    Mostly good news.

I worked with my dad and got my own lawyer.

I got the timeline of my shares wrong, but it comes out the same. What my brother and I inherited from my grandmother was originally part of my grandfather's portfolio, he was the money savvy one. My grandmother looked after those after he died and she personally set up my brother's accounts and gave him control of his part. She didn't do the same with mine before she died (I thought she had already set the accounts up for me and given control to dad before passing) instead the shares were in her will, and she left everything she owned to my dad with instruction that what was $15000 worth when my brother got his equivalent part would go to me when I was old enough to know how to take care of them. There was no trust, she just trusted my dad. My dad did the right thing and set up accounts for me and gave me control six years ago. My dad put some of his own shares in too as an extra leg up.

Dad admitted to me he'd chewed out my brother last year when he came to him asking for money, and dad had supported him several times over the years and got to the point he'd had enough. My brother found out I still had my investments because dad had used me as an example of how brother should have been using money. That's how my brother found out I still had shares and they'd grown.

According to all that info my lawyer tells me I'm in the clear, but it's not going to get to the point of finding that out in court as my brother's gf was only a legal secretary. I say was because the firm she worked for apologised and informed my lawyer she was terminated immediately. The letter I received from them had been edited to put her name in a position higher up than it should have been, and some of the contact information had been changed.

A week after she was fired my brother visited me begging for money. His girlfriend is in serious debt and she took a chance on scamming cash from me and lost. I felt awful rejecting my own brother over and over, and if he hadn't involved his girlfriend needing an amount well into five figures I might have given him some. The next morning I found all my tires had been slashed. Screw him, I don't feel bad any more.

The rest of the comments in the previous thread made me realise I don't know nearly enough about what I'm doing with the shares and dividends and money in general. A lot of the decisions I've made have been with dad's help and his advice has paid off well so far but not because I knew it would but because I had no idea what I was doing and left it up to him. I've booked in to work with a financial advisor to make the most of what I have. Thanks for all your comments.

E.R. Doctor called CPS on us for our daughter's broken leg

    Posted: 31 Mar 2018 04:40 AM PDT

    [UTAH, USA]

I'm a younger dad of a 3 year old girl and could use some help.

My daughter is a paraplegic (paralyzed from the waste down), and she gets nursing at night. Thursday night, our nurse called me into our daughter's room to show me that her right leg was significantly bigger and more swollen than her left, and advised us to take her to the E.R. the next morning. So we did.

Everything seemed fine, they ran some bloodwork and did some x rays. Because of my daughter's needs, we're no strangers to the E.R. and they treated us like regulars. That is, until the x-ray results came back to reveal the leg was broken.

The regular E.R. doc's entire tone shifted. He seemed more cautious and more susposcious, asking us questions about how or when it happened. The thing about having a paraplegic, nonverbal three year old? She can't feel her legs. She was sitting there on the hospital table, acting totally fine, her usual happy self. And even if she could feel anything, she can't speak to communicate that to us. And so we had no way of knowing when or how the break happened, or that it was even broken to begin with. So we told the doctor just that, "I don't know." We explained that maybe it could have happened while she was at preschool, but otherwise couldn't think of any specific instance when it could have happened.

The orthopedic surgeon was much more calm and relaxed. He came in, splinted her leg, and told us that he's not surprised her leg broke, nor would he be surprised if the other one broke next week. This is because she doesn't stand or weight bare on her legs at all, so the bones are naturally weaker and much more susceptible to breakage. "Anything, even the smallest thing, could have caused it", he said. I should have asked for this in writing, but didn't think I would need to at the time.

Back to the main E.R. doc, he explained that he would be calling DCFS "just to follow protocol",but that he didn't suspect us of abuse because he didn't see any other marks, bruises, or other indicators if abuse. But if he didn't suspect, why would he put in the report? He claimed it was so DCFS could speak to the school.

Long story short, the doctor filed a report with DCFS and told us to expect a call and visit within 24 hrs.

I'm frustrated that he called, even after admitting that he didn't suspect us nor did he find any other signs, but I do understand he's just doing his job and being cautious.

What I am concerned about though, is how best to handle CPS when they come calling/knocking. Half of what I read online says that CPS agents are trained to fish for any evidence against you, in a backwards "guilty until proven innocent" approach, and suggested that the less I cooperate, the better, and that I should keep them at the doorstep. The other half says they are just regular people who care about children and jsut want to find out what happened, and suggested that the more honest and cooperative we are, the sooner they will leave.

I already plan on secretly recording the audio of the home visit, as I discovered that my state allows it. But I can't afford a lawyer at all, and would hope that this case won't progress far enough that I would need one, since we didn't abuse her, and the doctor seemed to call based on protocol only.

The only reason I'm concerned is that we've dropped her off at school on colder days without a jacket a couple of times, so the school might share that information with the agent. Also, she sleeps in a twin bed, but we don't have any kind of side rail guard to prevent her from rolling off the bed. We plan on getting one soon but we just barely moved into our new place and haven't gotten to it, and since either a parent or a nurse is constantly with her, we would know if she fell. I'm worried that little tiny things like this will be used against us if we allow CPS to search our home.

[CA, USA] Group of homeless people living 6' away from our window. They keep trying to force themselves onto our side.

    Posted: 31 Mar 2018 08:14 AM PDT

So there's a group of homeless people that live next us. They are literally 6 feet away from our window. The only thing divinding us is an old wooden fence. It wouldn't be such a big deal if they didn't bother anyone. However, they lossened one of the planks. They would cross to our side and do God knows what.

The manager covered the loose plank with a bigger piece of wood. Now they are looking for another piece of loose wood. I don't know what they are trying to do. We cant leave the apartment unattended, because we fear they might try to break into our apartment.

The cops have been notified, unfortunately it's out of their jurisdiction, according to them. Supposedly the owner of the lot has to make a complaint. Problem is, nobody knows who the owner of the empty lot is. This lot has been empty for 7 years. Who knows how long it may stay empty, could be another 7 years.

I'm not sure if this is the appropriate subreddit for this. Any advice would be much appreciated.

sorry for the formatting, I'm on mobile

Edit: I would like to thank every single one of you who offered any piece of advice, much appreciated. I was able to find the owner of the lot. Apparently the company was approved to build a condo, this was in Jan 25. I'm not sure if they start the process any time soon. Perhaps they came across some bumps and will be delaying the construction.

Housing Discrimination due to Religion (or lack thereof)

    Posted: 31 Mar 2018 09:31 AM PDT

*update* We found a place within our price range twice the size of the apartment on its own little slice of land in the country right outside city limits. We start moving Monday. Thank you all for your advice.

A month ago my boyfriend, his mother and I got a months notice to find another home. (Rented, month to month, nothing bad, the landlord just needed the house back because she didn't want her son and his family in her own house anymore) About two weeks ago we finally find a place within our price range. Set up a walk through. The guy tells us we most likely would get it. Two days after that he gives us a phone call saying congrats the apartment is yours. Hurray! We don't have to move to a different town and start over. We pay him the 600 and the 400 deposit. I still have receipts. In the last week and and a half this man has been vying for my mother in laws attention. He found her on Facebook and added her. They're older and both single so I thought nothing of it. After a while, She begins to ignore him because he's either messaging her on Facebook or texting her phone and she's not particularly interested anymore. We hold our tongues because we're about to be out on our asses in the street. Yesterday about noon he calls me, asks me if my MIL does drugs. (She does, drs orders. Anxiety, heart pills etc) but it's none of his business though. Last night he calls me around 11:30 pm. Apparently he went snooping and found my personal Facebook (which isn't under my full name) and saw that I put that I worked Upper Management in Hell. Bad joke I know but it's just Facebook. Asks me what religion I am. I'm speechless. Isn't it illegal to ask me that as a landlord? After I tell him I'm not affiliated with any religion he tells me that he doesn't want anything to do with us and he will return my rent and deposit on Sunday. Mind you, we were at an agreement that we were to pick the key up Monday. Because we're supposed to be out of our other place by Friday at the latest. I'm just wanting to know what my options are legally here. The apartment is in his back yard in a separate 2 story house/ garage. This is in Texas. I just find it peculiar that he was find until my MIL started ignoring him. We have texts and screenshots saved, too. This is just so short notice and I don't know what to do. We're looking for another place in the meantime but we had already started calling light, gas etc to switch over that way. TIA.

A bank teller used my girlfriend’s personal information to find her on Facebook, what can we do about this breach of privacy?

    Posted: 31 Mar 2018 12:03 PM PDT

    [California, USA]

The title summarizes the whole situation. My girlfriend went to the bank yesterday morning and later that night, the bank teller adds her on Facebook and asks if she'd like to hook up. Apparently he took down her name earlier in the morning when she made a deposit/withdrawal. If I recall correctly, this is a breach of privacy. If it is what should/can we do?

    Inherited a murder weapon (California)

    Posted: 31 Mar 2018 08:05 AM PDT

A friend of mine's grandfather passed away recently, and among the grandfather's possessions was an old Colt revolver. Apparently there's a family story about a relative using the gun to kill someone back in the 1940s as part of a feud (we actually found old newspaper articles about the case, and the murder occurred in a Midwest state, I think Nebraska). For whatever reason the gun was kept and passed down. It did have a serial number but it's been filed off at some point, and I'm pretty sure that makes the gun super illegal, but what should they do with it? Is there a way to dispose of it without my friend's grandmother getting in trouble for having it? We can't find any of those police buyback programs anywhere nearby. Alternatively, the gun is in really nice condition, other than the serial number. Is there a way to legally keep it, like restore the serial?

My sister's boss slipped this very strange letter in her bag. It looks like they are bribing her to quit so they don't have to pay her severance or face issues for workplace injuries [Ontario, Canada]

    Posted: 31 Mar 2018 07:29 AM PDT

    • My sister has worked at said location for approximately 10 years
    • She has suffered serious back issues (degenerative disc, bulging disc) due to lack of proper equipment to lift 100+ pounds alone.
    • When she has been unable to work they forced her to use vacation time
    • She has doctors note stating how many hours she is capable of working and what duties she can't complete
    • My sister found out recently when someone else was injured (serious concussion) that they haven't been paying into WSIB and are forcing her to use vacation time as well

Please see the letter below and let me know know your thoughts and advice.

    Dear [name],

I would like to address this letter, Dearest [name], since I have such respect, fondness, and admiration for you. I highly value your skills, intellect, work ethic and passion. We have discussed previously your frustrations and disappointments here at the [workplace]. Your unhappiness is visible to me in words and body language. It is not ever day. The days when you are replaced, interactive with staff and clients seem to be on the upswing since your hours have been reduced. I see the old [Name]. There are days when your unhappiness is obvious to not just me but also clients. There have been reports back to me (please no speculation on staff or my friends, this was a client) that you have reached "burn-out stage" in [position/title] world. Theres words of your unhappiness also include complaints of the staff and [workplace]. I understand how a person copes when their life isn't reaching expectations, have probably been there myself at some stage. When your words like this are spoke, people have a choice to agree because they may truly believe it as well, or agree because they are fearful you may speak of them in a similar manner. Or they may feel uncomfortable because they do not agree, may ignore your words, or worry like myself that I have failed to provide you the means for happiness. Perhaps this explains some of the feedback you describe as feeling from staff and myself.

It has not escaped me that you might stay in this job that is not satisfying to you just receive the benefits (for services and products). I propose a way for you to find your passion with a question and an offer.

If you were to receive your benefic of this [Workplace] without work here, would you still remain employed with me?

If the answer is no, we can discuss more details. If you like to remain with a little pulse on the [position/title] world, perhaps filling in as necessary would also be an option.

Your skillest and intellect are an important part of the our [workplace], [name]. I hate to think that your job makes you so unhappy. I only want what is best and have always. This my way of setting you free to find it. Think about it this weekend and while you are away. Everything can be worked out for the best, [name], no matter what.

    With best regards always,

    [TX] No added sugar

    Posted: 31 Mar 2018 11:01 AM PDT

I work for a company that sells treats. They advertise that they serve treats with no added sugars. However this is 100% not the case given that we all pour sugar into some of the treats and make them by hand. I have diabetics that come in and I am worried about them. Is this breaking any law?

Also these are extra things and if you know were I cant post these it would be awesome. We reuse rags constantly. We have the same rags since from my knowledge a month ago, possibly longer, and I thought that you needed new clean rags every 6 hours (i worked at a couple of restaurants and they did this ). Also they are withholding my friends paycheck. It is from the first 4 days, and it has been more than a month and still nothing. So any idea?

Lastly their are wanting us to re purpose old treats into new batches. For example if 3 treats break and its a 3 week old batch, when we start to make a new batch they want us to pour the old treats into a new batch so that there is no "waste." Any help would be amazing.

[TX] Hospital is charging me about 5000 dollars for services I was unconscious for. Can anything be done?

    Posted: 31 Mar 2018 10:25 AM PDT

Maybe this is hopeless, but here goes. I had a seizure while visiting my neurologist. They sent me to the emergency room and relocated my shoulder, which had popped out. After I woke up, they gave me an EEG.

This isn't the first time this has happened, so I was more or less prepared for a big bill, though I thought it might be less since I was on insurance and already at the hospital--no ambulance, right?

Got the bill a few weeks ago and it was 1300 dollars. Not great, but I can handle it. Set up a payment plan and start paying.

Got another bill today, and the cost has jumped to 5000 dollars. This is more than I've ever had to pay for any emergency room visit ever. Some are things I agreed to, like the EEG, others are things I understand they had to do per Hippocratic oath.

The main thing that seems contestable is the Level IV emergency room they sent me to, which was around 1600 dollars on its own, and the drugs they gave me, which were about 600 dollars more. There's some other things that they seem to be charging me twice for, but I'm going to talk with their people about that.

(1), can I do anything about this? (2) Is there anything I can do to keep this from happening again, i.e., setting up an emergency room stipulation, keeping people from calling an ambulance, etc.?

EDIT: Online some people are suggesting disputing charges that seem inflated with a threat to go to small claims court. Is this a bad idea?

Older brother was killed in a car accident, but life insurance refuse to give my mother his insurance money.

They have never told her anything like that until she called them after he died. My mom has been paying them for 20 years.

Ridiculous Towing Fees on a Stolen Vehicle

    Posted: 31 Mar 2018 12:58 PM PDT

My car was stolen (from nc) and a towing company contacted me about the car being in florida. The towing company is charging $400 + $25/day since it was towed, and are threatening to auction the car if I don't pay soon. It was towed on the 23rd and they sent notice on the 26th. I received the notice today. They will not tell me the state of the vehicle, or if anything is in the vehicle.

I'm planning on driving down w someone on Monday (7hrs) and back overnight to make it to class the next morning. While its not out of my means to pay the fee, I do work for minimum wage so its not within my means either. I'd rather not give the rest of my emergency fund to a shady towing company.

What are my rights as someone who's vehicle was stolen? Would the police be able to return the car to me without having to deal with that towing company?

Edit. From what I'm reading the towing company should have notified the police, because the car had been reported stolen. Could this mean that the car was illegally towed?

[FL] Police Department and Bad References

    Posted: 31 Mar 2018 10:40 AM PDT

Hello, throwaway account because my main has potential connections to the issue.

I worked at a police department between the years of 2014-2017. I quit in August 2017. I worked in two different positions, one in the field, and the other as a dispatcher. Neither had union coverage.

The dispatch job required us to monitor cameras around the police building, and dispatch police officers to assist persons who had entered the police building. One day, a young black male, completely unknown to me, entered the police department lobby and began dancing and rapping to his reflection in the window. He walked past a sign that said "please pick up this phone for assistance". My supervisor and myself were in the camera room, and observed him on the CCTV screen. She told me to send a single police officer on a routine call to go and check on what was going on with this person.

I got on the police radio, assigned the call to a black female police officer, said there was a suspicious person in the lobby, and described him as a "black male, who appears to be dancing near the entrance". Every single officer who had their radio on at that time decided to take it upon themselves to go see what was going on. 6-7 black cops surround him in the lobby and begin questioning him, and later determine he is the son of the Chief of Police's secretary. All of the cops involved are black, so is the young man.

The only non-black people involved in the whole interaction? Myself and my supervisor. Young man files a complaint, saying that the officers made him feel threatened and like he was in danger. His mom, the Chief's secretary, tells the chief she wants it investigated.

I'm notified that I'm under an internal affairs investigation for the incident. I retained an attorney and participated in an interview where I explained that I said he was suspicious because he walked into a police lobby at 5PM on a weekday and started dancing/singing, not because he was black. It was an unusual activity for the time and place. I further explained that while I have the appearance of being a white/hispanic, I'm actually multi-racial, with a white father and a black mother. I further explained that one year prior to this event, I organized a department event where the police department fed 15 black families an Easter dinner. There is even a photo of the event published on the police department's instagram page, where I can be seen in uniform speaking at the event. The investigator replied "I'm going to make sure you never work in law enforcement again".

Fast forward 6 months, and I have quit the job. Every police job I apply to now does a background check, and part of it is getting a reference from this department. They produce reports saying that I was a "risk" and that I "endangered the public" regarding this incident. One reference check even informed me that they had fabricated an additional internal investigation after I quit working there. I file a public records request for my personnel file, which they refuse, yet they will provide it to reference checks.

What can I do? The things they are saying are simply untrue, and they are effectively blackballing me from work in law enforcement. I have several positive reference letters from all of the supervisors involved prior to this incident, yet once someone's secretary got pissed it appears I can never work in the business again.

Is there a case for defamation? They're essentially telling employers I profiled someone and put the public at risk. The case file has a DVD showing what the guy was doing, an audio recording of my exact words, and a video of the cops harassing him. Surely he was harassed, but how am I, as the dispatcher in a locked room 50 feet away, the one who should be blamed for it?

Custody, Incest, Family Law, and How to deal with a really stupid mother who loves her child.

    Posted: 31 Mar 2018 12:46 AM PDT

Texas here: throwaway account. So long story short. Friends with girl for 8 years. One night we get drunk. 9 months later there is a baby. 4 months after birth I find out he is mine. Not legally binding DNA test proves it. We both sign admission of paternity. Woman at office says this this will put on the Birth Certificate. Recently find out that is not the case.

So a few months later I find out that she (adopted) is in a sexual relation with her biological father. I found this out because she gave me her phone security code when drunk and I used it several days later to read her texts. Next day I spoke to a lawyer. (How I found this out could be a big problem)

Recently she made it clear that she would not end the relationship with her father....who has a history of drug abuse, drug dealing, domestic abuse, sexual abuse, cartel involvement, got her originally hooked on hard drugs...etc.

Tonight she dared me over and over again to try and take our son away from her. She has admitted to me what is going on several times. Told me that our son would accept their relationship...and I pretended to be dumb.

I have had him every weekend, and often during the week. She at no time has tried to keep me out of his life. I couldn't ask much more in a court of law.

But with the incest and who it is with...well this stuff cant stand. I told her over and over again that I have no desire to take her child away, but it had to end. That was lie. And she made clear that well, it wont end. And that man can't be part of my son's life. So I will pursue custody. And if I get it move far far away.

Question, other than hiring a competent lawyer, is how I should deal with situation. Do I need hard evidence as I would for a criminal case. Pretend everything is normal? What else can I do? How do I act? I am not sure.

    Thanks

Upstairs Neighbor's Dog Peeing onto our balcony (Pittsburgh, PA, USA)

    Posted: 31 Mar 2018 07:58 AM PDT

Our upstairs neighbor has a dog.

The neighbor often lets his dog out onto his wooden balcony. His dog pees on his balcony and it flows down onto our balcony. We don't have any furniture on our balcony (not because of the dog) and it is currently too cold to use the balcony to hang out on, so honestly our use of the balcony is limited, but we would like to use it once it warms up (maybe starting in early May).

Other info: Our landlord is aware. He talked to the guy and he stopped for about a month, but he recently restarted allowing his dog to pee on the balcony. We both have the same landlord. Dogs are forbidden in our lease; I'm pretty sure they are forbidden in the neighbor's lease as well. The landlord did not renew the lease for this upstairs neighbor; it ends June 30th.

The balcony below ours does have furniture; I'd imagine some urine does flow down from our balcony to this lower neighbor's balcony.

Though not recently, there have been instances where the dog barked for >1 hour. I reported these to the landlord, but otherwise did not take any action.

Is there any legal action I can take, or should I just suck it up for the next three months? I'd prefer not to sue my landlord, as otherwise this place has been great, and I'd like to live here thru 2020.

NY: Ex-wife fighting for 100% of life insurance

    Posted: 31 Mar 2018 05:04 AM PDT

Defendants have 2 lawyers. One thinks they should roll over and make a deal with "Plaintiff". The other, they have yet to review this case with. Will pursue later in the week.

I'm just looking for opinions from random strangers on the internet if you think "Plaintiff" has a case, or if this is just a scare tactic to push defendants in a corner with fear of losing all their money so they make a deal.

Background: Man married woman (Plaintiff). Man divorced woman approximately 10 years ago. Man, struggling to keep business afloat, borrowed money from different people. Man passed away. Man left money he owed people to them on his life insurance, left woman what he owed her in unpaid maintenance and unpaid child support, and left one of his children the rest.

She is suing for OVER 100% of the life insurance with the claim she would live XXX more years and he owed her future lifetime maintenance.

    However, in the divorce decree:

ORDERED that the Plaintiff and Defendant shall continue to jointly own XXX with Plaintiff's share to be XX% and Defendant's share to be XXX% (woman's share more than man's..this is in regards to his "own" business and property... defendants were let in his property after he died via his children who were supposedly his heirs by default since he had no will, just a note with his final wishes asking for two of his children to be executors of his estate)

ORDERED that the Defendant is obligated to obtain, or continue, life insurance naming the Plaintiff as irrevocable beneficiary, at a face-value which at all times is sufficient to secure unpaid child support and maintenance due under this judgment

Maintenance shall commence on [such a date] and will cease in the event Plaintiff remarries, or either party dies.

The papers served to the defendants state:

    PREAMBLE

    1) Plaintiff, XXX and her deceased husband, XXX, were residents of County of Rockland, state of New York 2) ... 8) Pursuant to a Judgment of Divorce dated XXX, XXX, now deceased, was obligated to obtain and continue life insurance naming Plaintiff XXX as the irrevocable beneficiary to secure the unpaid child support and maintenance obligation. The Judgment of Divorce was signed on XXX. 9) The Judgment of Divorce provided that XXX, now deceased, was obligate to provide Plaintiff, XXX with lifetime alimony. 10) On or about XXX, XXX changed the beneficiaries of his life insurance policy. As a result of this change [breakdown of new percentages to different beneficiaries INCLUDING Plaintiff with percentage covering unpaid alimony and unpaid child support only] 11) XXX's change to the beneficiary of the XXX's life insurance policy violated the Judgment of Divorce dated XXX (wrong year date by the way), as XXX owed child support and maintenance in excess of the XXX policy. 12) On XXX, XXX passed away 13) Plaintiff XXX was not listed as the sole beneficiary to the XXX life insurance policy at the time of XXX's death. 14) Plaintiff, XXX, has suffered and will continue to suffer damages as a result of Defendant's actions.

So, what do you guys think? What may be loop holes for Plaintiff or Defendants? What is the gray area that would cause the defendants' lawyer to want to just make a deal with the Plaintiff ? Thoughts are welcomed.

Thanks for your time, - Shuu

Witnessed a murder - receiving calls from Public defender's office

    Posted: 30 Mar 2018 04:12 PM PDT

About a year and half ago, me and my wife witnessed a murder in in the parking lot in our apartment building which was in the basement. We were parked to the side when a guy in a car ran in to someone else's car behind us. Mind you, guy1 was at fault here for speeding and ran into guy2's car. Things escalated and guy1 shot guy2 in the head. My wife yelled out loud when she heard the bang. guy1 turned and pointed the gun at our vehicle as he realized that some one was there. We both ducked. He knocked on the trunk of our car with his shotgun. We waited there ducking for what felt like an eternity. Suddenly, he ran into our vehicle with his car and basically made his car a barricade so we cannot move. All we could hear at this point was loud music coming from his vehicle. We really thought we were going to die at this point. It's a matter of time, we felt. After few minutes he just left in the vehicle of the guy he shot.
We carefully walked out and saw that the guy who was shot had a huge hole in his head. I calmed myself down and ran into the apartment holding my wife's hand. We locked the door, called 911 and reported the incident. 15minutes later, cops came in, took basic info and informed us that we will be moved to a different location for further questioning. My wife was crying this whole time. 2 hours later, a couple of detectives came in and took us to a police station. They informed that they got hold of the murderer and calmed us down. We spent the night at PS as they questioned us separately, wrote down our stories and showed us pictures to identify the murderer. We both did identify him. Police sent us home next day morning.
My wife was absolutely shook by what has happened. She had nightmares about the incident for months. To this day, she does not go outside alone after it's dark. I left my job and we moved to a different city. We heard nothing from the Police or Attorneys about the case. Now after all this time, we both got calls from Public defender's office who's representing the shooter. They asked me what I saw, how the murderer behaved during the incident. I was not comfortable speaking to her when she mentioned his name and that she reps him. I asked her to call me back in a week. She called me back in a week. I missed it. Now, I get a mail from her with the Public defender's office letter head that it's important for me to speak with her.

Now, what do I do here? I do not want to say something that could affect the case negatively. We have told the police everything we saw that night. If it comes to the point where we have to testify, I would definitely do it (Not sure my wife will, but I definitely will not pressure her into doing it) so the guy gets what he deserves for killing an innocent citizen.

    Please advice

[WI, FL] Received a letter demanding I turn over my email address or the person will sue me for damages and control of the email address.

    Posted: 30 Mar 2018 12:48 PM PDT

I received a letter today demanding that I turn over my email address to a person who shares my name (and the name of the email address; if my name was John Doe, my email is John.Doe at gmail). The letter looks pretty fancy and has a letterhead, and when I looked up the law office it said it was from I found it was a law office in Florida with the same address as it had on the letterhead. It was a Certified mailing, and it says I have 30 days from the receipt of the letter to back up anything I want to keep, delete everything, and turn over control of the email address to this person who shares my name. It says that I'll be sued by a person who shares my name if I don't comply. They also threatened to sue for "damages" but didn't say what these were or how much.

Is this legal? Can I actually be sued over the ownership of an email address? I never used it to try to pretend to be somebody else. How did they manage to get my RL physical address? It's my RL name and the letter was sent to my actual house, I've had it since early 2005, and I only use it for close friends and family to avoid getting spam and crap on it as best I can.

I'm kind of worried about this since I use it heavily for friends and family, and I don't have any other email except for my old Yahoo email that I haven't used since I got this email address.

If it matters, the different "how many people share my name" sites all show around 500 people in the States with my name, so it's not exactly a common name. I don't know if that last part matters any.

Update: I'll try to give the law office a call using the blocked number *67 when they open on Monday. I would try tomorrow but it looks like they're closed for Easter tomorrow. If they did send the letter I'll ignore things unless I get an actual lawsuit. Thank you everyone for your suggestions!

Parked car at my apartment complex in a spot not clearly marked "Reserved" and got towed

    Posted: 31 Mar 2018 05:59 AM PDT

(Daytona Beach, FL) I've lived in this apartment complex for approx. 6 months and don't park in the reserved spaces. Last night I parked in the middle spot (Seen in the picture) which I have parked in before. Car towed and can't get without paying 160.00.

Additional images of clearly not marked spot and example of decal.

What recourse do I have in getting my money back since this spot isn't clearly marked?

I am being harassed by my neighbor, who acts as the super of my building. My landlord is sketchy and doesn't care. Cops are useless and think I am crazy (NYC)

    Posted: 31 Mar 2018 12:41 PM PDT

I know for a fact that either the neighbor or my landlord have entered my studio without my knowledge on several occasions, based on certain things such as my TV being moved, unspoiled food making me sick (tampering), and personal hygiene products making me sick (again, tampering). You must simply take my word for it.

They also control utilities (they pay for utilities), so they can turn off electricity whenever they want. Setting up a security camera makes no difference if they can simply switch off the circuit breaker for 5 minutes.

When I first moved into my place, the old man came out and sexually harassed me, touching me and refusing to let go. He repeated this behavior a few more times.

I believe that there was a hidden camera set up in the communal bathroom-- my landlord ONLY rents out to young women because we share a public bathroom that can be accessed by anyone in the building, and really anyone who walks into from outside. For the longest time, my wifi connection would completely lose signal if I was in the bathroom (on my phone, tablet, laptop etc). The bathroom is only maybe 20 feet away from my room, where I have my modem and router set up. Only recently has the wifi started to work without any kind of issue. I have not updated my hardware or moved the location of the router or anything.

I also believe there was/is a hidden camera due to the way that the old man/super would come out of his apartment every single time I was done taking a shower and walking to my apartment, and he would give out this incredibly gross huffing chuckle as he would stare me down without moving until I enter my apartment.

My first 2 months at this place, I have woken up with strange breast pain and vaginal penetration pain. I have not had sex in a few years but I definitely know the feeling of getting "ripped" down there. My door is bent-- sometime in the past, I guess they crowbar-ed open the door and then refused to fix it.

I have tried to go to the cops, and they would not believe a fucking thing I said. I believe it is a race thing too, as my landlord accused me of making things up and being a racist. I am the only person of my race in this building, and I believe the gross neighbor/super targeted me because of my race.

My apartment is an illegal conversion too. The house is registered with the city as only have 2 apartments, when in total there are 6. My landlord technically cannot collect rent, even though he knowingly rented this out to me and I have a lease.

Because I have no power in this situation (I have completely stopped showering, I only wash myself in front of my "kitchen" sink), I think the only thing I can do is keep making complaints to 311 to get my landlord fined for all the illegal things he is doing-- such as, not having separate mailboxes. Privacy is a huge concern, I have already missed important letters that were supposed to be mailed to me, but because the old pervert man is the guy "in charge" of getting mail, I believe he has thrown away my mail.

I filed an HP Action over my broken door and lack of mailboxes, and my court date is coming up. My landlord called me to YELL at me, saying that I am making trouble for him and that he is going to have to evict everyone. I tell him he can simply register the proper number of apartments with the city and he literally says "no, I don't want to. That's expensive."

He then tells me how I am making things up regarding the old man sexually harassing me (calling me racist), saying "no offense, but I have rented to some very beautiful girls and they have had no problem with him. They were young too, 22, even 21!" As if that... means anything regarding who can be sexually harassed?

I live in a fucking rape/molestation house. Cops are absolutely fucking worthless, even though I have tried to call them. The precinct office does not pick up any of my phone calls anymore. My only possible course of action is to get my landlord fined for all the fucking illegal shit he is doing.

[CA] girlfriend is turning 18 in 3 days. Need advice on how to proceed regarding abusive mother and other stuff.

    Posted: 31 Mar 2018 11:05 AM PDT

So I am 18. My girlfriend is 17, but will be 18 in 2 days on April 2.

Some background: Mother has always been emotionally abusive. Father died when she was little. Emotional abuse consists of her verbally abusing, making my gf care for her half-siblings while going out getting drunk and high, etc. Gaslighting, manipulative, etc.

Until recently, my gf was able to have limited interactions with her mother, so the abuse wasn't quite bad (her words not mine). Anyways, I had been telling her time and again that we needed to find a way for her mother to be out of her life, but my gf always said she wasn't ready. Well today, things turned to even worse shit than before. My gf came home and her mother started beating badly. Note: this is the first time that gf's mom has been physically abusive. My gf had always planned to move out and in with me after graduating in June, but because she turns 18 soon this will have to happen sooner than later. She came over to my house immediately (my parents are out of town and they don't know yet). She says she can't handle it anymore. She does not want to go back AT ALL. Where should she go? Can she stay with me for these 2 days? If the police show up, can they make her go back to that daughter of a bitch?

At this point, can she go and file for a restraining order the day she turns 18? This is the main concern. Her mother really scares the shit out of both of us. We want to get as far away as possible from her. Should we go to the police right now and file a report? Does she need any identification to file a report? She doesn't have any at the moment.

Anyways, my gf wants to get a job as fast as possible, so she needs some sort of ID. My gf doesn't have an ID besides her school ID, which her mother has (and which we really don't want to go and get from her). She also doesn't have any documents, such SS card or birth certificate. Replacing the school ID is not a big deal, as she can get a new one. School has her picture already.

In this situation, how should she go about applying for a learner's permit to get her DL/ID eventually?
From the DMV website I gather she needs her

    1) SS card for her social security number. This seems to be the biggest hurdle. I read on SS website she needs a state issued ID, but she doesn't have a state issued ID. All she has is her school ID. How should she get her SS card then?

    2) Her residency: From what it seems like, any of the documents located in this pdf located at https://www.dmv.ca.gov/portal/wcm/connect/a34dbefd-c615-4c07-a271-b135850de9d1/Residency_DocsList.pdf?MOD=AJPERES One of them includes any document issued by a "U.S. educational institution." Would her school's transcripts/ID count for that?

    3) She also needs to establish her identity. How should she go about doing this? I am looking at all of the possible documents located in the 2 pdf files located at https://www.dmv.ca.gov/portal/dmv/detail/dl/dl_info#BDLP She does not have her passport nor her birth certificate. She has none of the other documents as well. The easiest way out of this requirement is to get her a certified birth certificate, but for that she needs to have identification that a notary could use. I don't think a school ID would count, so how should she get birth certificate in this case? Can she approach a judge with some witnesses attesting to who she is and the judge could get a certified order for her saying she is who she says she is?

Edit: Those witnesses would be trusted people who we plan to approach, like our English and Math teachers.

    Is this Wrongful termination?

    Posted: 31 Mar 2018 12:29 PM PDT

(North Carolina) I became a temporary employee in 2015. In 2017 I went out on disability because I required hand surgery to repair legaments. I do not know how I hurt my hand, it was in pain for a few months before I went to the doctor, the doctor said it could be from years of abuse, including from my childhood and teens. So it was not filed as a workplace injury. .

I returned to work in 2018. I did my full job duties without any issues. Then, 3 weeks after being back, I was called during my work shift and told I would be fired. .

I contacted my manager (who has been out of town since I've been back) to ask if I could do anything to prevent this. I recorded the call (we are both in "one party record states) . He said he was afraid that I would hurt my hand again and that he felt like I injured it at work, even though he admits that no one has said that. He repeated several times that he was afraid I would injury myself again and that he decided this before I came back. .

I get that I was temporary, so they could let me go at anytime. But the reasons he gave seems wrong and maybe illegal. .

I was planning on talking to a lawyer, but they all want a consultation fee and I don't have much to spare (burned through most of my savings while I was on disability, because I was only getting half a paycheck). So I'm just trying to get some advice so that I'm not giving money to a lawyer to tell me that I have no case.

An acquaintance let a drunk person pass out and vomit in their sleep at a party. The drunk person suffocated and died. How much legal trouble could the acquaintance be in?

    Posted: 30 Mar 2018 07:32 PM PDT

This incident happened a few years ago at a college party. The acquaintance admitted to the incident a few months ago in a group chat, but just got subpoenaed today, apparently someone anonymously told the police. He said he knew the person was impaired but did not roll him over and the drunk person ended up choking to death. How much legal trouble could he be in, and additionally how much legal trouble could the chat group members be in for not immediately reporting the incident?
