much help, but I don't want to be specific just in case. I'm mostly wondering about the medical for Girlfriend.

    AirBnB Boat Insurance

    Posted: 29 Jun 2018 01:41 PM PDT

I've been toying with the idea of getting a larger 20ft+ sleeper cabin type boat (ultimately a small fleet of boats) to rent out for people to stay in as an alternative to staying in a hotel or more traditional AirBnB rental. I've always thought these were a really cool idea and a way to potentially avoid flood insurance vs. beach/lake rentals.

Does anyone have any idea what sort of insurance coverage I would need on for this type of set-up? Not too sure where to even start here.

Edit: I wouldn't be allowing guests to take the boat out for leisure (unless it was chartered - potentially in the future, but that's more research I'd need to do), just to rent out as a room.

Are bids for insurance rebuilds 'rigged'?

    Posted: 29 Jun 2018 12:37 PM PDT

Our house was burned out in Feb last year. We were probably overinsured at 320k for a 1000 sq ft house but similar sized new houses in our area are selling for about that but that would include lot and a brand new build.

Thing is, the foundation and outer walls and roof were deemed unaffected by the engineer so our contractor only had to tear out and start from there, not from scratch.

So the final bills come in and what do ya know, they add up to exactly 320k.

My question is, how does the contractor manage to spend exactly the total amount of insurance we have when he is supposedly the 'lesser' of two bids?

He managed to squeeze 75k out of insurance for the tear out and vermiculate removal and then 245k to do the rebuild which is 245/sq ft for a house that already had a basement, walls and roof.

By anyone's standards up here that's rich. Don't insurance companies try to rein them in or is it just 'pay til the money runs out' with the contractor billing as much as he possible can once he knows the total coverage available?

    Runaround From Progressive

    Posted: 29 Jun 2018 03:51 PM PDT

I'll try to keep this as short as possible.

The driver of the pickup truck was at a complete stop in the middle lane, at a point where it was no longer legal to change lanes (he crossed over a median marker), with no turn signal. I proceeded into the right lane, as that lane turns into a dedicated lane onto 281, you can proceed through the intersection. The driver, with no signal, moved from the middle lane while stopped, into my path going to the right lane. My insurance company has already denied liability given the evidence of their insured being at fault.

At first, Progressive was denying liability and saying we'd need to go through arbitration. I got her supervisor involved, and after that she told me they would accept majority of the liability, but only up to 60%. When I asked why, she told me "there were some contributing factors for failure to control speed, and you weren't able to evade due to the speed".

I have screenshots from my dashcam viewer software that shows my speed before the time of the incident/going into the lane was just 22mph. My speed at the time that he moved over was just 13 mph, and at the time of contact I was just going 5mph. I think this clearly shows I was going a reasonable speed for traffic conditions, I made a reasonable attempt to avoid the incident, and I had complete control of my vehicle (I.e., I was slowing down as expected approaching an intersection).

Now they're just not replying to me, after I sent in the speed information. I've already filed a complaint with the Texas Department of Insurance. However, my first question - am I being hardheaded, or am I correct in that their driver should be 100% liable? Also, while I know I can go through my insurance company to go after them, I really would like to just handle this through them. What's the best way to get them to handle this? Is there anyone after a supervisor I can go through, or do insurance companies have any kind of appeals/investigative department? What should my next steps be in a situation like this?

Here's a link to the Google album with the screenshots and whatnot: https://photos.app.goo.gl/LcWfPhnSJ5QyZU4L8

Hey folks. Guy hit me backing out of his parking space as i had pulled past him an he caught the rear bumper of my suv. Honest mistake. Though i think he could have prevented it. I was nice. He was sorry in a Canadian way.

Should i have insurance deal with it or will that ding my rating. Was thinking of getting a repair quote from a friend on the cheap end, an offering him option to pay in cash while giving my pal some business. As a nice guy move. Not trying to extort. Is this legal to do?
