Legal Advice Bait-and-switch employment, employer asking for resignation letter

Bait-and-switch employment, employer asking for resignation letter

    Posted: 04 Jan 2018 07:26 AM PST

So I interviewed for an intern role at a big company in NYC this summer and after being onboarded in the fall discovered that my responsibilities and tasks were nothing even remotely similar to the described position.

I endured this for a few months because I had been given assurances that I would be joining the team as a full-fledged member after a "trial" period, hoping that if I demonstrated good faith things might change, but instead have been harassed, refused resources to do my assigned work, and when I finally confronted the director of my department about these issues she acquiesced that I hadn't been treated fairly and then immediately moved to make me resign this month.

They're asking for a resignation letter, but I'm worried about this impacting my chances of unemployment, in addition to the fact that I would never have taken the job had I know that they intended to bait and switch me.

I'd really appreciate any advice you might share. I know there are statutes in NY's labor laws that construe good cause for employees leaving an employer who would never have taken a job had they been made aware of certain conditions or if conditions of employment that were offered are not fulfilled (under 1735A, wages: https://labor.ny.gov/ui/aso/Section_1600.htm#1735)

I'd really appreciate your help or thoughts if you've ever been through anything like this before.

EDIT: thank you all for your comments and advice, you've all been very helpful.

Upon doing some reading I've realized that I still have an open claim from my last role and that finding employment in the interim does not disqualify me from returning to the previous claim for the benefit year.

As upsetting as this experience has been, I would prefer to keep this bridge un-torched, so I'll be sending in a resignation. Regardless, I'll go back to making more on unemployment than I'm getting paid for full time work. 😑

Came home to find my apartment boarded up and was told I cannot enter it until 5PM, and my roommate couldn't leave it. (Oregon)

    Posted: 03 Jan 2018 09:47 PM PST

I came home from vacation today at 2pm. When I walked up to my 2nd floor apartment, I was shocked to find a construction team in the entryway (they've been doing renovations for months on various parts of the building), with no way up the stairs to my apartment, and my door boarded up. My roommate was in the apartment trying to leave for work and they told us no one could go in or out of the apartment until 5pm.

I called my apartment manager and she told me that she was "sorry for the inconvenience" and that their email hadn't been working and therefor they didn't know that this was taking place today since the construction crew contacts them via email. I also find it hard to believe that they didn't know soon after the work was started this morning.

The apartment manager offered us a gift card to a restaurant as compensation, however I feel it's not only completely insane, but also a huge health and safety issue to lock someone out but especially IN their 2nd floor apartment from 8-5 and with no notice!

Suggestions on what to do? I was thinking about asking for a rent decrease instead.

This is supposed to happen again tomorrow and so now I have to rearrange my schedule as well.

Edit: Posting this for a friend, If you have questions I'll relay the answers as soon as possible

[TX] Update on severed child's ponytail and a bag full of hard drives.

    Posted: 04 Jan 2018 11:20 AM PST

The story of my friend's mother-in-law's weird boyfriend, the severed ponytail, little girl's clothes (visibly worn, not new) and hard drives in his rucksacks.

Police checked to see if there were any cases of missing girls in the area with similar hair or clothes to what was found, and it was a nope. As for the hard drives: My friend couldn't find anything on them because the folders were 'hidden'. Police found a bunch of porn (not a surprise) and some stuff about tax fraud and prescription drug sales, but they were for the MIL's pills and they were her tax documents too, and she's dead, so they're putting all that illegal stuff on her and saying they can't do anything about it now. Oh well.

Just want to take this opportunity to add that my friend's MIL (this guy's girlfriend) is the same woman that had him arrested for domestic violence and wanted rid of him before she died. She was ~50 years old and dropped dead of a heart attack. When they went into her home all of her pills (including blood pressure meds which she relied on) were missing and her bank accounts were also cleaned out (which my friend later found out after paying $3k in legal fees to get access to her accounts and storage units). Anyway, she died in weird circumstances, and no one knows where her meds or money went.

ANYWAY. This guy has a child and he was basically in hiding so he couldn't be tracked down for child support, and there was a warrant. My friend told the mother where she had heard he was working, the mother found him and now he's in jail for $13k in unpaid child support. So, at least this scummy guy ended up in jail eventually. My friend never got the car he stole back though, since he still insists it was a "gift".

TL;DR: Friend found a ponytail, children's clothing and a bunch of blank hard drives in her MIL's dodgy criminal boyfriend's rucksacks. She turned them in to police, who found a bunch of porn, tax fraud and prescription med sales stuff on them, but no source for the ponytail or clothes. He couldn't be arrested for that, but was arrested for unpaid child support.

[Oklahoma, US] Found a possible ancient Indian burial ground (no, seriously). Am I required to notify anyone?

    Posted: 04 Jan 2018 02:58 AM PST

Lots of backstory, please bear with me.
My mother's side of the family has lived in the small town I currently live in since the 1890s. All of them have the surname [M].

My town has no stop lights and only a gas station in terms of business, for reference, so it's pretty tiny. The M family was pretty influential back in the day, and in the middle-y bit of the original M land, there is a large hill that came to be known as M hill- this is where my house stands today, important for later. At one point there was actually a small town called M, named after my family, and though it was only formally a town for 5 years in the early 1900s (before we were formally a state) it's still shown as a town on most modern maps of the area, interestingly enough.

    Anyways, that's probably enough backstory.

Researching the town M online in about 2014, I found a site featuring Oklahoma "ghost towns" that mentioned ours- and it also mentioned the burial ground. The information was vague, though, and I didn't think that much of it. Last year, at my hoarder grandfather's house, I found a binder full of newspaper clippings, letters from my great-grandmother M, family pictures, etc all compiled by a distant relative. In it was an piece about M family's acquiring of land and how it was eventually split up by their children and such, and it talked about the discovery of a burial ground by original settler M [X] parts of a mile East of M hill. As I mentioned earlier, my house is at the top of M hill.

So naturally that was kind of a what-the-hell moment. None of my neighbors or living relatives know anything about an Indian burial ground ANYWHERE in the area, and [X] parts of a mile down the road that way from my house is a fenced in, wooded area not owned by my relatives. The people who own it live on the property and own horses.

Legally, is there someone I notify about bones that are 100+ years old in the ground? The tribes are each separate entities and I don't know which specific one to notify, or how. Like, what department do you call for "ancient Indian burial ground consultation"? Considering notifying someone could lead to these neighbors losing the land their horses live on, am I legally required to, since it's a graveyard? Are tribes allowed to repossess land, legally speaking, for this?
If the mods deem it acceptable, I would be happy to share the county if it helps to identify which tribe this might belong to- from my Google searches, though, it looks like several tribes have been forcibly located and relocated here.

Foreign court date due - but wasn’t in the country/didn’t have a passport when crime was committed

    Posted: 04 Jan 2018 05:35 AM PST

I was living in Ibiza, Spain from the start of Summer 2013 to end of Summer 2014, and was arrested for possession of laughing gas with the intent of sale (I wasn't actually selling, I just had a large personal supply, what isn't illegal in anyway) in 2014. A month later, my passport was stolen in Ibiza and I had to use an emergency passport issued from my embassy to travel back home with.

In 2016 I relieved a letter saying that a court date is due, and I have been found guilty of the above crime committed in Ibiza, July 2015. From the time my emergency passport was issued (September 2014) till June 2016, I didn't own a passport, and didn't leave my home country.

I am now due in court for my hearing, but if they are accusing me of a crime that happened in July 2015, and I have proof that I wasn't in the country, and didn't own a passport to even leave my home country on the said date, will it be void?

    Landlord won't fix furnace.

    Posted: 04 Jan 2018 05:43 AM PST

My family and I have lived in our apartment since August 2016 and since then it's been sold twice. The original landlord told us that the furnace didn't work, but they were planning on getting it fixed before winter. Well we weren't really in a position to shop around so we agreed.
So long story short, furnace never got fixed, talked to new owner about it in October, new landlord won't fix it claiming my wife told her that we'd be fine - what my wife actually said was that we'd be fine for now, as in its October so we don't need it right this second, assuming that it would be fixed before winter.

Anyway, we live in Wisconsin so the temp gets to be a bit of an issue. I'm able to keep my apartment relatively warm with space heaters, but I don't really like that since they are both a fire hazard and I have kids so there's the danger of them hurting themselves.

I'm not sure what my options are at this point since 1.] We've lived with it for so long already, do we have much recourse in forcing the repair? 2.] I know the statue says that I can withhold rent but not how much, or if any money I withhold needs to be paid anyway once the repair is made. 3.] Any other info/ advise would be helpful.

Is she doing this eviction correctly/legally?

    Posted: 04 Jan 2018 06:55 AM PST

I live in Texas and have lived in this house for 2 weeks. We just paid rent on the 2nd for the month. Our landlord called us the 1st, but we didn't answer as we were out and we didn't have our phones on us. So she took it upon herself to let herself into the house. In her lease she does put that she doesn't need notice. My brothers cats got dumped on me to stay until today, she found them of course. She showed back up pounding on the door that night. I answered and she told me she was coming in. Told me the cats are unacceptable. And also that the house was a mess,we are still unpacking so yes there are boxes still in the dining room and things aren't organized yet. She told us she would sleep on thinking about evicting us, but that she would stop by at our job the next day to pick up rent. She did and everything seemed fine, she said she was going to stop by Friday to make sure the cats were gone. We come home today and she's typed out an eviction notice saying we need to be out in 7 days. Now she won't answer her phone. I'm not positive it was legal for her to put in her lease that she could enter without notification. Also in the lease and by Texas law she needs to have on every exterior door a dead bolt that doesn't open from the outside and has either a window or peep hole. The front door has neither and the back has only a window, so I know she broke that part of the lease. Also I wanted to know if we have a right to our deposit back as well as any of this months rent as it seems now like she pretended like she wouldn't evict just to get the rent and keep it. This landlord is also the homeowner who I never gave my social security number or credit information so will this hurt my credit or renters history? We've paid just about $4,000 to move into this place and in rent to live in this place for 2 weeks and we can't even get in contact with this woman. Also something I noticed is that on the eviction notice she has the date next to her signature as 1/1/18, when though on the second she collected rent and told us everything was fine and she would stop by Friday to make sure the cats were gone.

[Virginia] My mom won't pay personal property tax she put in my name

    Posted: 04 Jan 2018 08:15 AM PST

When I was 17, my mom went to prison for selling drugs. She got out when I was 18 and I wanted to help her get back on her feet. She asked me if she could buy a car and register it in my name for whatever reason. I can't remember why now but I did it because I wanted to help her and I was young and stupid. Now I am 25 and got a "Final Notice" in the mail about personal property tax for all the vehicles she has put in my name since 2014 that she refuses to pay ($415). I also did not receive any of the mail until this final notice so numerous late fees have been added on.

I have confronted her about it and she keeps saying it's not right, that she doesn't owe that amount. She basically doesn't care if it reflects on me and my credit. Do I have any legal way to get her to pay this, or am I going to have to pay it? I haven't even owned a car since she's done this but because she registered them in my name I think I'm probably stuck with the cost...

edit: Thanks everyone for your responses. I'm going to go ahead and pay it. Can I get in legal trouble for making this mistake?

[USA] Are all the editions of Ayn Rand's Anthem in the public domain?

    Posted: 04 Jan 2018 06:53 AM PST

Saw a post on r/todayilearned about how her novel became public domain. I found out that there are actually 3 editions :

    1. The original one published in 1938 (which became public domain in 1966)
    2. A revised edition released in 1946 (which had some minor changes with modern wording and sentences)
    3. 50th anniversary edition released in 1995. Same as 1946 edition with an personal letter from the publisher
EDIT: I'm seeing conflicting information : The anniversary is actually the 1938 edition with some extras

I saw the scanned copies. Both 2 and 3 have copyright notices on them. This makes me wonder:

Is it legal to get material under public domain, modify it and be able to copyright it again? Is the 1946 edition in the public domain?

The 50th anniversary edition has this:

Introduction and appendix copyright © name of publisher

Does this mean other than the index and appendix sections, the remainder of the book is in public domain

[CA] Blue Shield CA told me my renewal premiums were $360 then charged me $630

    Posted: 04 Jan 2018 08:00 AM PST

The new year is off to a shitty start for me. Apparently, my Blue Shield Gold health insurance plan has skyrocketed in price; I've just been billed $631.11, up from last year's monthly premium of $302. There's been no significant changes in my life, I'm still unemployed, and I'm a healthy single late 20's guy. (I'm the only one on the policy, thru CoveredCA; didn't even use the insurance at all in 2017.)

    The 110% increase bill

My beef isn't even with the 110% price increase; it's the fact that in every single communication I have received thus far, they have said that the renewal price would have been $360. I got a letter in the mail that said that $360 figure. Even if I were to go to my blueshield account online right now, this is what I see:

    Blue Shield renewal screencap

As you can see, it's pretty clear that if I chose to "Keep my plan", it looks like I'm supposed to be paying $360/mo for 2018. So I gave them a call. The rep claimed that the reason my price is $630 and not $360 is because the $360 doesn't take into account any gov't subsidies (which I do not have). However, that's not what the renewal screen says; if you compare the column on the left (the 2017 plan) with the column on the right (the 2018 plan), the first row is supposed to indicate pre-subsidized premium; the second row is the subsidy; and the third row is the post-subsidy premium. Arguing with the rep didn't seem to change anything so he said he would escalate to his "legal department" and expect a response in 15-30 days.

Unfortunately the Open Enrollment period would've ended by then, and that doesn't do anything about the $630 they've already charged me. Basically, the heart of the matter is that if I had known my premiums would be so high, I would never have kept that plan. I've been told one figure but then charged another. It's almost like they had a blank check, they could've billed me a million bucks and I wouldn't have known about it till it was too late.

    What I'm wondering is:

    • Has anybody else been misled or experienced such a discrepancy with their renewal costs? If so, is there grounds for a class action suit?

    • Is there any way I can get back the money I've already been charged?

She got the money back and kept the items, so obviously this is fraud, but who do I report this to? How much info will they need? She's long been a liar and a thief and its time that she gets punishment for it.

Edit: She's no longer a roommate, and this happened several months ago and nothing has since happened to her.

Fired from a job because I called out to work at my better job. I am now banned from the property and they refuse to give me my final paycheck.

    Posted: 03 Jan 2018 07:25 PM PST

This is in Virginia. I called out sick because my better job needed me to come in with further advance. My ex-boss then called that job 3 different times asking for me. The third time I answered, and I was told that I was fired. I went to collect my final paycheck, they said it wasn't ready and to come back in a week, even though everyone else received their pay. When I showed up a week later, they said that I was banned from the property. What legal steps should I take now? Thanks.

    Debt accrued for motel stay

    Posted: 04 Jan 2018 08:25 AM PST

Good morning and thanks for any advise in advance. I am not versed in legal matters.

I work for a company that does full time travel. I stayed in a motel and [like many times before] had to put my card down for incidentals [25usd] along side the company card which pays for all the lodging, airfare, and car rentals. There was a mix up with the staff and my card that I put down for incidentals was charged 1700+ usd for a two week stay instead of the company card. My travel agent worked to get the company card charged and get me refunded. Two weeks after my stay I still have not been refunded. By the way, the company has a policy to not directly refund me for expenses that are accidental like in this case. So I call the lady that handles my travel. I get the poc for the motel's info and I give her a call. She tells me she is going to put through the refund and I should see it in 5-7 business days. Two more weeks go by without me being refunded. I give the motel the benefit of the doubt because luckily I will be working in that city and staying at the motel the week after xmas. When checking in I inquire the young lady at the desk. She informs me the sales manager will not be at work until after I check out but, she tells me she sees were my company's card was charged for the visit in question yet cannot see were I have been refunded. The lady tells me that she will inform the sales manager when she returns monday of this week and takes down my number. I have called the sales manager Tuesday, wednesdays, and this morning and the sales manager is always out when I call. Today I have no pending transactions to the credit card that was charged. I have had this suspicious feeling since December that I am not going to be refunded

I am begining to think it is time to bring in some legal representation because I feel the motel is double dipping and trying to get away with it. My coworkers agree, but none of us have legal knowledge or know where to start other than asking a lawyer and going through a consultation. Any advice is welcome. Also if anybody has been in a similar situation, would you please share your experience and wether or not you were able to obtain a refund without going to court.

    Thank you all very much.

[NY] On the deed, but not the mortgage of my house. Ex has fallen ill. Is it time to lawyer up?

    Posted: 04 Jan 2018 08:05 AM PST

Less than 10 years ago I purchased a home with my ex boyfriend (we never married). I had little credit history so we decided that I would supply the down payment, he would go on the mortgage, both of us would be on the deed. I have the deed in my possession.

I learned recently that he has fallen very ill, I'm not sure of the seriousness.

Are there repercussions of me not contributing to the house since my departure? He had children from a previous relationship (adult aged) would they be entitled to his half of the house? Would they have a stronger claim over me due to his contributions? Is there anything else I should be doing or considering aside from scheduling a consult.

Also, I saw this comment when searching previous posts to an answer for my questions. Can someone ELI5?

I'm not sure what my "goal" is, ultimately at absolute minimum I would want what I put in plus earned interest (can't think of the right wording, but percentage increase in any value the property has made). Half or whole would be a solid win obviously.

    Thanks in advance.

Child support question/issue with ex massively behind payments - MI

    Posted: 04 Jan 2018 07:14 AM PST

    Greetings

looking for a quick answer to this question. Following my divorce 26 months ago I was awarded primary parenting time of my two daughters. The courts ordered a total of $453 per month + 20% of medical expenses from my ex. When we divorced it was verbally decided at the time my ex would simply go away, she wanted to be with someone else and left both me and our two daughters. about six months later she realized what she lost (and got dumped) and came back. Ive been collecting less than i am owed since then and here is the break down as of right now

    $453 x 26 months of divorce = $11,778 actual child support ive collected = $4,660

this is not including the medical expenses of regular check ups, vaccinations and dental checkups but i believe i am past the point of collecting these as they need to be reported within 28 days.

Here is my question - while things have been fairly status quo ive become quite tired of collecting less than im due. I was told by my attorney that altering the parenting time over the long term can make it stand with the court. meaning if i just voluntarily give her more time with the kids she can go to the courts and get it mandated.

My question - is it the same with child support? Ive complained until i am blue in the face about how little i am paid yet i know my ex lives paycheck to paycheck - so if i were to report her to the courts i believe very bad things will happen to her. She says she doesnt owe me anything since i accept what she gives me, she says that means she doesnt owe me a dime over the meager sum she pays for the kids and since i accept what she gives there is no passed due sum despite her being over $7,000 in arrears. Is this true? If its not true - what kind of consequences would my ex face if/when i decide to take this to the courts?

little more information - We did NOT opt out of Friend of the Court (which manages child support in michigan) however we did opt to do a straight payment from her to me rather than run it through the courts at the time.

My sister is evicting my parents.help please.

    Posted: 03 Jan 2018 10:44 PM PST

Our house is in my sisters name but she only owns 40%, the 60% of the payment is being made by my parents and the rest of my sisters. Bills and utilities are split equally, phones are individual. Most of the bills are in my parents name. She got married and without notice, she informed us that she had an investor purchasing the house. We have no intention of moving out since this house is approved by medical insurance for my mom's dialysis and kidney transplant. My parents are seniors and disabled. Can we fight it?

Edit:thanks for the replies, I was honestly just verifying.. appreciate your time!

(MI) I applied to live in an apartment and chose unit based on move-in date (got it in writing). Now the company wants to change my move-in date and won't give me the option of another unit.

UPDATE: The manager heard my story and was very apologetic. She offered to change our application for another unit of the same floor-plan that became available today with a guarunteed move-in date of January 18th, which we accepted. Thanks-

I applied to live in a huge apartment complex (biggest in MI), got approved, and accepted a unit based on move-in date, among other things. I was told I could move in on January 27 (and I was given the new address and move-in date in writing), which was already later than I wanted because my husband starts his new job on the 29th, but it is what it is. When I called to complete the application process the leasing agent informed me that the move-in date had changed to the 29th.

This causes a massive inconvenience for my husband and I. We have already subleased our current apartment for Feb. 1 and hired cleaners to come in Jan. 31 in our current place, so we really only have 2 days to move. Compound all of that with the fact that I am pregnant and moving is already going to be difficult, and now we don't even have any guarantee of a place to live when we need it.

There was never any mention that the move-in date could change. I don't believe that is a common knowledge sort of thing that the agreed-upon move-in date can change like that. Can they change the move-in date like that, after the fact? I would even take a different unit, we just need a place before the 29th at least.

Employer changing worked day to show 0 hours worked

    Posted: 04 Jan 2018 07:01 AM PST

So a little background. Company I work for merged awhile back and rules changed. The one this is about was that if you have Monday as a normal day off you no longer get holiday hours for any holiday observed on Monday by the rest of the company. Bullshit by itself but doubt that is illegal.

The part I am not sure about is that because they cannot get the time clock (Kronos) to show 0 hours for the holiday instead they are changing the next working day to show 0 hours worked but I still have to be at work and click in as normal, they don't change it until the end of the 2 week pay period. Is there anything I can do?

    Edit: Forgot location. It's Ohio.
